B.                  MODIFICATIONS TO THE AGENDA

1.                   Bureau of Reclamation's Environmental Assessment/Findings of No Significant Impacts 2012 Lower Klamath River Late Summer Flow Augmentation (CONSENT). (Supervisor Mark Lovelace and Supervisor Ryan Sundberg)

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the letter from the Board of Supervisors commenting on the Bureau of Reclamation's Draft Environmental Assessment and the Findings of No Significant Impact for Lower Klamath/Trinity River Flow Augmentation - Late Summer 2012.

C.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Agricultural Commissioner

1.                   Approval of Cooperative Agreement No. 12-0303-SF Sudden Oak Mortality Regulatory Program Contract in the Amount of $28,975.03.

RECOMMENDATION: That the Board of Supervisors:  Approve Cooperative Agreement No. 12-0303-SF known as the Sudden oak Mortality Regulatory Program contract with the California Department of Food and Agriculture and; Authorize the Chair to sign the original agreement and one copy of the cover page, and direct the Clerk of the Board to return the signed agreement to the Agricultural Commissioner's Office for further processing; and Authorize the Auditor-Controller to execute the attached supplemental budget for fiscal year 2012-13; and Grant a waiver from the provisions of the Nuclear Free Ordinance.

2.                   Approval of Standard Agreement No. 12-0251-SA, Nursery Inspection Program Contract in the Amount of $2,471.00

RECOMMENDATION: That the Board of Supervisors: Approve Standard Agreement No. 12-0251-SA, known as the Nursery Inspection and Enforcement Program contract with the California Department of Food and Agriculture in the amount of $2,471.00; and Authorize the Chair to sign the original agreement, one copy of the cover page, and direct the Clerk of the Board to return all signed copies to the Agricultural Commissioner's office for further processing; and Grant a waiver from the provisions of the Nuclear Free Ordinance.

3.                   Reappointment of Mark Moore, Gary Belli and Gary Markegard to the Humboldt County Resource Conservation District Board. (Supervisor Jimmy Smith)

RECOMMENDATION: That the Board of Supervisors approve the reappointment of Mark Moore, Gary Belli and Gary Markegard for another four-year term, expiring on November 30, 2016.

4.                   Informational Report on the Appointment of Maggie Herbelin to the Citizens Law Enforcement Liaison Committee. (Supervisor Mark Lovelace)

RECOMMENDATION: That the Board of Supervisors receive and file the report.

5.                   Informational Report on the Appointment of Suzi Fregeau to the Citizens Law Enforcement Liaison Committee. (Supervisor Jimmy Smith)

RECOMMENDATION: That the Board of Supervisors receive and file the report.

Clerk of the Board

6.                   Board Orders from July 17, 2012.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders on July 17, 2012.  Authorize the Clerk of the Board and the Board Chair to sign the minute book in accordance with California Government Code Section 25103.

7.                   Recommendation to Reappoint John Rice, Peggy Satterlee, and Jonathon Brooks to the Williamson Act Committee.

RECOMMENDATION: That the Board of Supervisors approve the reappointment of John Rice, Peggy Satterlee, and Jonathon Brooks to the Williamson Act Committee for another two-year term, expiring on June 30, 2014.

County Counsel

8.                   Adoption of Fair Political Practice Commission Form 806.

RECOMMENDATION: That the Board of Supervisors:  Adopt the Fair Political Practice Commission ("FPPC") Form 806 ("Attachment 1"); and Direct the Clerk of the Board of Supervisors to post the FPPC Form 806 on the County's website, and to list on the Form all appointed positions by the Board of Supervisors for which compensation is paid, the salary or stipend for each appointed position, the name of the Board member who has been appointed as a member or alternate to those positions, and the term of such positions; and Direct the Clerk of the Board of Supervisors to update the information on Form 806 as needed.

 

Health and Human Services - Public Health Branch

9.                   Approval of Third Amendment To License with Grace Good Sheperd Church and Presbytery of the Redwoods for Office Space at 1450 Hiller Road, McKinleyville, California.

RECOMMENDATION: That the Board of Supervisors: Approve and authorize the Chair of the Board to execute the Third Amendment To License with Grace Good Shepherd Church and Presbytery of the Redwoods for Office Space at 1450 Hiller Road, McKinleyville, California; and Direct the Clerk of the Board to return one original of the executed Third Amendment To License to Public Works - Real Property Division for transmittal to Grace Good Shepherd Church and Presbytery of the Redwoods.

Health and Human Services - Social Services Branch

10.               Approval of County Purchase document with the California State Automated Welfare System (SAWS) Consortium IV to deploy and maintain a customer service center that will enable the Department of Health and Human Services to meet its mandatory enrollment obligations related to the delivery of CalFresh, Medi-Cal, County Medical Services program (CMSP) and other federal entitlement benefits.

RECOMMENDATION: That the Board of Supervisors approve the Purchase Approval document with California SAWS Consortium IV to deploy  and maintain a customer service center; authorize the Chair to sign three (3) copies of the Approval document to the Director, Department of Health and Human Services Social Services Branch Director to forward for final execution by the California SAWS Consortium IV; and direct the Department of Health and Human Services Social Services Branch Director to return on fully executed original to the Clerk of the Board.

11.               Temporary Salary Increase in Accordance with Section 7 of the Humboldt County Salary Resolution (4/5 Vote Required).

RECOMMENDATION: It is recommended that the Board of Supervisors authorize a temporary increase in compensation for Senior Staff Service Analysis, Nancy Starck, of 20 salary ranges, beginning July 22, 2012 and continuing until Merit System Services (MSS) and the Department have had the opportunity to review the position with the added duties or a one year period whichever comes first, pursuant to Section 7 of the Humboldt County Salary Resolution (4/5 Vote Required).

Probation

12.               Advanced Salary Step for Probation Officer I, Sam Gentle Per Section 7 of the Humboldt County Salary Resolution (4/5 vote required).

RECOMMENDATION: That the Board of Supervisors approve the Probation Department's advance step at range 346, Step C for Probation Officer I (Class 0473, Position 06), Sam Gentle.

Public Works

13.               Allocation of an Office Assistant Position in the Public Works Department Roads - Administration Division.

RECOMMENDATION: That the Board of Supervisors approve the allocation of 1.0 FTE Office Assistant I/II (class 0179, salary range 250/281) position in budget unit 1200320 effective the beginning of the next bi-weekly pay period following approval.

14.               Assignment of Michael Orr, Senior Park Caretaker as Parks Supervisor.

RECOMMENDATION: That the Board of Supervisors authorize compensation for Michael Orr as if he had been promoted to the classification of Parks Supervisor from July 15, 2012 through September 29, 2012, or until such time as a new Parks Supervisor is appointed, pursuant to Section 12.4 (Acting Supervisor) of the American Federation of State, County and Municipal Employees (AFSCME) Memorandum of Understanding.

15.               Change Order No. 3.0, Department of Health and Human Services (DHHS) Mental Health Branch for the Heating, Ventilating and Air Conditioning (HVAC) System Repair Project, Project No. 170114.

RECOMMENDATION: That the Board of Supervisors authorizes the Public Works Director to sign Change order No. 3.0 for a $16,735 cost increase and an additional 152 calendar days.

D.                  SPECIAL PRESENTATIONS

1.                   Comments of Appreciation in Recognition of Supervisor Jimmy Smith.

RECOMMENDATION: That the Board of Supervisors hear the "Comments of Appreciation" and take appropriate action, if required.

Public Works

1.                   Ordinance Amending Sections 421-3 and 421-7 related to stop signs on Hemlock and Walnut Streets to Title IV of the Humboldt County Code.

RECOMMENDATION: That the Board of Supervisors: Introduce the attached Ordinance by title, waive the first reading; and set the Ordinance for adoption on August 14, 2012 or at lease one week away; and Direct the Clerk of the Board to publish the pre-adoption summary of the Ordinance and to post a certified copy of the full text of the proposed Ordinance in the office of the Clerk of the Board, both publication and posting to be done at least five (5) days prior to the Board meeting at which the Ordinance will be adopted [Government Code Section 25124 (b)(1)}; and Direct the Clerk of the Board, within 15 days after adoption of the Ordinance, to publish a post-adoption summary of the Ordinance with the names of the Supervisors voting for and against the Ordinance, and to post in the office of the Clerk of the Board a certified copy of the full text of the adoption Ordinance and amendments along with the names of those Supervisors voting for and against the Ordinance and amendments along with the names of those Supervisors voting for and against the Ordinance [Government Code Section 25124(b)(1)]; and Direct Public Works to file the attached Notice of Exemption with the County Clerk in accordance with the California Environmental Quality Act.

2.                   Consider Making Appointment to Fill Vacant At-Large Seat on the Humboldt County Planning Commission. (CONTINUED FROM JULY 17, 2012 BOARD OF SUPERVISORS MEETING)

RECOMMENDATION: That the Board of Supervisors consider making an appointment to fill the open At-Large seat on the Humboldt County Planning Commission.

Planning and Building Department

1.                   City of Trinidad and Friends of Westhaven and Trinidad (co-appellants).  Appeal of the Planning Commission Approval of the Michael Moss Parcel Map Subdivision.  Application Case Nos.: PMS-03-14AA APN 515-131-32, 515-291-46, Trinidad Area.

RECOMMENDATION: That the Board of Supervisors:  Open the public hearing for the appeal; Continue the project, per request of the Project Applicant, to a date certain of September 4, 2012; and direct the Clerk of the Board to give notice of the decision to the Appellants, the Project Applicant, Planning Staff, and any other interested party.

Public Works

2.                   Public Hearing to Consider of an Ordinance to Amend the 2011-12 Humboldt County Schedule of Fees and Charges to Incorporate New Fees for the County's Operation of Grizzly Creek Redwoods State Park.

RECOMMENDATION: That the Board of Supervisors:  Open the public hearing and receive the staff report and public comments regarding the proposed new fees for the County's operation of Grizzly Creek Redwoods State Park; Close the Public Hearing; Approve the nee fees as shown on Attachment #2; Introduce by title Ordinance No. ____ (Attachment #1), incorporating new fees for the County's operation of Grizzly Creek Redwood State Park into the 2011-12 Humboldt County Schedule of Fees; And direct the Clerk of the Board to publish, within 15 days, a post adoption summary of the Ordinance (Attachment #3) with the names of the Supervisors voting for and against the ordinance, and to post in the office of the Clerk of the Board a certified copy of the full text of the adopted ordinance and amendments along with the names of those Supervisors voting for and against the ordinance.

M.                 AFTERNOON DISCUSSION ITEMS

1.             County Administrative Officer Report:  Federal Legislation, Revision to Ordinance No.          2477 and Various Other Topics.

RECOMMENDATION: That the Board of Supervisors receive an oral report from the County Administrative Officer on federal legislation, revisions to Ordinance No. 2477, and various other topics, and take action as may be required.

2.             Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance,        and Supervisorial District Matters.
