1.                   Informational Report on the North Coast Integrated Regional Water Management Plan Grant Request to the Harvard Kennedy School Ash Center for Democratic Governance and Innovation. (CONSENT) (Supervisor Jimmy Smith)

RECOMMENDATION: That the Board of Supervisors receive an informational report and take appropriate action, if required.

Board of Supervisors

1.                   Certificates of Recognition for Soroptimist International of Eureka and Humboldt Bay Award Winners. Supervisor Virginia Bass

RECOMMENDATION: Authorize the Chair to sign the Certificates.

Clerk of the Board

2.                   Board Orders - Meeting of March 13, 2012

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from the meeting of March 13, 2012.

Community Development Services

3.                   Approve Amendment No.3 to an Agreement for Consultant Services for a Supplemental Environmental Impact Report for the Moss Parcel Map Subdivision PMS-03-14, and Supplemental Budget (277) for Community Development Services Current Planning Division.

RECOMMENDATION: Receive the staff report.  Authorize the Chairperson of the Humboldt County Board of Supervisors to execute the attached Amendment No. 3 (Attachment 1) to a Three-Party Agreement for Preparation of and Environmental Impact Report by a Special Services Consultant under Contract to the County (Agreement) (Attachement2).  The parties to this Agreement are the County of Humboldt (County), Michael Moss (Applicant), and LACO Associates (Consultant).  Authorize Trust Fund Account, No. 3575, be used as an escrow account for depositing payments from the Applicant for consulting services and for paying expenditures of Consult for consulting service.  Authorize an increase in Community Development Services - Planning Division's Professional Services Expense Account, Number 1100-277-2-118, in the amount of $18,500.  Authorize the costs to be offset by an increase in Community Development Services - Current Planning Division's Revenue Account Number 110-277-608-061 in the amount of $18,500.  Authorize the Director of Community Development Services to execute for the County subsequent amendments to the Agreement as follows:  Changes in Scope of Services consistent with the overall project description; Changes in Schedule of Performance amending interim completion dates, final completion dates and county personnel services to administer the agreement; and Changes in total compensation not to exceed 50% of the amount of the original agreement.   Any changes in terms of the Agreement, Scope of Services, Schedule of Performance, and Agreement for Special Services must be reviewed by County Counsel, and approved by Community Development Services - Current Planning Division, Consultant, and Applicant.  The County shall not incur any additional costs as a result of subsequent amendments.  (Note: No additional amendments are contemplated).

4.                   Contract with Redwood Region Economic Development Commission to service a Headwaters Fund Loan to the Arcata/Eureka Airport.

RECOMMENDATION: Review and approve the attached Loan Servicing Agreement between the Headwaters Fund and Redwood Region Economic Development Commission; and Authorize the Chair of the Board to sign the Loan Servicing Agreement (Attachment 1) on behalf of the Headwaters Fund.


5.                   Pritchard/Brazil Joint Timber Management Plan Application.  File No.:APN 303-161-08.  Case No.: JTMP-11-04.

RECOMMENDATION: That the Board of Supervisors (by 4/5 vote: approve the division of assessor parcels zoned Timberland Production Zone (TPZ) for which a Declaration of Covenants, Conditions and Restrictions (Declaration) (Attachment A) has been executed and for which a Joint Timber Management Plan (JTMP) and Guide (Attachment B) have been prepared pursuant to Section 51119.5 of the California Government Code (C.G.C.) (Note: A 4/5th vote is required.); direct the Community Development Services - Planning Division staff to record the Declaration with the JTMP (Attachment B); and direct the Clerk of the Board to give notice of the decision to owners, the County Assessor's Office and any other interested party.

County Administrative Office

6.                   Superseding Agreement with AT&T California for California Integrated Information Network (CALNET 2) Services.

RECOMMENDATION: That the Board of Supervisors ratify and authorize the Chair to sign the attached agreement and rider effective March 16, 2012.

Health and Human Services - Mental Health Branch

7.                   Third Option to Extend the Lease Agreement with Rachael-Jill Hemmert.

RECOMMENDATION: Approve the third option to extend the Lease Agreement at 824 Harris Street, Eureka, Ca. with Rachael-Jill Hemmert for the period of July 1, 2012 through June 30, 2013; and Direct the Clerk of the Board to return one executed Board agenda item to the Public Works-Real Property Agent; and Authorize the Public Works-Real Property Agent to send a letter notifying Rachael-Jill Hemmert that the County is exercising the third option to extend the lease for an additional one year term, from July 1, 2012 through June-30, 2013.

Health and Human Services - Public Health Branch

8.                   Amendment A01 to State Standard Agreement #10-10132 for Housing Opportunities for Persons with AIDS (HOPWA) services in Fund 1175 for the term July 1, 2010 through June 30, 2013.

RECOMMENDATION: That the Board of Supervisors approve Amendment Number A01 to State Standard Agreement #10-10132 with the California Department of Public Health; direct the Chair to sign six (6) originals of the cover page of the Amendment to the Agreement and Contractor Certification Clauses Form (CCC-307); and direct the Clerk of the Board to return the six (6) signed originals of the cover page and signed CCC-307 form to the Public Health Branch.

9.                   Amendment A01 to State Standard Agreement with California Department of Public Health, Office of AIDS for Fiscal Years 2010-13 and Budget Adjustments to Fund 1175.

RECOMMENDATION: That the Board of Supervisors: Approve Amendment A01 to State Standard Agreement number 10-95259 with California Department of Public Health, Office of AIDS in the amount of $426,999 for the period of July 1, 2010 through June 30, 2013; direct the Chair of the Board to sign six (6) originals of the cover page of the Amendment package and one (1) original of the Contractor Certification Clauses form ( CCC-307); and direct the Clerk of the Board to return six (6) signed originals and one (1) signed original of the CCC-307 form to the Public Health Branch.


Health and Human Services - Social Services Branch

10.               Approve the Agreement with Food for People to assist with CalFresh Outreach and Support activities.

RECOMMENDATION: That the Board of Supervisors approve Agreement with Food for People to assist the Department of Health and Human Services to increase utilization of CalFresh benefits by eligible households through outreach and thereby reduce hunger and improve the health and economic stability of children, families and individuals of Humboldt County; and Authorize the Chair to execute three (3) copies of the Agreement; and Direct the Clerk of the Board to route two (2) fully executed copies of the Agreement to the Director, Department of Health and Human Services (DHHS) - Social Services Branch.

11.               Approve the Agreement with Humboldt State University-Sponsored Programs Foundation-California Center for Rural Policy to assist with CalFresh Outreach and Support activities.

12.               Adoption of Election Worker and Election Worker (Rover) Job Classifications.

RECOMMENDATION: That the Board of Supervisors adopt the new job class of Election Worker (class number 0191, salary range 250, unit 1) into the classification plan; and adopt the new class of Election Worker (Rover) (class number 0192, salary range 267, unit 1) into the classification plan, effective immediately.

Public Works

13.               Backhoe Replacement.

RECOMMENDATION: Authorize the purchase of one 2012 John Deere 310SK backhoe;   Approve the appropriation transfer to fund the purchase;  Declare one JCB backhoe (equipment #43872) surplus; and  Authorize the Purchasing Agent to dispose of the surplus property and deposit the revenue from the sale in the Roads Heavy Equipment Internal Services Fund (ISF).

D.                  SPECIAL PRESENTATIONS

1.                   Proclaim the Week of March 25-31, 2012 as Tsunami Preparedness Week in Humboldt County. Supervisor Jimmy Smith.

RECOMMENDATION: Hear the presentation and adopt the Proclamation.

1.                   Revenue Guarantees as an Incentive for Providing New Service from Arcata (ACV) to Los Angeles (LAX).

RECOMMENDATION: That the Board of Supervisors receive an update on the Minimum Revenue Guarantee request from American Airlines and take action as necessary.

H.                  DEPARTMENT REPORTS

County Administrative Office

1.                   Redevelopment Oversight Board Appointments.

RECOMMENDATION: That the Board of Supervisors appoint one Board Member to each of the oversight boards for the Arcata, Eureka, and Fortuna redevelopment successor agencies; and provide direction regarding the appointment of one member of the public to each of the three oversight boards for the redevelopment successor agencies.

2.                   2011 Code Enforcement Unit Annual Report.

RECOMMENDATION: That the Board of Supervisors receive the Code Enforcement Unit's 2011 annual report.

Code Enforcement Unit

1.                   Administrative Abatement Hearing.  Ronnie Verilhac and Maxine Pelroy.  171 Oak Hill Road, Orick, California.  AP#519-252-019.

RECOMMENDATION: That the Board of Supervisors, pursuant to Humboldt County Code sections 351-21 and 351-22 hold an administrative hearing to determine whether a public nuisance exists on the subject property and adopt the attached Findings of Nuisance and Order of Abatement consistent with the evidence presented at the hearing.

L.                   PUBLIC HEARINGS

Community Development Services

1.                   Williams/Guttero General Plan Amendment, Zone Reclassification, Lot Line Adjustment, Coastal Development Permit and Joint Timber Management Plan File No. APNs: 517-271-005, 517-271-007, 517-041-012.  Case No.: GPA-11-03/ZR-11-04/LLA-11-11/CDP-11-13/JTMP-11-03 Trinidad Area.

RECOMMENDATION: That the Board of Supervisors: Open the public hearing and receive the staff report and public testimony; Close the public hearing; Make the necessary findings prepared by Community Development Services-Current Planning Division Staff; Approve the General Plan Amendment, Zone Reclassification, Coastal Development Permit, Lot Line Adjustments and Joint Timber Management Plan subject to the recommended conditions of approval; Adopt Resolution No. ____(Attachment A), adopt the Planning Commission's findings and approve the amendment of the Humboldt County General Plan (Trinidad Area Plan (TAP)) land use map, by amending property in the Trinidad area (GPA-11-03, Williams Guttero) from Rural Residential Agriculture (RR(a)) to Coastal Commercial Timberland (TC); Introduce Ordinance No.____ (Attachment B) by title and waive further reading; Adopt Ordinance No. ____amending Section 311-7 of the Humboldt County Code by reclassifying property in the Trinidad area from Rural Residential Agriculture two acre minimum (RA-2) to Commercial Timber (TC); Direct current Planning Division Staff to prepare and file a Notice of Exemption with the County Clerk and Office of Planning and Research pursuant to California Environmental Quality Act (CEQA); and Direct the Clerk of the Board to give notice of the decision to  the applicant, the County Assessor's Office and any other interested party, and to publish a summary of the Ordinance (Attachment C) within 15 days after adaption by the Board.

M.                 AFTERNOON DISCUSSION ITEMS

1.                   Consider Directing Staff to Prepare an Interim Emergency Ordinance to Address Public Health & Safety Issues Associated with Activities on Courthouse Property and Discuss Status of General Ordinance Governing Public Use of All County Property and Provide Direction as Necessary. (Supervisor Jimmy Smith)

RECOMMENDATION: That the Board of Supervisors discuss alternatives to alleviate the immediate health and safety issues associated with activities on Courthouse property and direct staff to return with a proposed interim emergency ordinance to address these issues; that the Board of Supervisors discuss the current status of the Board directed drafting of an ordinance that governs public use of all County property and provide direction to staff as necessary.
