B.                  MODIFICATIONS TO THE AGENDA

1.                   Construction of Mill (Watek) Creek Culvert Replacement Riverside Road (5L005) at PM 0.85, Contract No.: 211302. (CONSENT)

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Mill (Watek) Creek Culvert Replacement Riverside Road (5L005) PM 0.85; Award the contract to Figas Construction for the total amount of $179,799.52; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance and direct the Auditor-Controller to establish a new contract account 1200321-0271 and transfer $188,799 to the account per the attached appropriation transfer.


2.                   Ratification of 2011-2014 Memorandum of Understanding Between the County of Humboldt and the American Federation of State, County and Municipal Employees (AFSCME) for representation Units 1-4 (CONSENT)

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. ____ approving the Memorandum of Understanding between the County of Humboldt and the American Federation of State, County and Municipal Employees (AFSCME) Local 1684 for Units 1-4; and authorize the Chairman of the Board to execute the Memorandum of Understanding.

3.                   Construction of Storm Damage Repairs on East Branch Road PM .36 and East Blue Rock Road PM 0.40, Project No.: PW-1290 $ PW-288, Contract No.: 206204 & 206266.(CONSENT)

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Storm Damage Repairs on East Branch Road PM .36 and East Blue Rock Road PM 0.40; Award the contract to Van Meter Logging, Inc. for the total amount of #327,016.76; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance and direct the Auditor-Controller to establish a new contract account 1203321-0270 and transfer $359,719 to the account per the attached appropriation transfer.

4.                   Advanced Step Increase for District Attorney Investigator Martin Perrone, Per Section 7 of the Humboldt County Salary Resolution. (4/5 vote required)  (CONSENT)

RECOMMENDATION: That the Board of Supervisors approve the advanced step for Martin Perrone, District Attorney Investigator (class 0412, position 04) from Step A (range 425), per section 7 of the Humboldt County Salary Resolution, retroactive to August 15, 2011.

Board of Supervisors

1.                   Congratulations Letter to Humboldt Bay Harbor, Recreation and Conservation District on the Woodley Island Marina's 30th Anniversary. (Supervisor Jimmy Smith)

RECOMMENDATION: Authorize Chair and Board Members to sign letter.

2.                   Thank You Letter to Don Tuttle for his Help on the Fernbridge 100th Anniversary Celebration. (Supervisor Jimmy Smith)

RECOMMENDATION: Authorize Chair and Board Members to sign letter.

County Administrative Office

3.                   Adoption of Ordinance: Purchasing Agent County Code.

RECOMMENDATION: That the Board of Supervisors adopt Ordinance No. ___, amending or adding sections to Humboldt County Code 245-1 et seq. (The Purchasing Agent of Humboldt County).

4.                   Reappointment of Victor Zazueta to the Access Humboldt Board of Directors.

RECOMMENDATION: That the Board of Supervisors reappoint Victor Zazueta as the County representative on the Access Humboldt Board of Directors.

5.                   Agreement with T-Mobile USA, Inc. for Microwave Relocation Services.

RECOMMENDATION: That the Board of Supervisors authorize the Chairman of the Board to sign the attached agreement with T-Mobile to provide turnkey microwave relocation services for Humboldt County at T-Mobile expense.


County Counsel

6.                   Adoption of Ordinance Amending Sections 351-1 et seq of the Humboldt County Code Relating to Abatement of Public Nuisances.

RECOMMENDATION: That the Board of Supervisors adopt Ordinance No. ______, amending sections 351-1 et seq of the Humboldt County Code Relating to Abatement of Public Nuisances.

7.                   Adoption of Ordinance Amending Sections 2131-3 et seq of the Humboldt County Code Relating to Administrative Penalties.

RECOMMENDATION: That the Board of Supervisors adopt Ordinance No. ___, amending sections 2131-3 et seq of the Humboldt County Code Relating to Administrative Penalties.

District Attorney

8.                   Supplemental Budget for Electronic Interface (EI) with Humboldt County Jail.

RECOMMENDATION: That the Board of Supervisors approve the transfer of District Attorney Asset Forfeiture Fund, (trust fund number 3921), money and attached supplemental budget to rebuild the EI with the Humboldt County Jail, not to exceed $28,500.

9.                   Authorize the District Attorney to sign all documents necessary to submit a Non-Competitive Grant Application for the Anti-Drug Abuse Enforcement Team Program for Fiscal Year (FY) 2011-12.

RECOMMENDATION: That the Board of Supervisors authorize the District Attorney to sign all documents necessary to submit a non-competitive grant application for the Anti-Drug Abuse Enforcement Team Program Funds.

Health and Human Services - Social Services Branch

10.               Lease with Richard Littlefield, Betty Littlefield and Charles Powell for storage space at 205 Seventh Street, Suite C, Eureka, CA

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair to sign the three year lease.

Probation

11.               Supplemental budget, transfer of five positions to budget unit 1100294, Public Safety Realignment from budget unit 1100235, Probation; appointment of the DHHS Director to the Community Corrections Partnership Executive Committee and approve a contract with the Criminal Justice Research Foundation.

RECOMMENDATION: That the Board of Supervisors authorize the Auditor-Controller to establish budget unit 1100294, Public Safety Realignment; approve the attached supplemental budget for $396,476; Approve the transfer 1.0 FTE Supervising Probation Officer (class 0470, position #6), 1.0 Senior Probation Officer (class 0469, position #2) and 3.0 FTE Deputy Probation Officer I/II positions (class 0473, positions #5, #6, and #9) from budget unit 1100235 to 1100294; approve changing the allocation type from Frozen-Unfunded (F0) to Grant (GT) for the impacted positions effective the first bi-weekly following approval; designate the Director of the Humboldt County Department of Health and Human Services

Public Works

12.               Construction of Storm Damage Repairs on Mattole Rd (F3C010) at PM 41.86; Project No. ER-4400(032); Contract No. 206263.

RECOMMENDATION: That the Board of Supervisors authorize the Director of Public Works to sign Contract Change Order Number 1 for the total amount of $20,577.65; and approve the attached Appropriation Transfer to provide funding.

13.               Construction of Bridge Over Indian Creek on Mattole Road (F3C01) at PM 10.0; Project No. P0810518, Contract No. 204301.

RECOMMENDATION: That the Board of Supervisors accept the completed contract, including all change orders approved by the Public Works Department, between GR Sundberg, Inc., Contractor, and Humboldt County for the construction of the bridge over Indian Creek; and approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $29,589.76. This will bring the total amount paid to 100% of the contract.

Sheriff

14.               Lease Agreement with George N. Frykberg Trust for Property Located at 2618 Myrtle Avenue, Eureka, Ca.

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Board to sign both originals of the lease agreement between the County of Humboldt and George N. Frykberg.

D.                 SPECIAL PRESENTATIONS

1.                   Proclaim September 2011 as "Backpacks for Kids" Month in Humboldt County. (Supervisor Virginia Bass)

RECOMMENDATION: Adopt the Proclamation.

RECOMMENDATION: That the Board of Supervisors receive an oral report from the County Administrative Officer on State legislative advocacy, and various other topics, and take action as may be required.

Community Development Services

2.                   Approval of the Headwaters Fund Board’s recommended changes to the Grant Fund Manual related to the Headwaters Fund Mini-Grant program

RECOMMENDATION: That the Board of Supervisors review and approve the Headwaters Fund Board's recommended changes to the Headwaters Fund Grant Manual related to the Headwaters Fund Mini-Grant program.

H.                  MATTERS SET FOR TIME CERTAIN

I.                     CLOSED SESSION

1.                   It is the intention of the Board of Supervisors to meet in closed session to consider the Public Employee Performance Evaluation for the position of Conflict Counsel pursuant to Government Code Sections 54954.5 and 54957.

2.                   Conference with Legal Counsel - Existing Litigation pursuant to Government Code section 54956.9(a), County of Humboldt v. Robert C. McKee; Humboldt County Superior Court Case No. DR020825


3.                   Conference with Labor Negotiator - Pursuant to Government Code Section 54957.6, it is the intention of the Board of Supervisors to meet in closed session to review the County's position and instruct its designated labor negotiator with respect to the various forms of compensation provided to the County's represented and unrepresented personnel.  Negotiator:  Dan Fulks. Employee Organizations:  American Federation of State, County and Municipal Employees (AFSCME local 1684), Humboldt County Attorneys Association, Humboldt Deputy Sheriffs' Organization (Law Enforcement Non-Management Unit).

County Administrative Office

1.                   Public Hearing to Consider Adoption of an Ordinance for the 2011-12 Update of the Humboldt County Schedule of Fees and Charges.

RECOMMENDATION: That the Board of Supervisors open the public hearing and receive the staff report and public comments; close the public hearing; approve the new, increased, decreased, deleted or changed fees, as shown in the 2011-12 Humboldt County Schedule of Fees and Charges; Introduce by title, Ordinance No. ____ updating the Humboldt County Schedule of Fees and Charges for 2011-12, waive the first reading of the ordinance and adopt the Ordinance; direct the Clerk of the Board, within 15 days, to publish a post adoption summary of the ordinance, and to post in the office of the Clerk of the Board a certified copy of the full text of the adopted ordinance and amendments along with the names of those Supervisors voting for and against the ordinance.  [Government Code Section 25124 (b) (1)]

Community Development Services

2.                   2010 Housing Element Implementation - Multifamily Rezoning Program (H-1M17 and H-1M18). (CONTINUED FROM JULY 27, 2011)

RECOMMENDATION: That the Board of Supervisors open the public hearing, introduce the proposed ordinance by title and waive further reading, receive a staff report, open the Public Comment Period and accept public comment, close the Public Comment Period, deliberate on the proposed revisions to the Housing Element, review and consider the proposed draft and final subsequent Environmental Impact Reports (FSEIR) for the multifamily rezoning program (SCH #2009022077), approve the FSEIR Findings of Fact, approve the FSEIR Statement of Overriding Considerations, and certify the FSEIR by approving Resolution 11- _________(Attachment 1), adopt the proposed plan and zoning changes by approving Resolution 11- ________ (Attachment 2).  Approval of the proposed rezones for properties in the inland areas will become effective 30 days from the date of its passage.  Approval of the proposed rezones for properties in the coastal zone will all become effective upon certification by the Coastal Commission.  (The Resolution also directs staff to submit the proposed amendments to the Coastal Commission for certification).  Adopt Ordinance No. _________ (Attachment 3), which amends Section 311-7 of the Humboldt County Code (Designation and Adoption of Zoning Maps) by reclassifying the zoning of selected candidate sites to Qualified R-3: Residential Multifamily (Inland Areas), and Qualified RM-Residential Multifamily (Coastal Areas), and carrying forward all existing and combining zones.  Direct the Clerk of the Board to publish a Summary of the Ordinance along with a map of the selected candidate sites (Attachment 7) within 15 days after adoption of the ordinance by the Board, along with the names of those Supervisors voting for and against the Ordinance and to post in the Office of the Clerk of the Board of Supervisors a certified copy of the full text of the adopted ordinance along with the names of those Supervisors voting for and against the Ordinance.   Direct the Clerk of the Board to give notice of the Zone Reclassification to the Assessor, by sending that office a copy of the executed Ordinance signed by the Chair and the Clerk of the Board.  Provide direction to the Planning Division staff regarding the timing of review for the next set of multifamily rezones and revisions to the Housing Element or Housing Element implementation ordinances.
