B.                  MODIFICATIONS TO THE AGENDA

1.                   Memorandum of Agreement between the County of Humboldt and the Trinidad Rancheria for Transportation Enhancement Project Component of the Trinidad Pier Project. [CONSENT - PUBLIC WORKS]

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Board to sign the attached Memorandum of Agreement (MOA) for the Transportation Enhancement Project Component of the Trinidad Pier Project and direct the Clerk of the Board to return the original MOA to the Department for processing.


C.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Community Development Services

1.                   Allocate One Full-Time Position, Senior Fiscal Assistant in Community Development Services Natural Resources Planning Division.

RECOMMENDATION: That the Board of Supervisors allocate one FTE Senior Fiscal Assistant (class number 0124, salary range 329, position 01) in Community Development Services Natural Resources Planning Division effective immediately.

District Attorney

2.                   Extension of Extra-Help Hours past the 960 Hour Limit for Office Support  Staff Personnel in Budget Unit 205.

RECOMMENDATION: That the Board of Supervisors approve the extension of extra help hours to 1920 hours through June 30, 2012 for the following employees, per Section 7 of the Humboldt County Salary Resolution: Christy Flemens, Office Assistant I; Janet Garcia, Office Assistant I and Garret Grimm, Office Assistant I

Health and Human Services - Mental Health Branch

3.                   First Amendment to Increase Funding from $850,000 to $950,000 for Changing Tides Family Services Agreement for the provision of Mental Health Services for Fiscal Year 2011-2012.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair to sign three (3) copies of the Amendment to the June 22, 2010 Agreement with Changing Tides Family Services for the provision of Mental Health Services for FY 2011-2012, and direct the Clerk of the Board to return two executed copies of the Amendment to the Department of Health and Human Services - Social Services Branch.

Probation

4.                   Request to approve and submit 2012-2013 Juvenile Justice Crime Prevention Act (JJCPA) Application for Continuing Funding.

RECOMMENDATION: That the Board of Supervisors attest to the on-going validity of the local Comprehensive Juvenile Justice Plan and funding strategy; and authorize the Chief Probation Officer to submit the 2012-13 JJCPA Application for Continuation Funding to the California Department of Corrections and Rehabilitation - Corrections Standards Authority (CSA).

5.                   Approval of the Establishment of Trust Fund Account.

RECOMMENDATION: That the Board of Supervisors approve the Probation Department's request to establish the Community Corrections Performance Incentives Fund for Community Corrections Performance Incentive funding, and authorize the Auditor's Office to establish the Community Corrections Performance Incentives Fund, and interest bearing trust fund account (#3783)

Public Works

6.                   Storm Damage Repairs on Elk Creek Road (C6D060) at P.M 2.01, Project No.: ER-4400 (0230, Contract No.: 206226.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications; and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with Bids to be opened on Tuesday, May 22, 2012 at 2:00 p.m.

7.                   Williams Creek Road (2G045) at PM 1.02 & Monument Road (3F020) at PM 0.18, DSR No: 2933 &2932, Contract No.: 210217 & 210229.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with Bids to be opened on Tuesday, May 22, 2012 at 2:00 PM.

8.                   Petition to Form Permanent Road Division (PRD) No. 1000, Zone NO. 007, Central Estates Phase 2A Subdivision, McKinleyville.

RECOMMENDATION: That the Board of Supervisors receive and file the petition, affidavit of valuation, and engineer's report for the creation of Permanent Road Division No. 1000, Zone No. 0007; adopt the Resolution of Intent to establish Permanent Road Division No. 1000, Zone 007 and to Impose Parcel Charges for Road Maintenance; set a time and date of 1:30 or soon thereafter on ^/12/2012 to hold a public hearing to receive testimony of protest regarding the formation and setting of an assessment for road maintenance for proposed Permanent Road Division No. 1000, Zone No. 007; and direct the Clerk of the Board to publish the petition, notice of formation, and notice of assessment as per Streets and highways Code 1164 and 1196; and the Department of Public Works to mail the notice of assessment and ballot to all landowners within the proposed zone as per Government Code 53753.

9.                   Resolution Authorizing the Application for Grant Funds from the State Bicycle Transportation Account for the Completion of Bicycle Lanes on Myrtle Avenue.

RECOMMENDATION: That the Board of Supervisors adopt the attached Resolution authorizing the Public Works Department to provide up to a 10% match for the Bicycle Transportation Account BTA grant; and authorize the Public Works Department to administer the design and construction of class II bicycle Lanes on the shoulder of Myrtle Avenue to connect existing bicycle shoulders on Freshwater Road, Old Arcata Road and Myrtle Avenue subject to the award of a (BTA) grant.

10.               Resolution to Accept the Updated 2012 Humboldt County Bicycle Transportation Plan.

RECOMMENDATION: That the Board of Supervisors adopt the attached Resolution and authorize the Public Works Department to pursue funding for the implementation of projects detailed in the plan.

D.                 SPECIAL PRESENTATIONS

1.                   Proclaim the Week of April 22-28 as National Crime Victim's Rights Week. (Supervisor Mark Lovelace)

RECOMMENDATION: Adopt the proclamation.

2.                   Proclaim the Week of April 22-28, 2012 as the Week of the Young Child in Humboldt County. (Supervisor Virginia Bass)

RECOMMENDATION: Adopt the Proclamation.

3.                   Recognition of the Child Abuse Service Team  for Sixteen Years of Dedicated Service. (Supervisor Ryan Sundberg)

RECOMMENDATION: Adopt the Proclamation.

Community Development Services

1.                   Approval of the Headwaters Fund Board's Recommended Forest Products Initiative.

RECOMMENDATION: That the Board of Supervisors receive this report, and review and approve a $750,000, three year Forest Products Initiative grant to the County of Humboldt Economic Development Division which is recommended for approval by the Headwaters Fund Board (HFB) and authorize the Chair of the Board to sign the grant contracts when completed, after review and approval by County counsel and Risk Management.

2.                   Approval of the Headwaters Fund Board's Recommended 2011-12 Grant Fund Awards for the February 1, 2012 Grant Round.

RECOMMENDATION: That the Board of Supervisors receive report and review and approve the slate of Grant Fund Competitive Awards recommended for approval by the Headwaters Fund Board (HFB) and authorize the Chair of the Board to sign the grant contracts when completed, after review and approval by County Counsel and Risk Management.

I.                     CLOSED SESSION

1.                   It is the intention of the Board of Supervisors to meet in closed session to consider the appointment for the position of Director of Planning & Building  pursuant to Government Code sections 54954.5 and 54957.

2.                   Conference with Legal Counsel - Threatened, Potential or Anticipated Litigation pursuant to Government Code section 54956.9, subd.(b)(1), and subd.(b)(3) subpar.(C), (1 case);  a written threat of litigation by the State Water Resources Control Board in a letter dated January 25, 2012, to the Director of Public Works.

RECOMMENDATION: That the Board of Supervisors receive an oral report from the County Administrative Officer on his attendance at the recent Transforming Local Government conference, and various other topics and take action as may be required.

2.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.
