B.                  MODIFICATIONS TO THE AGENDA

1.                   Small Communities Air Service Grant Award between the United States Department of Transportation and Humboldt County. PUBLIC WORKS [CONSENT]

RECOMMENDATION: That the Board of Supervisors authorize and approve the Director of Public Works to execute the Grant Offer for the award of a Small Committees Air Services Grant (SCASG) for the amount of $750,000 to serve as a component of a minimum revenue guarantee (MRG) for additional air service at the Arcata - Eureka Airport (ACV).

2.                   Consider Appointing Dan Hauser as the Public Member on the Arcata Redevelopment Oversight Board (CONSENT). (Supervisor Lovelace)

RECOMMENDATION: That the Board of Supervisors appoint Dan Hauser as the Public Member on the Arcata Redevelopment Oversight Board.

Board of Supervisors

1.                   Resolution Recognizing Susan Schlosser on her Retirement. (Supervisor Virginia Bass)

RECOMMENDATION: That the Board of Supervisors Ratify the Resolution.

2.                   Proclaim September 17th through September 23rd, 2012 as Constitution Week in Humboldt County. (Supervisor Virginia Bass)

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sogn the Proclamation.

3.                   Letter of Appreciation to Fire Chief Bob Harris for his services on the Fire Safe Council. (Supervisor Virginia Bass)

RECOMMENDATION: Authorize the Chair to sign the letter of appreciation.

4.                   Letter of Appreciation to Fire Chief John McFarland for his service on the Fire Safe Council. (Supervisor Virginia Bass)

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the letter of appreciation.

Clerk of the Board

5.                   Approval of the Board Orders dated August 21, 2012.

RECOMMENDATION: Approve the Board Orders of August 21, 2012.  Authorize the Clerk of the board and the board Chair, to sign the minute book in accordance with California Government Code Section 25103.

County Administrative Office

6.                   Approval of a Headwaters Fund Grant Award for up to $250,000 to the Redwood Region Economic Development Commission for Airline Recruitment.

RECOMMENDATION: That the Board of Supervisors review and approve the Headwaters Fund Board's recommended Community Investment Fund (CIF) grant of up to $250,000 to the Redwood Region Economic Development Commission (RREDC) for Airline Recruitment (Attachment 1; and Attachment 2) and authorize the Chair of the Board to sign the grant contract after review and approval by County Counsel and Risk Management.

7.                   Supplemental Budgets for Fiscal Year 2011-12.

RECOMMENDATION: That the Board of Supervisors approve the fiscal year (FY) 2011-12 supplemental budgets shown on Attachment 1 for the County Administrative Office Management Budget Team, Revenue Recovery, Contributions- Other, Courts-County Funded, Inmate/Indigent Medical Care, Liability and Purchasing.

District Attorney

8.                   District Attorney Supplemental Budget for Fiscal Year 2012-13.

RECOMMENDATION: That the Board of Supervisors approve the attached supplemental budget in the amount of $21,200 from the Special Narcotics Investigation Trust Fund to the Office of the District Attorney (DA) budget unit 1100-205.


Human Resources

9.                   Phase II in the Implementation of the Human Resources Department.

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. ____ approving the Amendment to the Compensation Plans for Management and Confidential Employees and Elected and Appointed Department Heads for fiscal years 2011-2012 and 2012-2013, effective September 2, 2012; approve the revised class description for Assistant Personnel Director with the new title of Assistant Director of Human Resources (class 0651, salary range 498, unit 8), effective September 2, 2012; adopt the new job class of Senior Human Resources Analyst – Risk (class 0690, salary range 444, unit 9, (effective immediately) approve the revised job class description for Personnel Analyst I/II with the new title of Human Resources Analyst I/II (class 0684, salary range 404/432, unit 9), effective immediately; Reallocate the vacant 1.0 FTE Human Resources Analyst – Risk I/II (class 0697, salary range 404/432, position 2) position in budget unit 359 to Senior Human Resources Analyst – Risk (class 0690, salary range 444), effective September 2, 2012.

Probation

10.               Supplemental Budget for Probation Department's Public Safety Realignment Budget Unit 294.

RECOMMENDATION: That the Board of Supervisors approve the Probation Department's Supplemental Budget in Budget Unit 294; and approve the allocation of three (3) 1.0 FTE Probation Officer I/II (class 0473, salary range 346/378) positions in Budget Unit 294, effective immediately.

Public Works

11.               Request for Proposal (RFP) for Preparation of a County-Wide Development Impact Fee Study.

RECOMMENDATION: That the Board of Supervisors direct the Department of Public Works to issue a request for proposal (RFP) for the preparation of a county-wide Development Impact Fee Study with proposals due on October 5, 2012; direct the Department of Public Works to report to the Board of Supervisors with the ranking of the firms; and direct the Department of Public Works to work with the County Administrative Office to identify funding for the preparation of a county-wide Development Impact Fee Study.

12.               Transfer from Public Works Land Use (166) and Water Management (251) through Contingencies to Parks (713) for Fiscal Year 2011/12.

RECOMMENDATION: That the Board of Supervisors approves the attached Budget Transfer moving appropriations from Public Works Land Use (166) and Water Management (251) through Contingencies to Parks (713).

13.               Agreement with Enterprise Rent-A-Car Company for the Arcata/Eureka Airport.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chairperson to execute the Agreement with Enterprise Rent-A-Car Company; and direct the Clerk of the Board to return two executed originals of the Agreement to the Public Works Department for transmittal to the concessioner.

14.               Grant Agreement with the Trust for Public Land for Phase One of Management Plan Development for Proposed McKay Tract Community Forest.

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the attached grant agreement with the Trust for Public Land providing funds in the amount of $17,000 for Public Works to initiate the first phase of developing a management plan for a proposed community forest within the McKay Tract, located southeast of Eureka; and adopt the attached supplement budget for FY 2012-13.

15.               Terminate the existing License Agreement and approve a new License Agreement for the Hansen-Degnan Surface Mining Operation, Stockpile Site, and Temporary Equipment Storage Area, APN 207-036-001, 32353 Kneeland, Bridgeville.

RECOMMENDATION: That the Board of Supervisors approve the termination of the existing Agreement between the County of Humboldt and John J. Hansen (deceased) for the Hansen-Degnan property (APN 207-036-001) along Kneeland Road, and direct staff to provide the owner written notice of termination; authorize the Chairperson to sign, in duplicate, the new License Agreement between the County of Humboldt and Pat O’Day (President) and Wanda Hansen-Ash (Secretary) of Hansen – Degnan Properties; and direct the Clerk of the Board to return both executed License Agreements to the Department of Public Works Land Use Division for further processing.

Sheriff

16.               Supplemental Budget in Sheriff's Budget 1100 221 to Purchase Hardware and Application Services to Upgrade Sheriff's Office Computer Aided Dispatch (CAD).

RECOMMENDATION: That the Board of Supervisors approve a supplemental budget in budget unit 1100 221 in the amount of $26,266 for the purchase of two (2) servers and application upgrade for the Sheriff's Office Computer Aided Dispatch (CAD) program.

D.                  SPECIAL PRESENTATIONS

1.                   Proclaim September 2012 as Local Food Month in Humboldt County. (Supervisor Virginia Bass)

RECOMMENDATION: Adopt the Proclamation.

2.                   Resolution Recognizing Carla Bolton on her Retirement. (Supervisor Virginia Bass)

RECOMMENDATION: That the Board of Supervisors adopt the Resolution.

3.                   Presentation on East-West Railroad Feasibility Study.

RECOMMENDATION: That the Board of Supervisors receive a presentation from David Tyson, City Manager of the City of Eureka, regarding a feasibility study for a possible east-west railroad alignment; determine whether the Board of Supervisors wishes to take a position with respect to this item; and if the Board wishes to express support for the concept of a feasibility study, direct staff to return to the Board with a resolution of support.

DHHS - Environmental Health

1.                   Appeal of the Division of Environmental Health Approval of Septic Permit Issued May 14, 2012 to Gregory Hufford for 81 Lundblade St. Orick, Ca. Assessor's Parcel Number (APN): 520-082-006.

RECOMMENDATION: That the Board of Supervisors open the public hearing and receive testimony of the Health Officer, the appellant, the property owner and/or the testimony of their respective agents; receive public comment; based on the testimony received, affirm the Division of Environmental Health's (DEH) action; direct the Clerk of the Board to give notice of the decision to the permit applicant, the property owners, the Director of the Division of Environmental Health, the Director of the Building Division, the appellant party and any other interested party; and close the public hearing.

County Administrative Office

2.                   Public Hearing to Consider Adoption of and Ordinance for the 2012-13 Update of the Humboldt County Schedule of Fees and Charges.

RECOMMENDATION: That the Board of Supervisors open the public hearing; introduce by title, Ordinance No. _____ updating the Humboldt County Schedule of Fees and Charges for 2012-13, waive the first reading of the ordinance; receive the staff report and public comments; approve the new, increased, decreased, deleted or changed fees, or modify the new, increased, decreased, deleted or changed fees, as shown in the 2012-13 Humboldt County Schedule of Fees and Charges; adopt the Ordinance; Direct the Clerk of the Board, within 15 days, to publish a pos-adoption summary of the ordinance with the names of the Supervisors voting for and against the ordinance, and to post in the office of the Clerk of the board a certified copy of the full text of the adopted ordinance and amendments along with names of those Supervisors voting for and against the ordinance [Government Code Section 25124(b)(1)]; and close the public hearing.

Planning and Building Department

3.                   Proposed Amendments to the Housing Element to Respond to Comments from the Department of Housing and Community Development (HCD).

RECOMMENDATION: That the Board of Supervisors open the public hearing; receive a staff report; open the public hearing; receive a staff report; open the public comment period and accept public comment; close the public comment period; deliberate on the proposed revisions to the Housing Element; review and consider the proposed addendum to the Final Supplemental Environmental Impact Report (FSEIR) for the Housing Element (SCH# 2009022077); adopt the proposed revisions to the Housing Element by approving Resolution No. ___.


M.                 AFTERNOON DISCUSSION ITEMS

1.                   Williamson Act Monitoring Program and Program Evaluation Committee Formation.

RECOMMENDATION: That the Board of Supervisors receive the staff report; receive public comments and deliberate; review and approve immediate implementation of the Monitoring Program as recommended by the Williamson Act Advisory Committee and appoint a Williamson Act Advisory Evaluation Committee from the committees and organizations, departments and interested individuals listed in Attachment D.
