Agricultural Commissioner

1.                   Approve the Cooperative Agreement No. 12-0011-SA, Petroleum Products Compliance and Weighmaster Enforcement Programs Contract in the Amount of $6,825.00.

RECOMMENDATION: That the Board of Supervisors; Approve Cooperative Agreement No. 12-0011-SA, known as the Petroleum Products Compliance and Weighmaster Enforcement Program contract with the California Department of Food and Agriculture, and; Authorize the Chair to sign the original agreement and one copy of the cover page, and direct the Clerk of the Board to return the signed copies to the Agricultural Commissioner's Office for further processing; and Grant a waiver from the provisions of the Nuclear Free Ordinance.

2.                   Supplemental Budget Request for Agricultural Commissioner, Removal of Former Underground Storage Tank at the Agricultural Center.

RECOMMENDATION: That the Board of Supervisors approve the attached Supplemental Budget totaling $18,425.00 for the Agricultural Center.

3.                   Supplemental Budget for Assessor.

RECOMMENDATION: That the Board of Supervisors adopt the following supplemental budget for the Assessor; (Revenue) 1100-602050 Property Tax Administration Fees -$18, 784.  (Expenditure) 1100-113-8066 Computer Equipment-$4,814.  1100-113-2317 Office Expense Equipment - $9,021.  1100-113-2148 Computer Software - #3,013.  1100-113-2225 - Transportation Out of County - $1, 936.

4.                   Appoint Kent Wrede to the Fortuna Cemetery District Board of Directors. (Supervisor Clif Clendenen)

RECOMMENDATION: That the Board of Supervisors appoint Kent Wrede to the Fortuna Cemetery District Board of Directors to fill the vacant seat left open by the resignation of Harley Baumgart with a term expiring June 30, 2012; and appoint Mr. Kent Wrede to a subsequent four-year term expiring on June 30, 2016.

5.                   Collings Foundation Aviation Fuel Request. (Supervisor Virginia Bass)

RECOMMENDATION: Authorize the Airport Manager to sell aviation fuel to the Collings Foundation at the County's cost plus flowage.

6.                   Letter of Support for North Coast Regional Land Trust Six Rivers by the Sea Conservation Easement Program. (Supervisor Clendenen & Supervisor Lovelace)

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the letter of support.

7.                   Board Orders - Meeting of May 7, 2012

RECOMMENDATION: That the Board of Supervisors approve the Board order of May 7, 2012 and authorize the Clerk of the Board and the Board Chair, to sign the minute book in accordance with California Government Code Section 25103.

8.                   Board Orders from the Meeting of May 8, 2012.

RECOMMENDATION: Approve the Board Orders of May 8, 2012 and authorize the Clerk of the Board and the Board Chair, to sign the minute book in accordance with California Government Code Section 25103.

9.                   Lease Agreement with Carter Properties, Inc. for Office Space for the Conflict Counsel's Office at 935 Third Street.

RECOMMENDATION: That the board of Supervisors: Approve the Lease for 935 Thirtd Street, Eureka, from July 1, 2012, at a beginning rental rate amount of $2,000.00 per month through June 30, 2015; Authorize the Chairperson to execute the Lease; and Direct the Clerk of the Board to return one executed Lease to Real Property Services for transmittal to Lessor.

10.               Adoption of Ordinance Regarding Planning and Building Department.

RECOMMENDATION: That the Board of Supervisors adopt Ordinance No._______, amending Section 247-1 through 247-2 and adding Sections 247-3 through 247-4 to Chapter 7 of Division 4 of Title II of the Humboldt County Code relating to the Planning and Building Department.

11.               Request for Extension of Extra Help Hours for Budget Unit 114.

RECOMMENDATION: That the Board of Supervisors approve the extension of extra help hours for Elishia Hayes, Revenue Recovery Officer I, from 960 hours to 1578 hours through June 30, 2012, per Section 7 of the Humboldt County Salary Resolution (4/5 vote required).

12.               Administrative Abatement Funding Transfer. AP#303-091-037.

RECOMMENDATION: That the Board Authorize the cost of abatement to be advanced by the County of Humboldt, pursuant to Humboldt County Code section 351-31, and if unpaid by the property owner, that a lien be placed against the parcel in the amount of the costs of abatement pursuant to Humboldt County Code sections 351-33 to 351-44;  Authorize a transfer from the Code Enforcement Trust Fund, account #3440000, in the amount of $12,000 to the County Counsel's revenue account #1100-121-603-040 to cover the cost of the abatement; and Authorize the Auditor-Controller to execute the supplemental budget shown in Attachment A for fiscal year 2011/2012.

13.               Standard Agreement Amendment, Amendment No. 1 to Agreement No. 1CAO1123 with the State of California Department of Forestry and Fire Protection (Calfire) to Pay Landing and Fuel Flowage Fees at Rohnerville Airport.

RECOMMENDATION: That the Board of Supervisors by a 4/5's vote; Approve and authorize the Chairperson to execute in duplicate the attached Standard Agreement Amendment, Amendment No. 1 to Agreement No. 1CA01123 with the State of California Department of Forestry and Fire Protection; and Direct the Clerk of the Board to return the Standard Agreement Amendment to the land Use Division of Public Works for processing.

14.               Rescission of Tax Sale Parcel 526-102-030-000.

RECOMMENDATION: That the Board of Supervisors approve the attached resolution which authorizes the Treasurer-Tax Collector to rescind the property identified by Assessor's Parcel Number 526-102-030-000 which was sold at auction on October 18, 2011 and authorize the Auditor to refund the total purchase price of $6041.60 plus interest at the county pool apportionment rate.

1.                   Merger of Department of Economic Development and Natural Resources into Existing County Departments. (Supervisor Jimmy Smith and Supervisor Ryan Sundberg)

RECOMMENDATION: That the Board of Supervisors elect not to fill the position of Director of Economic Development and Natural Resources upon the departure of the incumbent department head; merge the Division of Natural Resources into the Environmental Services Division of the Department of Public Works; merge the Division of Economic Development into the County Administrative Office; and direct staff to bring back appropriate agenda items to effectuate the foregoing policy direction.

2.                   Informational Update on the Efforts to Keep Grizzly Creek Redwood State Park Open. (Clif Clendenen)

RECOMMENDATION: Hear the Informational Update from Public Works.

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. ____, a Resolution of Intention to approve an Amendment to Contract between the Board of Administration California Public Employees' Retirement System and the Board of Supervisors County fo Humboldt; introduce the attached ordinance by title, waive the first reading thereof, and schedule fo adoption on June 5, 2012; direct the Clerk of the Board to publish the pre-adoption summary of the Ordinance and to post a certified copy of the full text of the proposed Ordinance in the office of the Clerk of the Board, both publication and posting to be done at least five (5) days prior to the Board meeting at which the Ordinance will be adopted [Government Code Section 25124 (b)(1)]; direction the Clerk of the Board, withih 15 days after adoption of the Ordinance, to publish a post-adoption summary of the Ordinance with the names of the Supervisors voting for and against the Ordinance, and to post in the office of the Clerk of the Board a certified copy of the full text of the adopted Ordinance and amendments along with the names of those Supervisors voting for and against the Ordinance [Government Code Section 25124 (b)(1); and direct the Clerk of the Board to sign the "CERTIFCATION OF GOVERNING BODY'S ACTION", CERTIFICATION OF COMPLIANCE WITH GOVERNMENT CODE SECTION 7507', and "CERTIFICATION OF COMPLIANCE WITH GOVERNMENT CODE SECTION 20475" forms.

1.                   Tentative Cancellation of Western Rivers Conservancy Land Conservation Contract.

RECOMMENDATION: That the Board of Supervisors: Open a public hearing in the manner prescribed by law; Receive a staff report, consider the petition for Cancellation of the Western Rivers Land Conservation Contract No. 88-15 and receive public testimony; close the public hearing; Determine that the cancellation is in the Public Interest pursuant to Governmental Code Section 51282(c) and adopt Resolution No. __________, which contain the Findings of Cancellation and the Conditions of Approval for Tentative Cancellation of Land Conservation Contract No. 88-15 (Attachment A); Determine and certify to the County Auditor the amount of the cancellation fee that the landowner shall pay to the County Treasure upon cancellation is $56,750: Direct the Clerk of the Board to record the Certification of Tentative Cancellation (Attachment B); and Direct the Clerk of the Board to publish the notice of the decision pursuant to Government Code Section 51284 and to give notice of the Board's action to the applicant, the Assessor's Office, County Counsel, the Planning Division, the Director of the California Office of Land Conservation and any other interested party within thirty (3) days of this hearing.

RECOMMENDATION: That the Board of Supervisors receive public comment on the proposed formation of the Humboldt County Tourism Business Improvement District and the assessment to be levied thereunder.

1.                   County Administrative Officer Report: Governor's May Revise and Various Other Topics.

RECOMMENDATION: That the Board of Supervisors receive an oral report from the County Administrative Officer on the May Revision to the Governor's Proposed State Budget for Fiscal year 2012-13, and various other topics, and take action as may be required.

2.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.
