Board of Supervisors

1.                   Informational Item Announcing the Appointment of Elizabeth Conner as a District 3 Representative on the Humboldt County Housing Authority Commission. (Supervisor Mark Lovelace)

RECOMMENDATION: Receive the report on the appointment of Elizabeth Conner to the Humboldt County Housing Authority Commission as a District 3 Representative.

2.                   Proclaim September 17th through September 23rd, 2011 as Constitution Week in Humboldt County. (Supervisor Mark Lovelace)

RECOMMENDATION: Adopt the Proclamation.

3.                   Letter to Postal Service Administration Requesting a Meeting to Discuss Consolidation Alternatives. (Supervisor Jimmy Smith)

RECOMMENDATION: Authorize Chair to sign the letter.

4.                   Letter to the Times Standard Requesting Reconsideration of the Decision to Discontinue Home Delivery Service in Southern Humboldt. (Supervisor Clif Clendenen)

RECOMMENDATION: Authorize Chair to sign the letter.

Community Development Services

5.                   Supplemental Budget for Fund 1100, Budget Unit 262, Building Inspection Division, Community Development Services FY 2010-2011

RECOMMENDATION: That the Board of Supervisors approve a supplemental budget in Fund 1100, Budget Unit 262, Building Inspection Division of the Community Development Services Department and direct the Auditor-Controller to incorporate the supplemental budget attached.

County Administrative Office

6.                   Approval of modifications to Amendment 1 of the Fire Protection Reimbursement Agreement between the County of Humboldt and the California Department of Forestry and Fire Protection (Cal Fire) to provide Fire Protection Services in County Service Area (CSA) #4 and Fire Dispatch Services in Fiscal Year 2011-12 through Fiscal year 2012-2013.

RECOMMENDATION: That the Board of Supervisors adopt the attached resolution # _________, authorizing the Chair to execute Amendment Number 1 of the Fire Protection Reimbursement Agreement with Cal Fire for fire protection services to CSA #4 and fire dispatch services, beginning July 1, 2010 through June 30, 2013; waive the Humboldt Nuclear-Free Clause; and direct the Clerk of the Board to submit four copies of the agreement and two copies of the Board Resolution to the County Administrative Office for processing.

7.                   Internal Service Fund Supplemental Budgets for Fiscal Year 2010-11.

RECOMMENDATION: That the Board of Supervisors approve the fiscal year (FY) 2010-11 supplemental budgets shown on Attachment 1 for Risk Management Administration, Communications, Liability Insurance, Dental Plan, Purchasing and Information Technology.


8.                   Supplemental Budget for the Courthouse Construction Certificates of Participation Payment Budget for Fiscal Year 2010-11.

RECOMMENDATION: That the Board of Supervisors approve the attached supplemental budget for the Courthouse Construction Certificates of Participation (COP) budget for fiscal year (FY) 2010-11.

9.                   Supplemental Budgets for Fiscal Year 2010-11. Transfer from Contingencies and Supplemental Budget for Fiscal Year 2011-12.

RECOMMENDATION: That the Board of Supervisors approve the fiscal year (FY) 2010-11 General Fund supplemental budgets shown on Attachment 1 for the County Administrative Office management Budget Team, Certificates of Participation (COP) Payments, Contributions-Other, Courts-County Funded, Forester and Warden and Inmate/Indigent Medical Care; and approve a transfer from Contingencies for FY 2010-11 of $5,191 to the Forester and Warden budget and a supplemental budget for FY 2011-12 increasing Contingencies by $5,191.

District Attorney

10.               Supplemental Budgets for Fiscal Year 2010-11.

RECOMMENDATION: That the Board of Supervisors approve the attached fiscal year (FY) 2010-11 Supplemental Budgets for the District Attorney's Office, CAST and State Board of Control.

Health and Human Services - Social Services Branch

11.               Approve a Supplemental Budget for Fund 1110 Budget Unit 518 Foster Care for Fiscal Year 2010-2011.

RECOMMENDATION: That the Board of Supervisors adopt the attached Supplemental Budget in 1110-518, Foster Care, Attachment #1 - increasing the revenues and expenditures by $500,000.

Personnel

12.               Supplemental Budget for Personnel, Budget Unit 130 for Fiscal Year 2010-11.

RECOMMENDATION: That the Board of Supervisors approve a supplemental budget in fund 1100, budget unit 130, for fiscal year 2010-11 in the amount of $1,178 as attached.

Probation

13.               Approval of the Consultant Agreement with W. Haywood Burns Institute for services related to the Disproportionate Minority Contact - Technical Assistance Project II (DMC-TAP II) Grant.

RECOMMENDATION: That the Board of Supervisors approve the attached Consultant Agreement with W. Haywood Burns Institute for technical consulting services to the Probation Department related to the Disproportionate Minority Contact Technical Assistance Project II (DMC-TAP II) Grant through September 30, 2012; authorize the Chair of the Board to sign two copies of the Consultant Agreement; and authorize the Clerk of the Board to forward the two signed copies of the Consultant Agreement to the Chief Probation Office.

Public Defender

14.               Supplemental Budget for Public Defender (1100-219) in Fiscal Year (FY) 2010-2011.

RECOMMENDATION: That the Board of Supervisors approve the attached supplemental budget for FY 2010-2011 in the amount of $70,581.


15.               Request for Action Under Section 7 of the County Salary Resolution to Provide Additional Compensation for Deputy Public Defender IV, Greg Elvine-Kreis, for the Performance of Duties Above and Beyond the Normal Scope of Work.

RECOMMENDATION: That the Board of Supervisors, in accordance with Section 7 of the Humboldt County Salary Resolution, approves a 10 range salary increase for Deputy Public Defender (DPD) IV, Greg, Elvine - Kries, beginning the first pay period following approval through the pay period ending January 21, 2012.

Public Works

16.               Approval of License Agreement between Jack R and Mary L. Noble and the County of Humboldt for Gravel Extraction on the Van Duzen River Ranch Gravel Bars (APN 204-101-026, 204-111-011, 204-063-013, 204-063-014, and 201-111-005).

RECOMMENDATION: That the Board of Supervisors authorize the Chairman to execute in duplicate, a License Agreement between the County of Humboldt and Jack R. Noble and Mary L. Noble; and direct the Clerk of the Board to return both executed license Agreements to the Department of Public Works Land Use Division for further processing.

17.               Request for Proposals from Engineering Firms for Design Engineering and Environmental Document Development Assistance for Mattole Road Bridge (04C-0055) over the Mattole River at Honeydew.

RECOMMENDATION: That the Board of Supervisors authorize the Director of Public Works to advertise and distribute the attached Request for Proposal (RFP) from qualified firms for design and environmental services to develop plans for construction of a new bridge over the Mattole River at Honeydew.  Further, authorize the Director to negotiate with the selected firm to develop a contract for review and authorization by the Board of Supervisors.

18.               Supplemental Budget for Facilities Management for FY 2010/2011.

RECOMMENDATION: That the Board of Supervisors adopt the attached supplemental budget for FY 2010/11.

19.               Supplemental Budget for Motor Pool - Fiscal year 2010/2011

RECOMMENDATION: That the Board of Supervisors adopt the attached supplemental budget for FY 2010/11; and approve the attached Appropriation Transfer utilizing excess intrafund transfers.

20.               Supplemental Budget for Water Management for Fiscal Year 2010/11.

RECOMMENDATION: That the Board of Supervisors adopt the attached supplemental budget for FY 2010/2011; and approve the attached Budget Transfer increasing intrafund transfer accounts and transferring appropriations from Solid Waste to Water Management to cover overdrafts.

21.               Supplemental Budget for Parks for Fiscal Year 2010/11.

RECOMMENDATION: That the Board of Supervisors adopt the attached supplemental budget for FY 2010/11; and approve the attached Budget Transfer increasing Intrafund transfer accounts and transferring appropriations from Solid Waste (438) to Parks (713) to cover overdrafts.

Sheriff

22.               Transfer from Contingencies in the amount of $145,500 to clear Overdrafts in Budget Unit 1100243 (Jail) for FY 2010/2011.

RECOMMENDATION: That the Board of Supervisors approve the attached appropriation transfer from Contingencies to Sheriff's Jail Budget 1100243 to clear year end edits in the FY 2010/2011 budget.

1.                   Proclaim September 2011 as Prostate Cancer Awareness Month. (Supervisor Jimmy Smith)

RECOMMENDATION: Adopt the Proclamation.

2.                   Proclaim the Week of September 4th - September 10th, 2011 as Suicide Prevention Week. (Supervisor Ryan Sundberg)

RECOMMENDATION: Adopt the Proclamation.

3.                   Proclaim September 2011 as Local Food Month in Humboldt County. (Supervisor Clif Clendenen)

RECOMMENDATION: Adopt the Proclamation.

4.                   Proclaim September 4th through September 10th, 2011 as Pride Awareness Week in Humboldt County. (Supervisor Mark Lovelace)

G.                 DEPARTMENT REPORTS

County Administrative Office

1.                   County Administrative Officer Report:  Outside Audit and Various other Topics.

RECOMMENDATION: That the Board receive an oral report from the County Administrative Officer on the outside audit of County finances, and various other topics; authorize the County Administrative Officer, upon recommendation of the Auditor-Controller and approval of County Counsel and Risk Management, to sign a contract with an auditing firm to assist in completing the County’s independent audit for the fiscal year ended June 30, 2010; select one member of the Board to work with the County Administrative Officer and Auditor-Controller to resolve outstanding issues with the firm of Caproricci & Larson; and Take other action as may be required.

H.                  MATTERS SET FOR TIME CERTAIN

DHHS - 9:30

1.                   Humboldt Homeless and Housing Coalitions (HHHC); 10 Year Plan to End Homelessness; 2011 Point-in-Time Count.

RECOMMENDATION: That the Board of Supervisors accept a report containing an overview of the Humboldt Homeless and Housing Coalition, and its mission, scope and accomplishments.  DHHS will update the Board on Humboldt County's Ten Year Plan to End Homelessness, and the results of the 2011 Point-in-Time Count.

1.                   Presentation by Representatives from Mendocino County on their 9.31 Program as it Relates to Medical Marijuana Cultivation Regulations. (Supervisor Smith & Supervisor Lovelace)

RECOMMENDATION: Hear the presentation and take appropriate action, if required

I.                     CLOSED SESSION

1.                   Conference with Labor Negotiator - Pursuant to Government Code Section 54957.6, it is the intention of the Board of Supervisors to meet in closed session to review the County's position and instruct its designated labor negotiator with respect to the various forms of compensation provided to the County's represented and unrepresented personnel.  Negotiator:  Dan Fulks. Employee Organizations:  Humboldt County Attorneys Association, Humboldt Deputy Sheriffs' Organization (Law Enforcement Non-Management Unit).

2.                   Conference with Legal Counsel - Existing Litigation pursuant to Government Code section 54956.9(a), Forster-Gill, Inc. v. County of Humboldt, Humboldt County Superior Court Case No. CV110550
