B.                  MODIFICATIONS TO THE AGENDA

1.                   Resolutions from the City of Arcata Requesting Consolidation of the Municipal Election with Humboldt County's General Election on November 6, 2012, and Calling for an Election, and Placing Two Measures on the Ballot: an Initiative Declaring that Corporations are not Persons, and an Excessive Residential Electricity Users Tax. (CONSENT) (Supervisor Mark Lovelace)

RECOMMENDATION: That the Board of Supervisors approve the request for election consolidation with the condition that the City of Arcata reimburse the County for costs incurred pursuant to this request, and request the Clerk of the Board forward the signed Board Order and copy of Arcata's

Resolution # 112-48 and Resolution # 112-52 to the Humboldt County Elections Department.

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

 

Board of Supervisors

1.                   Resolution of the City Council of the City of Rio Dell Requesting the County of Humboldt Elections Department to Include Rio Dell in the 2012 General Election for a Special Improvement Measure. (Supervisor Clif Clendenen)

RECOMMENDATION: That the Board of Supervisors approve the request for consolidation and the inclusion of the Special Improvement Measure with the condition that the City of Rio Dell reimburse the County for costs incurred pursuant to this request, and notify the Elections Department of the County to take any and all steps necessary for the holding of the consolidated election.

Child Support Services

2.                   Reallocation of a 37.5 Hour Legal Clerk I/II Position to a 40.0 Hour Legal Clerk I/II Position.

RECOMMENDATION: That the Board of Supervisors reallocate the 1.0 FTE, 37.5, Legal Clerk I/II (class 0350, salary range 264/284, position #01) position in budget unit 206, currently occupied by Virginia Roney, to a 1.0 FTE, 40.0 hour, Legal Clerk I/II (class 0351, salary range 274/297) position in budget unit 206, effective July 22, 2012.

3.                   Consider Setting Date and Process for Appointment to Fill Vacancies on the Humboldt County Aviation Advisory Committee, First Five Humboldt Commission, and the Arcata Redevelopment Oversight Board.

RECOMMENDATION: That the Board of Supervisors consider setting a date for making appointments to fill vacancies on the Humboldt County Aviation Advisory Committee, First Five Humboldt Commission, and the Arcata Redevelopment Oversight Board.

4.                   Board Orders for July 19, 2011.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from the meeting of July 19, 2011.

5.                   Board Orders from July 10, 2012.

Planning and Building Department

6.                   Temporary Increase in Compensation for Senior Planner, Michael Richardson to the position of Supervising Planner, Advance Planning Division.

RECOMMENDATION: That the Board of Supervisors approve a temporary increase in compensation for Senior Planner, Michael Richardson, as if promoted to the class of Supervising Planner, pursuant to Section 12.4 of the AFSCME MOU effective July 22, 2012, and continuing until December 30, 2012 or until a permanent Director is hired, at which time the assignment will be re-evaluated.

County Administrative Office

7.                   Supplemental Budget for Fund 1120, Budget Unit 275, Economic Development, Fiscal Year (FY) 2011-12.

RECOMMENDATION: That the Board of Supervisors approve the following supplemental budget in Fund 1120, Budget Unit 275, Economic Development, for FY 2011-12:   Revenue: 1120275-590034 HOME Grant Revenue $1,300,000; Expense: 1120275-3663 Aster place 08-HOME-5002 $1,3000,000.

 

 

 

 

 

 

Health and Human Services - Social Services Branch

8.                   Approve Second Option to Extend the Lease at 134 D. Street, Suite 101 and 302, Eureka, Ca.

RECOMMENDATION: That the Board of Supervisors: Approve exercising the second option to extend the lease at 134 D. Street, Suite 101 and 302, Eureka, CA with JLPREO, L.L.C.; Authorize Public Works-Real Property Division to send a notice to Lessor that County is exercising the first option to extend the lease; and Direct the Clerk of the Board to return one executed agenda to Public Works-Real Property Division.

9.                   Second Option to Extend the Lease at 231 Second Street, Eureka.

RECOMMENDATION: That the Board of Supervisors: Approve exercising the second option to extend the lease at 231 Second Street, Eureka with JLPREO, L.L.C. through September 30, 2012;  Authorize Public Works-Real Property Division to send a notice to Lessor that the County is exercising the second option to extend the lease; and Direct the Clerk of the Board to return one executed agenda item to Public Works-Real Property Division.

Human Resources

10.               Public Employees' Retirement System Contract Amendment.

RECOMMENDATION: That the Board of Supervisors: Direct the Clerk of the Board of Supervisors to sign the "CERTIFICATION OF FINAL ACTION OF GOVERNING BODY (Form CON-5)" form; and Authorize the Chair of the Board of Supervisors to sign the Amendment to Contract, two original sets.

Public Works

11.               Acknowledgement Of Irrevocable Offers Of An Easement Dedication From Eldridge And Jodrey And Resolution To Summarily Vacate An Offer Of Dedication Of A Portion Of Orchard Lane in Miranda.

RECOMMENDATION: That the Board of Supervisors: Acknowledge an Irrevocable Offer of an Easement Dedication from Philip Eldridge; Acknowledge an Irrevocable Offer of an Easement Dedication from Kevin Jodrey; Adopt the attached Resolution to summarily vacate a portion of Orchard Lane in Miranda pursuant to Streets and Highways Code Section 8330 (a).; Direct the Clerk of the Board to return a certified copy of the Resolution summarily vacating a portion of Orchard Lane in Miranda to the Department of Public Works Land Use Division for recordation; and Direct the Clerk of the Board to return a certified copy of the irrevocable offers to the Department of Public Works Land use Division for recordation.

12.               Rohnerville Airport Lease with Fortuna Ace Hardware, Inc.

RECOMMENDATION: That the Board of Supervisors by a 4/5's vote:  Authorize the Chairperson to sign and execute the attached Lease, in duplicate, with Fortuna Ace Hardware, Inc., LESSEE; and Direct the Clerk of the Board to return one original executed Lease to Real property for transmittal to the LESSEE.

13.               Arcata/Eureka Airport Runway 14 Bluff Stabilization Improvements, Airport Improvement Program (AIP) Grant 03-06-0010-39, Project No. 919265.

RECOMMENDATION: That the Board of Supervisors: Authorizes the Public Works Director to sign Change Order No. 5.0 to Wahlund Construction, Inc. for a $16,907.07 cost increase and an additional one (1) calendar day increase in construction time;  Authorizes the Public Works Director to sign Change Order No. 6.0 Final to Wahlund Construction, Inc. for a $26,862.10 cost increase and an additional three (3) calendar day increase in construction time;  Authorize the Chair to execute all our (4) copies of the attached First Amendment to the Construction Engineering Services Agreement between the County and Mead & Hunt, Inc., Santa Rosa, California, for the construction engineering services for the Arcata-Eureka Airport (ACV) Runway 14 Bluff Stabilization Improvements; and Direct the Clerk of the Board to file one (1) executed original, and return the remaining amendments to Public Works.

14.               Application for Reimbursement Under the State Criminal Alien Assistance Program.

RECOMMENDATION: That the Board of Supervisors authorize the Sheriff's Office's application to the State Criminal Alien Assistance Program (SCAAP) for reimbursement by accepting all assurances and certifications contained in the on-line application.

County Administrative Office

1.                   Response to the 2011-2012 Grand Jury Report.

RECOMMENDATION: That the Board of Supervisors:  Review and modify as necessary the proposed response (Attachment 2) from the Board of Supervisors to Grand Jury Report 2012-L&J-01;  Approve the document, as may be modified, as the response;  Direct the Clerk of the Board, within five working days, to submit the final response with an accompanying Board Order, to the Presiding Judge of the Superior Court; and Direct the Clerk of the Board, within five working days, to submit two copies of all responses to the County Clerk/Recorder, one of which will be forwarded to the State Archivist, together with a copy of the original report.

2.                   Consider Making Appointment to Fill Vacant At-Large Seat on the Humboldt County Planning Commission.

RECOMMENDATION: That the Board of Supervisors consider making an appointment to fill the open At-Large seat on the Humboldt County Planning Commission.

Building and Planning

1.                   Samoa Town Master Plan General Plan Amendment (Local Coastal Plan Amendment)/Zone Reclassification /Urban Limit Line Extension.  File No. APN 401-021-29; Case No: GPA-02-01/ZR-0202 Samoa Area.

RECOMMENDATION: That the Board of Supervisors:  Open the Public Hearing in the manner prescribed by the law, and receive the staff report, and public testimony; Deliberate on the project as necessary;  Approve modified land use and zoning maps (as requested by the California Coastal Commission staff) for Samoa Town Master Plan Amendment of the Humboldt County General Plan (Humboldt Bay Area Plan (HBAP)); Introduce Ordinance by Title and Waive Further Reading, and approve adoption of Ordinance No. _____ amending Section 311-7 of the Humboldt County Code.  The proposed rezoning would amend the zoning for the approximate 171 acres making up 6 parcels of the Samoa town site by designating the boundary lines of the following zones and combining zones.  Residential Single Family (RS), Residential Multi Family (RM), Commercial General (CG), Commercial Recreation (CR), Natural Resources (NR), Public Recreation (PR), Public Facilities (PF), and Coastal Dependent Industrial (MC) zones; and Planned Unit Development (P), Wetland (W), Archaeological Resources (A) and Design Review (D) combining zones (Attachment C2); Direct the Clerk of the Board to publish the post adoption summary of the Ordinance within 15 days after adoption of the Ordinance (Attachment C2); Adopt a Revised Resolution making the Required Findings and Recommending adoption of the Local Coastal Plan Amendments as modified by the Coastal Commission (Attachment A); Adopt a Resolution of Transmittal to the California Coastal Commission or the revises land use and zoning maps to the California Coastal Commission for certification in accordance with Coastal Act (Attachment D); Direct the Clerk of the Board to give notice of the decision to the applicant, to the Assessor's Office and any other interested party; and Close the Public Hearing.

2.                   Moore Zone Reclassification, Parcel Map Subdivision, Establishment of the Alex Morre Agricultural Preserve and Disestablishment of the Branstetter Agricultural.  Preserve AGP-77-16.  Case Nos.: AGP-08-06/ZR-08-05/PMS-08-17.  File Nos.: APNs 107-101-12 et al.  Honeydew Area.

RECOMMENDATION: That the Board of Supervisors:  Introduce Ordinance No. ____ (Attachment A) by title and waive further reading;  Hold a public hearing in the manner prescribed by law and consider the application;  receive the staff report and public comment;  Approve Resolution No. __ (Attachments B), adopting the Planning Commission findings; Approve the Zone Reclassification (rezone) amending Section 311-7 of the Humboldt County Code by reclassifying timberlands in the Honeydew area and within the Branstetter Agricultural Preserve that are currently zoned Agriculture Exclusive (AE-B-5(160) and AE-B-5(193)) into Timberland Production Zone (TPZ) by adoption of Ordinance No. _____ (Attachment A);  Adopt Resolution No. ____ (Attachment C) disestablishing the Branstetter Agricultural Preserve No. AGP-77-16;  Adopt Resolution No. ___ (Attachment D) establishing the Moore Agricultural Preserve AGP-12-01;  Authorize the Chair of the Board to execute a land Conservation Contract (Attachment E) for the Moore Class B Agricultural Preserve AGP-12-01;  Approve the Parcel Map Subdivision to result in Parcels 1, 2, and 3 of approximately 609,200 and 710 acres, respectively;  Approve the immediate cancellation of Parcels 2 and 3 from the Land Conservation Contract for the Branstetter Agricultural Preserve No. AGP-77-16;  Direct the Clerk of the Board to record copies of the Resolutions and the Moore Land Conservation Contract with the County Recorder; Direct the Clerk of the Board to record a Certification of Rezoning (Notice of Timberland Production Zone Status) (Attachment F) on the parcel pursuant to Sections 51117 and 51141) of the California Government Code (C.G.C), after attaching a copy of the fully executed Ordinace and map (Attachment A, Exhibit B); and Direct the Clerk of the Board to give notice of the decision to the applicants/owners, the county Assessor's Officer, the California Office of Land Conservation and any other interested party, and to publish the Post-Adoption Summary of the Ordinance (Attachment G) within 15 days after adoption by the Board, and direct the Planning Division to file a notice of Exemption with the County Clerk and office of Planning and Research pursuant to the California Environmental Quality Act (CEQA).
