Agricultural Commissioner

1.                   Renewal of Memoranda of Understanding with Del Norte and Trinity County Departments of Agriculture to Provide Regulatory Weighing and Measuring Services.

RECOMMENDATION: That the Board of Supervisors approve renewal of memoranda of understanding (MOUs) between the Agricultural Commissioner's Office and the Del Norte and Trinity County Departments of Agriculture for weights and measures services; authorize the Chair to sign on original and one copy of each memorandum; and return all four copies of the MOUs along with a Board order authorizing execution to the Agricultural Commissioner's Office for final processing and mailing to the respective counties.

2.                   Supplemental Budget for Agricultural Commissioner FY 2011-2012.

RECOMMENDATION: That the Board of Supervisors approve the following supplemental budget for FY 2011-12; Revenue 1100261-525032 State Aid for Pesticide Program = $4,275.00; Expenditure 1100261-2118 Professional & Special Services $4,275.00.

3.                   Approval of Memorandum of Understanding with the California Agricultural Commissioners and Sealers Association to Receive Reimbursement for Pesticide use Reporting Activities.

RECOMMENDATION: That the Board of Supervisors approve the Memorandum of Understanding (MOU) between Humboldt County and the California Agricultural Commissioners and Sealers Association to receive reimbursement for pesticide use reporting activities; authorize the Chair to sign two copies of the memorandum; and direct the Clerk of the Board to return both signed copies of the MOU to the Agricultural Commissioner's office for final processing.

4.                   Resolution Establishing Balance in Tax Loss Reserve Fund.

RECOMMENDATION: That the Board of Supervisors adopt the accompanying resolution establishing the balance of the Tax Loss Reserve fund pursuant to Revenue and Taxation Code section 4703.2(c).

5.                   Reappointment of Petrolia Cemetery District Board Members Kelton Chambers, Teresa Jordan, Nick Mendes, Patty Mendes and Joe Zanone. (Supervisor Rex Bohn)

RECOMMENDATION: That the Board of Supervisors approve the reappointment of Kelton Chambers, Teresa Jordan, Nick Mendes, Patty Mendes and Joe Zanone to the Petrolia Cemetery District Board of Trustees.

6.                   Humboldt County Fish & Game Advisory Commission Request to Fund Two Grants. (Supervisor Rex Bohn)

RECOMMENDATION: That the Board of Supervisors direct grant allocations as requested and direct the Clerk of the Board to notify the Secretary of the Humboldt County Fish & Game Advisory Commission of the Boards decision.

7.                   Letter of Appreciation to Walt Giacomini for his service on the Humboldt County Resources Conservation District. (Supervisor Virginia Bass)

RECOMMENDATION: That the Board authorize the Chair to sign the letter of appreciation.

8.                   Informational Report Regarding the Appointment of Jackie Deuschle Miller and George Davis to the Greater Eureka Area Municipal Advisory Committee (GEAMAC)

RECOMMENDATION: That the Board of Supervisors receive and file the report.

9.                   Board Orders from the Meeting of July 24, 2012.

RECOMMENDATION: Approve the Board Orders of July 24, 2012.  Authorize the Clerk of the Board and the Board Chair to sign the minute book in accordance with California Government Code Section 25103.

10.               Property Tax Sharing Agreements with Local Fire Districts.

RECOMMENDATION: That the Board of Supervisors authorize the County Administrative Officer or his designee to represent the County in negotiations with local fire districts for a share of the County's General Fund property tax revenues in areas of service expansion resulting from district boundary changes.

11.               Supplemental Budget for Cable Franchise Transfer Processing.

RECOMMENDATION: That the Board of Supervisors adopt the following supplemental budget for Fiscal Year 2012-2013: Revenue 1100103-619033 Fee for Service $5,000; Expenditure 1100103-2118 Professional & Special Service $5,000.

12.               HOME Program First Time Homebuyer Grant Application.

RECOMMENDATION: That the Board of Supervisors approve the submission of a First Time Homebuyer Grant Application and authorize the County Administrative Officer to sign all documents related to the Application and documents to carry out grant activities.

13.               Set Public Hearing for Adoption of Fee Updates.

RECOMMENDATION: That the Board of Supervisors:  Direct to Clerk of the Board to schedule a public hearing on Tuesday, August 28, 2012 at 1:30pm or as soon thereafter as the matter may be heard, for consideration of adoption of an ordinance updating the Humboldt County Schedule of Fees and Charges; Direct the Clerk of the Board to post and publish the required pre-adoption summary of the ordinance and public hearing notice for updating the Humboldt County Schedule of Fees and Charges at least ten (10) days prior to the public hearing;  two publications are required, with at least five (5) days intervening between the dates of the first and last publication, not counting such publication dates; Direct the Clerk of the Board to have the data and documentation supporting the new fees for public review at least  ten (1) days prior tot he public hearing; and Direct the Clerk of the Board to post a certified copy of the full text of the proposed ordinance in the office of the Clerk of the Board of Supervisors at least five (5) days prior to the Board meeting at which the ordinance will be adopted [Government Code Section 25124(b)(1)].

Health and Human Services - Administration

14.               Second Option to Extend the Lease at 930 Sixth Street, Eureka.

RECOMMENDATION: That the Board of Supervisors approve exercising the second option to extend the lease at 930 Sixth Street, Eureka with California Newspapers Partnership, Inc. through November 30, 2013; Authorize Public Works- Real Property Division to send a notice to Lessor that the County is exercising the second option to extend the lease; and direct the Clerk of the Board to return one executed agenda item to Public Works- Real Property Division.

Health and Human Services - Mental Health Branch

15.               Agreement with Glenn County Health Services.

RECOMMENDATION: That the Board of Supervisors approve the Agreement with Glenn County Health Services; authorize the Chair to sign the Agreement with Glenn County Health Services; and direct the Clerk of the Board to return the three signed originals of the Agreement to the Department of Health and Human Services (DHHS) - Mental Health Branch Administration for transmittal to Glenn County for final executed.

16.               California Department of Mental Health (DMH) and California Department of Health Care Services (DHCS) Managed Care Agreement for the term April 1, 2012 through December 31, 2012.

RECOMMENDATION: That the Board of Supervisors approve the attached Agreement between the Department of Health and Human Services, Mental Health Branch and the California DMH and California DHCS for the term April 1, 2012 to December 31, 2012; authorize the Department of Health and human Services (DHHS) - Mental Health Branch Director to sign the Agreement and subsequent amendments or documents related to the original Agreement for the term April 1, 2012 through December 31, 2012 on behalf of Humboldt County and submit it to the California DMH and California DHCS; and direct the Clerk of the Board to send the DHHS-Mental Health Branch Administration one certified copy of this Board Order.

17.               Reappointments of Jennifer Wilson, M.D., Harpreet Duggal, M.D. and Jonathan Greenberg, M.D. as active members of the Medical Staff at the Sempervirens Acute Psychiatric Hospital.

RECOMMENDATION: That the Board of Supervisors, acting as the Governing Body of Sempervirens Psychiatric health Facility and with the recommendations of the Department of Health and Human Services Mental Health Branch Medical Staff Executive Committee: Approve the reappointments of the Medical Staff of the Sempervirens Psychiatric Health Facility as follows: Jennifer Wilson, M.D. as Active Medical Staff member with all requested clinical privileges for a two year term; Harpreet Duggal, M.D. as Active Medical Staff member with all requested clinical privileges for a two year term and Jonathan Greeberg, M.D. as Active Medical Staff member with all required clinical privileges for a two year term.

18.               California Child and Family Services Review, County Self Assessment for Humboldt County Social Services Branch, Children & Family Services, and Humboldt County Probation Department.

RECOMMENDATION: That the Board of Supervisors approve the California Child and Family Services Review, Humboldt County Self Assessment (2012) for the Child Welfare Services (CWS) Division of Children & Family Services, Social Services Branch (SSB); authorize the Chair to execute four (4) copies of the Self Assessment document as requested by the state; and direct Clerk of the Board to route three (3) copies of the Self Assessment document to the Director of Health and Human Services.

19.               Literacy Services Agreement with Humboldt Literacy Project.

RECOMMENDATION: That the board of Supervisors accept Grant Award # 40-8067 through the California State Library in the amount of $6,280 as a pass through to the Humboldt Literacy Project; authorize the Chairperson to sign Grant Award #40-8067 on behalf of the County and return to the County Librarian; authorize the Chairperson to sign the attached Literacy Services Agreement and two additional copies of the signature page; and direct the Clerk of the Board to return the two (2) signed signature pages of the Literacy Services Agreement to the County Librarian.

20.               Storm Damage Repairs on Mattole Road (3C010) at PM 6.60 Project No.: ER-4400(060), Contract No.: 206394.

RECOMMENDATION: That the Board of Supervisors accept the completed contract, including all change orders approved by the Public Works Department, between G.R. Wilcox Enterprises, Inc. and Humboldt County for the storm damage repairs on Mattole Road; approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $2,458.65. This will bring the total amount paid to 100% of the contract.

21.               Lease Agreement with Hertz Corporation for the Arcata/Eureka Airport.

RECOMMENDATION: That the Board of Supervisors by a 4/5 vote; approves and authorizes the Chairperson to execute the lease with Hertz Corporation; and direct the Clerk of the Board to return two executed originals of the lease to the Public Works Department for transmittal to the Lessee.

22.               Bell Springs Road (8A010) at PM 4.50 & Island Mountain Road (8A020) at PM 2.50, DSR No: 2922, 2830, Contract No.: 210271, 210258.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above mentioned project as required by Section 22037 of the California Public Contract Code with Bids to be opened on Tuesday, September 11, 2012 at 2:00 P.M.

23.               Adoption of Federal Emergency Management Agency Grant #2012-0004 and Approval of Request for Proposal for Consulting Services for the Humboldt Operational Area Hazard Mitigation Plan Update.

RECOMMENDATION: That the Board of Supervisors: Authorize the Public Works Director to sign the California Emergency Management Agency Grant Award Face Sheet (Attachment 2) and Sub grantee Assurances (Attachment 3) for grant funding from the Federal Emergency Management Agency to perform the Humboldt Operational Area Hazard Mitigation Plan Update: Authorize the Public Works Director to issue the attached Request for Proposals (Attachment 4) for consulting services; and Direct the Auditor-Controller to incorporate the supplemental budget as follows:  Revenue:1100289-589020 $120,000 FEMA Pre-Disaster Mitigation 12.  Expense: 1100289-3381 $120,000 FEMA Pre-Disaster Mitigation 12.

24.               Construction of Earthquake Repairs on Tompkins Hill Road (3H050) at PM 0.2-2.7, Project No.: ER-4820 (032), Contract No.: 210245.

RECOMMENDATION: That the Board of Supervisors:  Receive and file the bids for Construction of Earthquake Repairs on Tompkins Hill Road at PM 0.2-2.7;  Award the contract to Van Meter Logging, Inc for the total amount of $82,099.50; Authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and Direct the Auditor-Controller to establish a new contract account 1200321-0285 and transfer $86,205.00 to the account per the attached appropriation transfer.

25.               Construction of Earthquake Repairs on Mattole Road (F3C010) at PM 39.90 & 42.84-43.62, Project No.: ER-4820 (002) & (007), Contract No.: 210200 & 210208.

RECOMMENDATION: That the Board of Supervisors: Receive and file the bids for Construction of Earthquake Repairs on Mattole Road at PM 39.90 & 42.84-43.62; Award the contract to Van Meter Logging, Inc for the total amount of $173,386.50; Authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0286 and transfer $182,056.00 to the account per the attached appropriation transfer.

26.               Amendment to the Agreement for the Operation of Six Solid Waste Southern Container Sites.

RECOMMENDATION: That the Board of Supervisors approves the attached Amendment to the Agreement with Eel River Disposal and Resource Recovery, Inc. (ERD) for the operation of six solid waste southern container sites effective August 15, 2012; and direct the Clerk of the Board to return two fully executed copies of the said Amendments to Public Works for distribution.

27.               Budget Adjustment and Bid Authorization for Mental Health Nurse's Station Project, County of Humboldt, Project No. 162313.

RECOMMENDATION: That the board of Supervisors:  Approve the attached Budget Adjustment for department of Health and Human Services (DHHS) Mental Health Branch Administrative budget unit 1170-424 to provide funding for the nurse's station project; Receive the plans and specifications; and Authorize the Clerk of the Board to advertise the above-mentioned project, pursuant to Section 22073 of the California Contract Code, with bids to be opened on Tuesday, September 18, 2012 at 2:00pm.

28.               Adoption of Ordinance: Amending Sections 421-3 and 421-7 Relating to Stop Signs on Hemlock and Walnut Streets to Title IV of the Humboldt County Code.

RECOMMENDATION: That the Board of Supervisors adopt Ordinance No. _______, Amending Sections 421-3 and 421-7 relating to stop signs on Hemlock and Walnut Streets to Title IV of the Humboldt County Code.

29.               Authorization to Submit an Application for FY12 Emergency Management Performance Grant (EMPG) to the California Emergency Management Agency and Signature Authority.

RECOMMENDATION: That the Board of Supervisors authorize the Sheriff's Office to submit an application for fiscal year 2012 Emergency Management Performance Grant (EMPG); authorize the Chair to sign the Governing Body Resolution and Certification naming the Chair and the Sheriff as authorized agents to execute actions necessary for obtaining financial assistance; and direct the Clerk of the Board to return the completed documents to the Sheriff's Office, Attention Linda Modell by Wednesday August 15, 2012, for further processing.

30.               Governing Body Resolution, Certification and Grant Assurance for the Federal Fiscal Year 2012 Homeland and Security Grant Program.

RECOMMENDATION: That the Board of Supervisors; Authorize the Chair to sign, in blue ink, the Governing and Certification and direct the Clerk of the Board to certify, for a grant request to the State for the Federal Fiscal Year (FFY) 2012 Homeland Security Grant Program;  Authorize the Sheriff to sign the Grant Assurances, cover sheet and other grant documents as Authorized Agent; and Direct the Clerk of the Board to return the completed documents tot he Sheriff's Office, attention Linda Modell by Wednesday, August 15, 2012, for further processing.
