Board of Supervisors

1.                   Letter of Appreciation to Congressman Thompson and Staff. (Supervisor Jimmy Smith)

RECOMMENDATION: That the Board of Supervisors ratify authorization to sign letter of appreciation.

2.                   Certificate of Achievement for Nathan Frey for Achieving the Rank of Eagle Scout. (Supervisor Jimmy Smith)

RECOMMENDATION: Authorize the Chair to sign the Certificate of Achievement.

3.                   Certificate of Recognition for John Shelter for winning the American Civil Liberties Union's prestigious "Patriot Award - 2012". (Supervisor Mark Lovelace)

RECOMMENDATION: Ratify the Certificate.

4.                   Certificates of Recognition for the Fortuna Chamber of Commerce 2011 Award Winners. (Supervisor Clif Clendenen)

RECOMMENDATION: Ratify the Certificates of Recognition.

5.                   Opposition to SB 1161 (Padilla) Communications: Voice Over Internet Protocol and Internet Protocol Enabled Communication Services. (Supervisor Mark Lovelace)

RECOMMENDATION: That the Board of Supervisors authorizes the Chair to sign the letter of opposition to SB 1161.

6.                   Letter to National Data Buoy Center requesting assistance in getting Buoy # 46022 back in service. (Supervisor Jimmy Smith)

RECOMMENDATION: That the Board of Supervisors authorizes the Chair to sign the letter.

7.                   Certificate of Recognition for Rob and Cherie Arkley, Humboldt County 2011 Republicans of the Year. (Supervisor Jimmy Smith)

RECOMMENDATION: That the Board of Supervisors ratify the Certificate of Recognition.

Clerk of the Board

8.                   Board Orders - Meeting of April 24, 2012.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from meeting of April 24, 2012.

Health and Human Services - Public Health Branch

9.                   Memorandum of Understanding with the State of California, Department of Public Health (CDPH), and Community Based Organizations covering the transfer of medical and health assets to locations within Humboldt County.

RECOMMENDATION: That the Board of Supervisors approve the attached form Memorandum of Understanding between the California Department of Public Health and Humboldt County, Department of Public Health and Human Services, Public Health Branch for the transfer and storage of medical surge assets; authorize the Public Health Branch Director to sign individual Memorandums of Understanding with community based facilities for the storage of medical surge assets in the form of the attached sample; and authorize the Public Health Branch Director to sign the attached Agreement between Department of Health and Human Services, Public Health Branch, CDPH and St. Joseph's Hospital for the maintenance and storage of 8 LTV 1200 ventilators.

Public Works

10.               Benbow Drive (6B180) at PM 0.85 & 1.90 & Wilder Ridge Road (5B010)at PM 10.1, DSR No: 2819, 2924, & 2926, Contract No.: 210256, 210257 & 210272.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with Bids to be opened on Tuesday, May 29, 2012 at 2:00 PM.

11.               Earthquake repairs on Wilder Ridge Road (5B010) PM 7.25, DSR No.L 2832, Contract No. 210260.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications; and direct the Clerk of the Board to advertise the above mentioned project as required by Section 22037 of the California Public Contract Code with Bids to be opened on Tuesday, may 29, 2012 at 2:00 PM.


12.               Storm Damage Repairs on Mattole Road (F3C010) at P.M. 10.88,39.40,40.50 & 42.24, Project No.: ER-4400(062), (019), (20) &(072), Contract No. 206396, 206339, 206261& 206408.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with Bids to be opened on Tuesday, May 29, 2012 at 2:00 PM.

13.               Donation of Aviation Owned Vehicles and Equipment to the County Motor Pool and Heavy Equipment for Capitalization, Maintenance and Insurance.

RECOMMENDATION: That the Board of Supervisors approve the donation of Aviation-owned Vehicles and equipment to the County Motor Pool and Heavy Equipment Divisions for capitalization, maintenance and insurance effective July 1, 2012.

D.                 SPECIAL PRESENTATIONS

1.                   Proclaim May 2012 as Bike Month in Humboldt County. (Supervisor Mark Lovelace)

RECOMMENDATION: Adopt the Proclamation.

2.                   Proclaim May 3, 2012 as a Day of Prayer in Humboldt County. (Supervisor Virginia Bass)

RECOMMENDATION: Adopt the Proclamation.

3.                   Distinguished Service Award Recognizing Madalyn Johnson. (Supervisor Jimmy Smith)

RECOMMENDATION: That the Board of Supervisors sign the Distinguished Service Award for Madalyn Johnson.

1.                   Presentation and Memorandum of Understanding Between the Counties of Sonoma, Mendocino, and Humboldt and the Sonoma County Water Agency, Marin Municipal Water District, and the Mendocino County Russian River Flood Control and Water Conservation Improvement District Regarding the North Coast Zebra and Quagga Mussel Consortium (Supervisor Jimmy Smith)

RECOMMENDATION: That the Board of Supervisors hear the presentation and adopt the MOU.

County Administrative Office

1.                   Third Quarter Budget Review for Fiscal Year 2011-12 and Updated Outlook for Fiscal Year 2012-13.

RECOMMENDATION: That the Board of Supervisors receive and file a review of the third quarter budget results for Fiscal Year (FY) 2011-12 and outlook for the FY 2012-13 budget; approve the list of budget adjustments and supplemental budgets as shown on Attachment 1 and authorize County Administrative Office (CAO) staff to make any technical corrections necessary to effectuate the Board's direction; direct staff, in developing the FY 2012-13 budget proposal, to use available resources according to the following priority: a. allocate a minimum $500,000 contribution to General Reserve; b. restore one half of the FY 2011-12 reductions to General Fund allocations to other County funds; c. fund facility related supplemental requests; provide funding for ongoing supplemental requests; authorize department heads to approve voluntary unpaid furloughs for employees under their appointing authority and authorize the County Administrative Officer to approve voluntary unpaid furloughs for other departmental heads for FY 2012-13, utilizing the attached form and take other action as appropriate.

2.                   Consider Making Appointment to Fill Open (Alternate) Seat on the Humboldt County Assessment Appeals Board.

RECOMMENDATION: That the Board of Supervisors consider making appointment to fill the open Alternate seat on the Humboldt County Assessment Appeals Board.

Public Works

3.                   An Ordinance of the Board of Supervisors of the County of Humboldt amending Sections 431-64, 431-84 and 431-10 Relating to Main Street in Loleta, Oak Street in Eureka and Adding Section 431-86.5 Relating to Parking on Peninsula Drive in Manila to Title IV of the Humboldt County Code.

RECOMMENDATION: That the Board of Supervisors introduce the attached Ordinance by title and waive the first reading; set the Ordinance for adoption on May 8, 2012 or at least one week away; direct the Clerk of the Board to publish the pre-adoption summary of the Ordinance and to post a certified copy of the full text of the proposed Ordinance in the office of the Clerk of the Board, both publication and posting to be done at least five days prior to the Board meeting at which the Ordinance will be adopted; and direct Public Works to file the attached Notice of Exemption with the County Clerk in accordance with the California Environmental Quality Act.

I.                     CLOSED SESSION

1.                   It is the intention of the Board of Supervisors to meet in closed session to consider the appointment for the position of Director of Planning & Building  pursuant to Government Code sections 54954.5 and 54957.

2.                   Conference with Legal Counsel - Existing Litigation pursuant to Government Code section 54956.9(a); Humboldt Coalition for Property Rights v. County of Humboldt et.al.; Humboldt County Superior Court Case No. CV120232.

Community Development Services

1.                   Formation of the McKinleyville Municipal Advisory Committee [MMAC]

RECOMMENDATION: That the Board of Supervisors open the public hearing; receive staff report; open the public comment period and accept public comment; close the public comment period; deliberate on the proposed, Rules and Regulations and Procedures for Establishment and Operation of the MMAC; establish the MMAC by approving Resolution No. 12-___; direct the Clerk of the Board to solicit nominations for the MMAC and bring those nominations back to the Board of Supervisors for consideration and appointment; direct the Clerk of the Board to add the MMAC to the County’s Conflict of Interest Code.


2.                   Formation of the Greater Eureka Area Municipal Advisory Committee. [GEAMAC]

RECOMMENDATION: That the Board of Supervisors open the public hearing, receive a staff report open the public comment period and accept public comment; close the public comment period; deliberate on the proposed Rules, Regulations and Procedures for Establishment and Operation of the GEAMAC; establish the GEAMAC by approving Resolution No. 12-___; direct the Clerk of the Board to solicit nominations for the GEAMAC and bring those nominations back to the Board of Supervisors for consideration and appointment; direct the Clerk of the Board to add the GEAMAC to the County’s Conflict of Interest Code;
