B.                  MODIFICATIONS TO THE AGENDA

1.                   Endorsement of a Redwood Coast Regional Broadband Consortium Grant to the California Advance Services Fund (CONSENT). (Supervisor Mark Lovelace)

RECOMMENDATION: Authorize Chair to sign letter of support.

C.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Agricultural Commissioner

1.                   Approval of United States Department of Agriculture Wildlife Services Agreement No. 11-73-06-0254-RA.

RECOMMENDATION: That the Board of Supervisors approve Cooperative Agreement No. 11-73-06-0254-RA, Known as the United States Department of Agriculture Wildlife Services conract, and authorize the Chair to sign all three (3) copies of the agreement, and return all three signed copies to the Commissioner's office for further processing, and Grant a waiver of the Nuclear Free Ordinance.

2.                   Approval of Cooperative Agreement No. 11-0250-SF, European Grapevine moth Program Contact in the amount of $8,764.

RECOMMENDATION: That the Board of Supervisors approve Cooperative Agreement No. 11-0250-SF, known as the European Grapevine Moth Program contract between Humboldt County and the California Department of Food and Agriculture, authorize the Chair to sign the original agreement and one copy of the cover page and direct the Clerk of the Board to return all signed copies to the Agricultural Commissioner for further processing and grant a waiver from the provisions of the Nuclear Free Ordinance

3.                   Approval of Standard Agreement No. 11-0195-SA, Nursery Inspection and Enforcement Program Contract in the amount of $2,600.

RECOMMENDATION: That the Board of Supervisors approve Standard Agreement No. 11-0195-SA, known as the Nursery Inspection and Enforcement Program contract with the California Department of Food and Agriculture in the amount of $2,600; authorize the Chair to sign the original agreement, one copy of the cover page, and direct the Clerk of the Board to return all signed copies to the Agricultural Commissioner's office for further processing and grant a waiver from the provisions of the Nuclear Free Ordinance.

4.                   Informational Item Announcing the Reappointment of Lora Canzoneri as a District 5 Representative on the Humboldt County Housing Authority Commission. (Supervisor Ryan Sundberg)

RECOMMENDATION: Receive the report on the reappointment of Lora Canzoneri to the Humboldt County Housing Authority Commission as a District 5 Representative.

5.                   Certificates of Recognition Honoring Arcata Police Officer Brandon Fox, Officer Brian Hoffman and Detective Sergeant Todd Dokweiler. (Supervisor Mark Lovelace)

RECOMMENDATION: Ratify Certificates of Recognition.

6.                   Request from the Humboldt County Fish & Game Advisory Commission to Fund Two Grants; City of Arcata - Upper Beith Creek Fish Habitat Restoration Program and the Cuddeback Unified Elementary School Salmon Time: Life Cycling Program. (Supervisor Smith)

RECOMMENDATION: Approve grant allocations as requested and direct the Clerk of the Board to notify the Secretary of the Humboldt County Fish & Game Commission (Nancy Katis-Slocum) of the approval.

7.                   Letter of Support for Wiyot’s Tribe's Request to Approve Converting Land into Trust in Madera County for the North Fork Rancheria. (Supervisor Lovelace)

RECOMMENDATION: Authorize Chair to sign Letter of Support.

8.                   Letter to State Board of Forestry and Fire Protection Urging the use of Regulatory Authority to Improve ABX1 29 Implementation. (Supervisor Mark Lovelace)

RECOMMENDATION: Authorize Chair to sign letter.

Community Development Services

9.                   Resolutions authorizing Chair of the Board execute agreements with the Department of Water Resources for a $500,000 grant for Implementation and Administration of the North Coast Integrated Regional Water Management Disadvantaged Community Pilot Project and a $2,176,860 grant for the North Coast Integrated Regional Water Management Proposition 50 Round 2 Supplemental Implementation Project; authorize Community Development Services Director to sign and execute Sub-Grantee Agreements.

RECOMMENDATION: That the Board of Supervisors approve Resolution No. ______ (Attachment A) authorizing the Chair of the Board to sign an agreement for $500,000 from the Department of Water Resources for the North Coast Integrated Regional Water Management Disadvantaged Community Pilot Project for administration and implementation of a pilot project targeted at small water and waste water providers in the North Coast and authorize the Community Development Services Director to sign any Sub-Grantee Agreements and any amendments thereto; approve Resolution No. _____ (Attachment D) authorizing the Chair of the Board to sign an agreement for $2,176,860 from the Department of Water Resources for the North Coast Integrated Regional Water Management proposition 50 Round 2 Supplemental Implementation Project (Attachment B) for administration and implementation of four projects in coastal watersheds in the North Coast and authorize the Community Development Services Director to sign any Sub-Grantee Agreements and any amendments thereto.

Probation

10.               Resolution authorizing Submission of Application to the California Department of Corrections and Rehabilitation - Corrections Standards Authority for Juvenile Accountability Block Grant (JABG) Evidence Based Practices Program.

RECOMMENDATION: That the Board of Supervisors adopt the attached Board of Supervisors Resolution a) authorizing the Chief Probation Officer to sign and submit the 2011 Evidence Based Practices Program applications (Attachment 1) to the California Department of Corrections and Rehabilitation -Corrections Standards Authority (CSA), b) agreeing Federal funds obtained through this grant will not be used to spplant existing expenditures, and c) agreeing the County will abide by the statutes and regulations governing the JABG program as well as the terms and conditions of the grant application as set forth by the CSA including the provision of matching funds; Direct the Clerk of the Board to return the Board Resolution the Humboldt County Probation Department attn: Jody Green.

Public Works

11.               Supplemental Budget for FY 2011/12 for Jet Fuel Truck.

RECOMMENDATION: That the Board of Supervisors adopts the attached supplemental budget for FY 2011/12.

Sheriff

12.               Equitable Sharing Agreement and Certification

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Board of Supervisors and the Sheriff to sign the Equitable Sharing Agreement and Certification; instruct the Clerk of the Board to return the signed document to the Sheriff's Office for further processing.

13.               Supplemental Budget in the Amount of $55,248 in Budget Unit 1100274 for Tsunami Siren Warning Equipment.

RECOMMENDATION: That the Board of Supervisors approve attached supplemental budget in the Sheriff's budget 1100274, Office of Emergency Services (OES), in the amount of $55,248 to install new and retrofit old tsunami siren warning equipment.

14.               Supplemental Budget in Sheriff's Homeland Security Budget 1100 213 for Expenditure of Funding from the FFY 2010 Governor's Office of Homeland Security Grant.

RECOMMENDATION: That the Board of Supervisors approve supplemental budget in the amount of $245,959 to purchase approved expenditures under the U.S. Department of Homeland Security grant through the Governor's Office of Homeland Security.

15.               Agreement to Provide Law Enforcement Services within the City of Trinidad.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair to sign the Agreement to provide Law Enforcement Services within the City of Trinidad between the County of Humboldt, through the Sheriff, and the City of Trinidad; and direct the Clerk of the Board to return all documents to the Sheriff's Office, attention Linda Modell for further processing.  A fully executed original of all agreements will be returned for the Board files.

16.               Amendment to Deputization Agreement between the Yurok Tribe and the County of Humboldt.

RECOMMENDATION: That the Board of Supervisors approve the Amendment to Deputization Agreement the Yurok Tribe and the County of Humboldt.

D.                 SPECIAL PRESENTATIONS

1.                   Recognition of Loretta Nickolas Management Academy Graduates.

RECOMMENDATION: That the Board of Supervisors recognize graduates of the Loretta Nickolaus Management Academy and authorize the Chair and County Administrative Officer to execute and present certificates to the graduates.

2.                   Resolution Recognizing Maggie Nystrom Upon her Retirement. (Supervisor Lovelace)

RECOMMENDATION: Adopt the Resolution.

County Administrative Office

1.                   Purchasing Agent County Code Amendment.

RECOMMENDATION: That the Board of Supervisors introduce the attached Ordinance by title and waive the first reading; set the Ordinance for adoption at least one week away; direct the Clerk of the Board to publish the pre-adoption summary of the Ordinance and to post a certified copy of the full text of the proposed Ordinance in the office of the Clerk of the Board, both publication and posting to be done at least five (5) days prior to the Board meeting at which the Ordinance will be adopted. [Government Code Section 25124 (b)(1)]; and direct the Clerk of the Board, within 15 days after adoption of the Ordinance, to publish a post adoption summary of the ordinance with the names of the Supervisors voting for and against the Ordinance, and to post in the office of the Clerk of the Board a certified copy of the full text of the adopted Ordinance and amendments along with the names of those Supervisors voting for and against the Ordinance. [Government Code Section 25124 (b)(1)].

2.                   Response to 2010-11 Grand Jury Report 2011-CD-02.

RECOMMENDATION: That the Board of Supervisors review and modify the proposed response (Attachment 2) from the Board of Supervisors to Grand Jury Report 2011-CD-02; review and modify the proposed Grand Jury responses from departments under the appointment authority of the Board of Supervisors; approve the documents, as may be modified, as the response; direct the Clerk of the Board, within five working days, to submit the final response with an accompanying Board order, to the Presiding Judge of the Superior Court; and direct the Clerk of the Board, within five working days, to submit two copies of all responses to the County Clerk/Recorder, on of which will be forwarded to the State Archivist, together with a copy of the original report.

3.                   Amendment to Humboldt County Code Sections 2131 et seq Relating to Administrative Penalties.

RECOMMENDATION: That the Board of Supervisors introduce the attached ordinance by title and waive the first reading; set the Ordinance for adoption on August 23, 2011 or at least one week away; direct the Clerk of the Board to publish the pre-adoption summary of the Ordinance and to post a certified copy of the full text of the proposed Ordinance in the office of the Clerk of the Board both publication and posting to be done at least five (5) days prior to the Board meeting at which the Ordinance will be adopted [Government Code Section 2524 (b)(1)]; and direct the Clerk of the Board, within 15 days after adoption of the Ordinance, to publish a post adoption summary of the Ordinance with the names of the Supervisors voting for and against the Ordinance, and to post in the office of the Clerk of the Board a certified copy of the full text of the adopted Ordinance and amendments along with the names of those Supervisors for and against the Ordinance [Government Code Section 25124 (b)(1)].

4.                   Amendment to Humboldt County Code Sections 351-1 et seq Relating to Abatement of Public Nuisances.

RECOMMENDATION: That the Board of Supervisors introduce the attached ordinance by title and waive the first reading; set the Ordinance for adoption on August 23, 2011 or at least one week away; direct the Clerk of the Board to publish the pre-adoption summary of the Ordinance and to post a certified copy of the full text of the proposed Ordinance in the office of the Clerk of the Board both publication and posting to be done at least five (5) days prior to the Board meeting at which the Ordinance will be adopted [Government Code Section 2524 (b)(1)]; and direct the Clerk of the Board, within 15 days after adoption of the Ordinance, to publish a post adoption summary of the Ordinance with the names of the Supervisors voting for and against the Ordinance, and to post in the office of the Clerk of the Board a certified copy of the full text of the adopted Ordinance and amendments along with the names of those Supervisors for and against the Ordinance [Government Code Section 25124 (b)(1)].

H.                  MATTERS SET FOR TIME CERTAIN

I.                     CLOSED SESSION

1.                   Conference with Labor Negotiator - Pursuant to Government Code Section 54957.6, it is the intention of the Board of Supervisors to meet in closed session to review the County's position and instruct its designated labor negotiator with respect to the various forms of compensation provided to the County's represented and unrepresented personnel.  Negotiator:  Dan Fulks. Employee Organizations:  American Federation of State, County and Municipal Employees (AFSCME local 1684), Humboldt County Attorneys Association, Humboldt Deputy Sheriffs' Organization (Law Enforcement Non-Management Unit).

RECOMMENDATION:

Elections

1.                   Public Hearing to Consider Redistricting Humboldt County Supervisorial Districts per 2010 Census.

RECOMMENDATION: That the Board of Supervisors open the public hearing; listen to report and redistricting plans from the redistricting committee; receive public comment; close the public hearing; consider the plans presented, select one plan that best meets the needs of balanced population while addressing the Communities of Interest that have been identified and other considerations described in Elections Code 21500, and accept that plan for adoption or recommend further revision; and direct staff to set a public hearing to introduce and consider the adoption of an ordinance establishing supervisorial boundaries consistent with a redistricting plan.
