Auditor-Controller

1.                   Distribution of Excess Proceeds from tax sale on October 28, 2010.

RECOMMENDATION: That the Board of Supervisors approve the distribution of that portion of the excess proceeds resulting from the October 28, 2010, public auction of parcels listed on Attachment A to the claimants and in the amounts listed for each parcel.

2.                   Resolution in Support of Proposition 29: The California Cancer Research Act (Supervisor Virginia Bass and Supervisor Jimmy Smith)

RECOMMENDATION: That the Board of Supervisors authorizes the Chair to sign the Resolution.

3.                   Letters of Appreciation to Ms. Sara Kavich and Mr. Bob Hiney for serving on the Big Lagoon Subdivision Design Review Committee. (Supervisor Ryan Sundberg)

RECOMMENDATION: Authorize the Chair to sign the Letter of Appreciation.

4.                   Appointment of Ms. Lucinda Maier to the Bid Lagoon Subdivision Design Review Committee. (Supervisor Ryan Sundberg)

RECOMMENDATION: Appoint Mr. Lucinda Maier to the Big Lagoon Subdivision Design Review Committee.

5.                   Board Orders - Meeting of April 30, 2012. (9:00am Special Meeting)

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from the meeting of April 30, 2012 9:00am.

6.                   Board Orders Board Meeting of April 30, 2012 - 1:30pm.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from the meeting of April 30, 2012 1:30 pm.

7.                   Board Orders from the Meeting of May 1, 2012.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from the meeting of May 1, 2012.

County Clerk-Recorder

8.                   US Elections Assistance Commission Grant Fund Acceptance.

RECOMMENDATION: That the Board of Supervisors accept grant funds totaling $25,000 for fiscal years 2011-12 and 2012-13; approve supplemental budget in the amount in the amount of $25,000 and direct the Auditor-Controller to supplement the budget in Fund 1100, Budget Unit 140 (Elections) for Fiscal year 2011-12 and carryover into Fiscal Year 2012-13.

District Attorney

9.                   Edward Byrne Memorial Justice Assistance Grant Application.

RECOMMENDATION: That the Board of Supervisors approve the attached grant application for the Edward Byrne Memorial Assistance Grant.

Health and Human Services - Administration

10.               Extension of Extra Help Hours Past the 960 Hour Limit.

RECOMMENDATION: That the Board of Supervisors approve the extension of extra help hours to 1920 hours through June 30, 2012 for the following Laborers: Chuck Prescott, Melinda Johnson, Matthew Perkins and Joseph Adams.

Health and Human Services - Public Health Branch

11.               State Standard Agreement with California Department of Parks and Recreation for water testing by the Public Health Laboratory for the period of October 15, 2011 through December 31, 2012.

RECOMMENDATION: That the Board of Supervisors approve State Standard Agreement C1137057 with the California Department of Parks and Recreation for water testing by the Public health Laboratory for the North Coast Redwoods District for up to $4,750.00 for the period of October 15, 2011 through December 31, 2012; authorize the Chair to sign three (3) originals of the Agreement and one Contractor Certification Clauses; and direct the Clerk of the Board to return all signed originals and Contractor Certification Clauses to the Public Health Branch.


Public Works

12.               Central Avenue Shoulder Widening (4L800) PM 0.35 - 0.45 Project No.: RPL-5904 (069), Contract No.: 202719.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications, and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with Bids to be opened on Tuesday, June 5, 2012 at 2:00 PM.

13.               Exclusive Right to Negotiate between Porter Hospitality Management LLC, and County of Humboldt for 3561 Boeing Avenue, McKinleyville, California, 95519, Assessor Parcel No. 511-351-09 (that portion lying westerly of Highway 101 and northerly of Letz Avenue and south of Vista Point).

RECOMMENDATION: That the Board of Supervisors by a 4/5 vote authorize the Chair to execute the attached agreement for an Exclusive Right to Negotiate 9ERN)

14.               Extension of Courthouse Snack Bar Lease.

RECOMMENDATION: That the Board of Supervisors approve by a 4/5 vote of extending the lease to Alan Sadler and Jessalyn Kunkler, Lessee, for one year, through July 31, 2013; authorize Real Property to notify Lessee of approval of the extension; and direct the Clerk of the Board to return on executed agenda item to Real Property.

15.               Project Acceptance for Site Service Entrance - Coroner's Office, County of Humboldt, Project No. 170214.

RECOMMENDATION: That the Board of Supervisors accept the work of Sequoia Construction Specialties as substantially complete for their portion of the Site Service Entrance - Coroner's Office Project; authorize the Public Works Director to file the Notice of Completion for Sequoia Construction Specialties portion of the project as required.

16.               Adoption of Ordinance: Amending Sections 431-64, 431-84 and 434-10 relating to Main Street in Loleta, Oak Street in Eureka and Adding Section 431-86.5 relating to parking on Peninsula Drive  in Manila to Title IV of the Humboldt County Code.

RECOMMENDATION: That the Board of Supervisors adopt Ordinance No._____, Amending Sections 431-64, 431-84 and 434-10 relating to Main Street in Loleta, Oak Street in Eureka and adding Section 431-86.5 relating to parking on Peninsula Drive in Manila to Title IV of the Humboldt County Code.

17.               Storm Damage Repairs on Kneeland Road (F6F060) at P.M. 18.34, Project No.: ER-4400 (003), Contract No.: 206219.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above mentioned project as required by Section 22037 of the California Public Contract Code with Bids to be opened on Tuesday, June 5, 2012.

18.               Request for Proposals from Engineering Firms for Design Engineering and Project Development for Red Cap Road Bridge (04C-0117) over Big Rock Gulch.

RECOMMENDATION: That the Board of Supervisors authorize the Director of Public Works  to advertise and distribute the attached Request for Proposal (RFP) from qualified firms for design and project development services for construction of a new bridge on Red Cap Road over Big Rock Gulch.  Further, authorize the Director to negotiate with the selected firm to develop a contract for review and authorization by the Board of Supervisors.


Sheriff

19.               Boating Safety and Enforcement Financial Aid Program contract for Fiscal Year 2012-2013 with Department of Boating and Waterways.

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the Boarding Safety and Enforcement Financial Aid Program Contract for Fiscal Year 2012-2013 with Department of Boating and Waterways; authorize the Sheriff and the County Auditor to sign all necessary documents to claim reimbursements from the California Department of Boating and Waterways; and direct the Clerk of the Board to certify the approved Board Order and return all documents for processing to the Sheriff's Office, Attention Linda Modell.

1.                   Proclaim May 2012 as Mental Health Month in Humboldt County. (Supervisor Virginia Bass)

RECOMMENDATION: Adopt the Proclamation.

2.                   Proclaim May 2012 as "Older American Month". (Supervisor Virginia Bass)

RECOMMENDATION: Adopt the Proclamation.

3.                   Proclaim May 6-12, 2012 as National Nurses Week. (Supervisor Ryan Sundberg)

RECOMMENDATION: Adopt the Proclamation.

4.                   Proclaim May 12, 2012 as National Association of Letter Carrier's Food Drive Day in Humboldt County. (Supervisor Mark Lovelace)

RECOMMENDATION: Adopt the Proclamation.

5.                   Veteran's Appreciation Month. (Supervisor Jimmy Smith)

RECOMMENDATION: Hear a brief presentation and adopt the Proclamation.

DHHS - Public Health

1.                   Reduction in Force: Disallocation of One Health Client Services Worker in Budget Unit 460.

RECOMMENDATION: That the Board of Supervisors approve the disallocation of one full-time equivalent (1.0 FTE) Health Client Service Worker, salary range 306, class #1573, in budget unit 460, effective June 30, 2012; and authorize the Personnel Department to begin the layoff process.

Public Works

2.                   Phased Reorganization of Department of Public Works Land Use and Reclassification of Environmental Services Manager, Adopt Revised Class of Deputy Public Works Director, Reallocate the 1.0 FTE Associate Engineer (M-C) Position currently occupied by Robert Bronkall to Deputy Public Works Director, Adopt the new Class of Deputy Public Works  Director - Environmental Services, Reallocate the Environmental Services Manager to Deputy Public Works Director - Environmental Services, Remove Environmental Services Manager from the Classification Plan and Allocate Associate Engineer (M-C) position.

RECOMMENDATION: That the Board of Supervisors adopt the revised class of Deputy Public Works Director (class 0300, salary range 502, unit 8) into the classification plan; reallocate the 1.0 FTE Associate Engineer (M-C) (class 0303, salary range 466, position # 01) position in budget unit 166, currently occupied by Robert Bronkall, to Deputy Public Works Director (class 0300, salary range 502) in budget unit 166; adopt the new class of Deputy Public Works Director - Environmental Services (class 0307, salary range 480, unit 8) into the classification plan; reallocate the 1.0 FTE Environmental Services Manager (class 0203, salary range 447, position #01) position in budget unit 331, currently occupied by Hank Seemann, to Deputy Public Works Director - Environmental Services (class 0307, salary range 480) in budget unit 331; remove Environmental Services manager (class 0203, salary range 447, unit 8) from the classification plan; and allocate 1.0 FTE Associate Engineer (M-C) (class number 0303, salary range 466) position in budget unit 166, effective the beginning of the next bi-weekly pay period following approval.

1.                   It is the intention of the Board of Supervisors to meet in closed session to consider the appointment for the position of Director of Planning & Building  pursuant to Government Code sections 54954.5 and 54957. (Time-Set 11:00am)

2.                   Conference with Legal Counsel - Existing Litigation pursuant to Government Code section 54956.9(a); Kenneth and Linda Bareilles v. County of Humboldt; Humboldt County Superior Court Case No.CV120241

3.                   Conference with Labor Negotiator - Pursuant to Government Code section 54957.6 it is the intention of the Humboldt County Public Authority for In-Home Supportive Services to meet in closed session to review the Public Authority's position and instruct its designated labor negotiators with respect to various forms of compensation provided to the Public Authority's represented and unrepresented personnel. Negotiators: Rick Haeg and Dan Fulks. Employee Organization: California United Home Care Workers Union, SEIU/AFSCME (CUHW); Adjourn as the Humboldt County Board of Supervisors; Convene as the Governing Board for the Humboldt County Public Authority for In-Home Supportive Services

4.                   Conference with Legal Counsel - Anticipated or Potential Litigation pursuant to Government Code section 54956.9 subd.(b)(1) and subd.(b)(3), subpar.(C). (1 case). (Claim for Damages of Jeannie Y. Duncan)

Public Works

1.                   Unmet Transportation Needs Public Hearing.

RECOMMENDATION: That the Board of Supervisors open a public hearing and receive the staff report and allow the public comment on transit needs in the unincorporated areas of the County; and close the public hearing and direct the Clerk of the Board forward meeting minutes and any recommendations to the Humboldt County of Associations of Governments (HCAOG) for inclusion in their hearing.

M.                 AFTERNOON DISCUSSION ITEMS

1.                   County Administrative Officer Report:  Assembly Bill 2443, East-West Railroad Feasibility Study and Various Other Topics.

RECOMMENDATION: That the Board of Supervisors receive and oral report from the County Administrative Officer on Assembly Bill 2443, a potential presentation regarding an east-west railroad link, and various other topics and take action as may be required.

2.                   Introduction of Ordinance Regarding Planning and Building Department and Resolution Regarding Past References to Community Development Services Department.

RECOMMENDATION: That the Board of Supervisors introduce the attached Ordinance by title and waive the first reading; set the Ordinance for adoption at least one week away; direct the Clerk of the Board to publish the pre adoption summary of the Ordinance and to post a certified copy of the full text of the proposed Ordinance in the office of the Clerk of the Board, both publication and posting to be done at least five days prior to the Board meeting at which the Ordinance will be adopted [Government Code Section 25124 (b)(1)]; Direct the Clerk of the Board, within 15 days after adoption of the Ordinance, to publish a post adoption summary of the Ordinance with the names of the Supervisors voting for and against the Ordinance, and to post in the office of the Clerk of the Board of Supervisors a certified copy of the full text of the adopted Ordinance and amendments along with the names of those Supervisors voting for and against the Ordinance [Government Code Section 25124 (b)(1)]
