B.                  MODIFICATIONS TO THE AGENDA

1.                   Agreement with the Federal Emergency Management Agency for Floodplain Mapping in Orick and Blue Lake. (CONSENT)

RECOMMENDATION: That the Board of Supervisors review and approve the attached Mapping Activity Statement No. #1 (MAS No. #1) with the Federal Emergency Management Agency (FEMA) and authorize the Public Works Director to sign MAS No. #01 and to apply for the associated FEMA grant funding; and direct the County Administrative Office to incorporate the attached revenue and expenditure items into the final budget for FY 2011-12.

2.                   Supplemental Budget for Transportation Services - TDA Funds for FY 2010/11 (CONSENT).

RECOMMENDATION: That the Board of Supervisors adopt the attached supplemental budget in FY 2010/11.

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Board of Supervisors

1.                   Resolution Recognizing Chief Kris Kitna Upon His Retirement. (Supervisor Clendenen)

RECOMMENDATION: Ratify Authorization to Adopt the Resolution.

2.                   Letter of Appreciation to John Chiv for Serving on the Humboldt County Human Rights Commission. (Supervisor Virginia Bass)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

3.                   Informational Item Announcing the Appointment of Keith Taylor as a District 3 Representative on the Humboldt County Human Rights Commission. (Supervisor Mark Lovelace)

RECOMMENDATION: Receive the report on the appointment of Keith Taylor to the Human Rights Commission as a District 3 representative.

Community Development Services

4.                   Dissolution of Green Employer Council.

RECOMMENDATION: That the Board of Supervisors receive staff report; and dissolve Green Employer Council (GEC) as a committee of the Humboldt County Workforce Investment Board due to grant funds ending and thank council members for their service.

County Administrative Office

5.                   Set Public Hearing for Adoption of Fee Updates.

RECOMMENDATION: Direct the Clerk of the Board to schedule a public hearing on Tuesday, August 23, 2011, at 1:30 p.m. or as soon thereafter as the matter may be heard, for consideration of adoption of an ordinance updating the Humboldt County Schedule of Fees and Charges.  Direct the Clerk of the Board to post and publish the required pre-adoption summary of the ordinance and public hearing notice for updating the Humboldt County Schedule of Fees and Charges at least ten (10) days prior to the public hearing; two publications are required, with a t least five (5) days intervening between the dates of the first and last publication, not counting such publication dates.  Direct the Clerk of the Board to have the data and documentation supporting the new fees for public review at least ten (10) days prior to the public hearing.  Direct the Clerk of the Board to post a certified copy of the full text of the proposed ordinance in the office of the Clerk of the Board of Supervisors at least five (5) days prior to the Board meeting at which the ordinance will be adopted (Government Code Section 25124(b)(1).

County Counsel

6.                   Special Assessment for Unpaid Administrative Penalty Russell Papstein - 4181 Weiler Road, Eureka, California, AP# 019-161-021.

RECOMMENDATION: That the Board of Supervisors, pursuant to Humboldt County Code Section 2131-8 (e), adopt the Resolution in Attachment A declaring a special assessment against real property for an unpaid administrative penalty.

Health and Human Services - Mental Health Branch

7.                   Agreement with Crestwood Behavioral Health Inc. for Fiscal Year 2011-12.

RECOMMENDATION: That the Board of Supervisors approve the Agreement between County of Humboldt and Crestwood Behavioral Health, Inc (CBHI) for Fiscal Year 2011-12; and authorize the Chair to execute three copies of the Agreement effective July 1, 2011; and direct the Clerk of the Board to return two copies of the executed Agreement to the Department of Health and Human Services, Mental Health Branch Administration.

Public Works

8.                   Storm Damage Repairs on Mattole Road (3C010) at P.M. 6.60, Project No.: ER-4400 (060), Contract No.: 206394.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with Bids to be opened on Tuesday, August 23, 2011 at 2:00 PM.

9.                   Letter to U.S. Fish and Wildlife Service Regarding Need for Enhanced Predator Management and Public Involvement for Western Snowy Plover Recovery Efforts in Humboldt County.

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Board to sign the attached letter to U.S. Fish and Wildlife Service requesting a decision whether or not to implement a predator management program to address crow and raven impacts on western snow plovers within Humboldt County, and requesting enhanced public outreach efforts.

Sheriff

10.               Firewood Distribution Agreement between the County of Humboldt and the Humboldt Senior Resource Center.

RECOMMENDATION: That the Board of Supervisors authorize Sheriff Michael Downey to sign the Senior Wood Agreement between the County of the Humboldt and the Humboldt Senior Resource Center outlining this year's firewood distribution process for low to moderate income senior citizen's of the County.

Treasurer-Tax Collector

11.               Resolution to Auction Tax-Defaulted Properties.

RECOMMENDATION: That the Board of Supervisors approve resolution no. _____ and direct the Clerk of the Board of Supervisors to provide the Treasurer-Tax Collector four certified copies of the Resolution by July 29, 2011.  Approval is given to re-offer unsold parcels in accordance with Revenue and Taxation Code, section 3698.5.

D.                 SPECIAL PRESENTATIONS

1.                   Resolution Honoring the 100th Anniversary of Fernbridge, the "Queen of the Bridges". (Supervisor Smith & Supervisor Clendenen)

RECOMMENDATION: Authorize Chair to sign the Resolution.

1.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.

G.                 DEPARTMENT REPORTS

County Administrative Office

1.                   County Administrative Officer Report: Federal Legislative Update and Various Other Topics.

RECOMMENDATION: That the Board of Supervisors receive and oral report from the County Administrative Officer on federal legislative advocacy, and various other topics, and take action as may be required.


2.                   Adoption of Fiscal Year (FY) 2011-12 County Budget.

RECOMMENDATION: Approve the attached Resolution (Attachment A) adopting the proposed budget, as modified by the Final Budget Adjustments listed on Attachment B, as the final adopted budget for FY 2011-12.  Approve the attached personnel allocation table (Attachment C) corresponding to the budget appropriations.  Authorize the County Administrative Office, after consultation with Personnel, to make substitutions to positions designated as frozen on the attached personnel allocation table (Attachment C) as may be required by the needs of departments.  Direct the Personnel Director to rescind any layoff notices that have been issued and cease the issuance of any pending layoff notices for the following positions:  1.0 full time equivalent (FTE) Administrative Secretary (MC) (class 0166), 2.0 FTE Legal Office Assistant I/II (class 0178), and 8.0 FTE Deputy Sheriff I/II (class 0416) positions in budget unit 221; 3.0 FTE Probation Officer I/II (class 0473) positions in budget unit 235; 1.0 FTE Office Assistant I/II (class 0179 and 2.0 FTE Animal Shelter Care Attendant I/II (class 0440) positions in budget unit 278.  Designate 2.00 FTE currently filled Deputy Sheriff I/II (class 0416) positions in budget unit 260 as allocation type F0, effective October 1, 2011, and authorize the Personnel Department to work with the department to begin the layoff process for the affected positions.  Remove the F0 designation from 1.0 FTE Administrative Assistant to the Board of Supervisors (class 0111) position in budget unit 101, effective at the beginning of the next biweekly pay period following approval.  In recognition of the new F0 and F1 position allocation types, terminate the hiring freeze originally adopted on June 3, 2008, as of August 7, 2011.  Direct the County Administrative Office and Personnel Director to work with department heads to develop a process to more effectively control filling of extra help positions, and return to the Board of Supervisors no later than the First Quarter Budget Review with a proposal.  Authorize the Auditor-Controller, in conjunction with the County Administrative Office, to establish the County Local Revenue Fund 2011 and all associated accounts as required by Government Code 30025; and take other action as appropriate.

Community Development Services

3.                   Approval of the Headwaters Fund Board's Grant Award of $200,000 to the Humboldt Bay Harbor, Recreation and Conservation District for the Humboldt Bay Mariculture Expansion Project.

RECOMMENDATION: That the Board of Supervisors by a 4/5ths vote; review and approve the Headwaters Fund Board's recommended Community District for the Humboldt Bay Mariculture Expansion Project and authorize the Chair of the Board to sign the grant contract after review and approval by County Counsel and Risk Management.

H.                  MATTERS SET FOR TIME CERTAIN

I.                     CLOSED SESSION

1.                   Conference with Labor Negotiator - Pursuant to Government Code Section 54957.6, it is the intention of the Board of Supervisors to meet in closed session to review the County's position and instruct its designated labor negotiator with respect to the various forms of compensation provided to the County's represented and unrepresented personnel.  Negotiator:  Dan Fulks. Employee Organizations:  American Federation of State, County and Municipal Employees (AFSCME local 1684), Humboldt County Attorneys Association, Humboldt Deputy Sheriffs' Organization (Law Enforcement Non-Management Unit), Elected & Appointed County Officials, and Management & Confidential Employees

J.                   PUBLIC APPEARANCES--1:30 P.M.

K.                  ADMINISTRATIVE ABATEMENT HEARINGS

L.                   PUBLIC HEARINGS

Community Development Services

1.                   2010 Housing Element Implementation - Multifamily Rezoning Program (H-1M17 and H-1M18).

RECOMMENDATION: That the Board of Supervisors open the public hearing, introduce the proposed ordinance by title and waive further reading, receive a staff report, open the Public Comment Period and accept public comment, close the Public Comment Period, deliberate on the proposed revisions to the Housing Element, review and consider the proposed draft and final subsequent Environmental Impact Reports (FSEIR) for the multifamily rezoning program (SCH #2009022077), approve the FSEIR Findings of Fact, approve the FSEIR Statement of Overriding Considerations, and certify the FSEIR by approving Resolution 11- _________(Attachment 1), adopt the proposed plan and zoning changes by approving Resolution 11- ________ (Attachment 2).  Approval of the proposed rezones for properties in the inland areas will become effective 30 days from the date of its passage.  Approval of the proposed rezones for properties in the coastal zone will all become effective upon certification by the Coastal Commission.  (The Resolution also directs staff to submit the proposed amendments to the Coastal Commission for certification).  Adopt Ordinance No. _________(Attachment 3), which amends Section 311-7 of the Humboldt County Code (Designation and Adoption of Zoning Maps) by reclassifying the zoning of selected candidate sites to Qualified R-3: Residential Multifamily (Inland Areas), and Qualified RM-Residential Multifamily (Coastal Areas), and carrying forward all existing and combining zones.  Direct the Clerk of the Board to publish a Summary of the Ordinance along with a map of the selected candidate sites (Attachment 7) within 15 days after adoption of the ordinance by the Board, along with the names of those Supervisors voting for and against the Ordinance and to post in the Office of the Clerk of the Board of Supervisors a certified copy of the full text of the adopted ordinance along with the names of those Supervisors voting for and against the Ordinance.   Direct the Clerk of the Board to give notice of the Zone Reclassification to the Assessor, by sending that office a copy of the executed Ordinance signed by the Chair and the Clerk of the Board.  Provide direction to the Planning Division staff regarding the timing of review for the next set of multifamily rezones and revisions to the Housing Element or Housing Element implementation ordinances.
