Auditor-Controller

1.                   Fiscal Year 2012-2013 Appropriation Limits.

RECOMMENDATION: That the Board of Supervisors approve the attached resolution and schedule setting forth the fiscal year 2012-2013 appropriation limits in accordance with Article XIII B of the California Constitution and California Government Code, Title 1, Division 9.

2.                   Resolution Fixing the Tax Rate for Fiscal Year 2012-2013.

RECOMMENDATION: That the Board of Supervisors adopt the accompanying resolution fixing the tax rates for the County of Humboldt, school districts and special districts within the County for fiscal year 2012-2013 pursuant to California Government Code, Title 3, Division 3, Chapter 1, Article 5.

Board of Supervisors

3.                   Resolution Recognizing the New Eureka Veterans Clinic. (Supervisor Virginia Bass & Supervisor Rex Bohn)

RECOMMENDATION: That the Board of Supervisors adopt the Resolution.

4.                   Informational Report on the Appointment of Dawn Dickinson to the Citizens Law Enforcement Liaison Committee. (Supervisor Ryan Sundberg)

RECOMMENDATION: That the Board of Supervisors receive and file the report.

5.                   Resolution for the Honorable Mike Thompson. (Supervisor Virginia Bass & Supervisor Mark Lovelace)

RECOMMENDATION: That the Board Ratify the Resolution.

Clerk of the Board

6.                   Approval of the Board Orders - Monday, September 17, 2012.

RECOMMENDATION: That the Board approve the Board Order and authorize the Clerk of the Board and the Board Chair to sign the minute book in accordance with California Government Code Section 25103.

7.                   Approval of the Board Orders for September 18, 2012.

RECOMMENDATION: That the Board approve the Board Order and authorize the Clerk of the Board and the Board Chair to sign the minute book in accordance with California Government Code Section 25103.

Planning and Building Department

8.                   Clarification of Board of Supervisors Orders for Item L-3 of the August 28, 2012 Meeting.

RECOMMENDATION: That the Board of Supervisors direct the Clerk of the Board to modify the Board Orders of the August 28, 2012 meeting to explicitly reflect Board approval of the minor addition to the Housing Element amendment recommended by staff during the meeting, and to notify interested parties of the modified Board Orders.

9.                   Approve Surplus Storage Space lease Extension Option.

RECOMMENDATION: That the Board of Supervisors: Approve exercising the option to extend the lease at 714 4th Street, Eureka, with Jack L. Retzloff Trust, Cindy Olsen, Trustee, under the same terms and conditions through January 31, 2014; Authorize Real Property to send a notice to Lessor that the County is exercising the option to extend the lease; and Direct the Clerk of the Board to send one executed agenda item to Real Property.

County Counsel

10.               Resolution Amending Resolution No. 10-69 of the Conflict of Interest Code for the County of Humboldt.

RECOMMENDATION: That the Board of Supervisors adopt the Resolution amending Resolution No. 10-69 of the Conflict of Interest Code for the County of Humboldt.

11.               Special Assessments for Unpaid Administrative Penalties: Auburn Sky, LLC, A.P.#109-141-009; and Henry Curlee IV, A.P.#521-123-005; and David Cox and Danny Cox, Trustee, A.P.#205-212-018; and Charles Morse, A.P. #218-091-001.

RECOMMENDATION: That the Board of Supervisors, pursuant to Humboldt County Code section 2131-8 (e), Adopt the attached resolutions declaring a special assessment against each real property for unpaid administration penalties.

District Attorney

12.               Grant Application for Fiscal year (FY) 2012-13 Underserved Victim Advocacy and Outreach Program.

RECOMMENDATION: That the Board of Supervisors:  Authorize the Chair to sign both the Grant Award Face Sheet and the Certification of Assurance of Compliance; and Direct the Clerk of the Board to process and return the executed original copy of the Grant to the District Attorney's Office, attention Kevin Furtado, for submission to the State.

13.               Professional Service Agreement between the County of Humboldt and the Georgia State University Research Foundation for SafeCare Training.

RECOMMENDATION: That the Board of Supervisors:  Approve the Professional Services Agreement between the County of Humboldt and the Georgia State University Research Foundation for Fiscal Year 2012-13 in the amount of $69,853; Direct the Auditor's Office to supplement the budget in Fund 1175, Budget Unit 416 Public Health Nursing as shown on Attachment 2; Authorize the Chair to sign three (3) original agreements; and Direct the Clerk of the Board to return two (2) agreements to the Public Health Branch.

14.               Grant Agreement with California Department of Public Health for the tern of October 1, 2012 through September 30, 2016 for Nutrition Education and Obesity Prevention Program.

RECOMMENDATION: That the Board of Supervisors:  Approve Grant Agreement with California of Public Health for up to $1,422,624 for the term of October 1, 2012 through September 30, 2016; Authorize the Chair to sign two originals (2) of the Agreement, two (2) original of the Lobbying Disclosures (Exhibit D(F)), and one (1) original of the Certification Clauses (CC307); Authorize the Public Health Branch Director to sign any subsequent amendments directly related to the Agreement; and Direct the Clerk of the Board to return all signed originals of the Agreement to the Public Health Branch.

Health and Human Services - Social Services Branch

15.               Approve Agreement with Open Door Community Health Centers to Assist With CalFresh Outreach and Support Activities.

RECOMMENDATION: That the Board of Supervisors:  Approve Agreement with Open Door Community Health Centers to assist the Department of Health and Human Services to increase utilization of CaFresh benefits by eligible households and thereby reduce hunger and improve the health and wellness of children, families and individuals in Humboldt County; and Authorize the Chair to execute three (3) copies of the Agreement; and Direct the Clerk of the Board to route two (2) fully executed copies of the Agreement to the Director, Department of Health and Human Services (DHHS) - Social Services Branch.

Probation

16.               Approval of option to extend Lease Agreement with Elaine Joyce Foote Revocable Trust at 404 H Street, Eureka.

RECOMMENDATION: That the Board of Supervisors:  Approve option to extend the lease with Elaine Joyce Foote Revocable Trust for office space at 404 H Street, in Eureka, for the period beginning December 1, 2012 through November 30, 2015; and Direct the Clerk of the Board to return one copy of the executed agenda item to Public Works-Real Property Division; and Authorize the Public Works-Real Property Division to send a letter to Elaine Joyce Foote Revocable Trust that the County is exercising the option to extend the lease for three (3) additional years.

Public Works

17.               Lease Termination Agreement and Lease Agreement for Operation of the Courthouse Snack Bar.

RECOMMENDATION: That the Board of Supervisors: Approve by 4/5 vote the Lease Termination Agreement of the lease dated July 27, 2010, with Alan Sadler and Jessalynn Kunkler for operation of the Courthouse Snack Bar and authorize the Chairperson of the Board to execute the attached Lease Termination Agreement; and Approve by 4/5 vote and authorize the Chairperson of the Board to execute the attached lease Agreement with Jeanne Flack and Michael Scollard for operation of the Courthouse Snack Bar from October 1, 2012 through September 30, 2013; and Direct the Clerk of the Board to return one each of the original executed Lease Termination Agreement and Lease Agreement to Real Property.

18.               Supplemental Budget for January 9, 2010 Earthquake Damage Project Costs.

RECOMMENDATION: That the Board of Supervisors:  Adopts the following supplemental budget for FY 2012-13:  Revenue: 1100170-506105 Earthquake 2010-CalFema $6,168,091.00  1100170-705501 Capital Projects Trust $2,175,508.00.  Expenditures:  1100170-8967 Earthquake Repair - Courthouse $968,730.00, 11001-8818 Earthquake Repair - Jails $936,348.00, 1100170-8840 Earthquake Repair - Mental Health $244,470.00,  1100170-8865 Earthquake Repair - Juvenile Hall/Regional Facility $921,963.00, 1100170-8823 Earthquake Repair - Eureka Veterans $5,335,388.00, 1100170-9316 Other County Fund - Mental Health $-63,300.00; and Authorize the Public Works Director to sign agreements after review by County Counsel and Human Resources totaling $962,455.00 with the following consultants fort he repair of the Courthouse, Correctional Facility, Mental Health, Juvenile Hall, Regional Facility and the Eureka Veterans Building: 2.1 KPFF Consulting Engineers, 2.2 Matson & Vallerga Architects, Inc., 2.3 GHD, 2.4 Terry Clark Consulting, LLC.  Attachment 1 shows the Project and Agreement Structure.

19.               Acceptance of Department of Health and Human Services (DHHS) Mental Health Branch, Ventilating and Air Conditioning (HVAC) System Repair Project, Project No. 170114.

RECOMMENDATION: That the Board of Supervisors:  Accept the work of O&M Industries as substantially complete for their portion of the Mental Health Branch for the Heating, Ventilating and Air Conditioning (HVAC) System Repair Project; and Authorize the Public Works Director to file the Notice of Completion for O&M Industries' portion of the project as required.

20.               License Agreement with Glenn-Jon Gunther, DBA Redwood Coast Helicopters, LLC, at Rohnerville Airport.

RECOMMENDATION: That the Board of Supervisors by a 4/5 vote:  Approve and authorize the Chairperson to execute the attached License Agreement, in duplicate, with Glenn-Jon Gunter, DBA Redwood Coast Helicopters, LLC; and Direct the Clerk of the board to return one executed original License Agreement to Real Property for transmittal to Licensee.

21.               Construction of Earthquake Repairs on Bell Springs Road (8A010) at PM 4.50 & Island Mountain Road (8A020) at PM 2.50, DSR No; 2922, 2830, Contract No.: 210271, 210258.

RECOMMENDATION: That the Board of Supervisors:  Receive and file the bids for Construction of Earthquake Repairs on Bell Springs Road at PM 4.50 and Island Mountain Road at PM 2.50; Award the contract to Van Meter Logging, Inc. for the total amount of $54,326.74; Authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and Direct the Auditor-Controller to establish a new contract account 1200321-0287 and transfer $57,043.00 to the account per the attached appropriation transfer.

Sheriff

22.               Reallocation of Deputy Sheriff I/II to Sheriff's Sergeant, Disallocation of Sheriff's Sergeant Position and Allocation of Deputy Sheriff I/II Position.

RECOMMENDATION: That the Board of Supervisors:  Reallocate the Deputy Sheriff II (salary range 394, class 0416, position #02 position in budget unit 221, currently occupied by Kerry Ireland, to Sheriff's Sergeant (salary range 423, class 0414), effective the beginning of the bi-weekly pay period following approval; and Disallocate 1.0 FTE vacant Sheriff's Sergeant position #11 in budget unit 221 (salary range 423, class 0414); and Allocate 1.0 PFT Deputy Sheriff I/II position (salary range 379, class 0416) frozen and unfunded, in budget unit 221.

D.                  SPECIAL PRESENTATIONS

1.                   Distinguished Service Award Recognizing Tia Richardson. (Supervisor Virginia Bass)

RECOMMENDATION: That the Board of Supervisors sign the Distinguished Service Award.

2.                   Proclaim October 2012 as United Way Month in Humboldt County. (Supervisor Virginia Bass)

RECOMMENDATION: That the Board adopt the Proclamation.

3.                   Presentation from Peterson Consulting on the County's 2012 State Legislative Program.

RECOMMENDATION: That the Board of Supervisors hear the presentation and take appropriate action, if required.

RECOMMENDATION: That the Board of Supervisors receive an update on activities from the Advisory Committee regarding the Humboldt County Aviation System.

Public Works

1.                   Ordinance Amending Section 421-3 Relating to Stop Sign on Heartwood Drive, 422-7, 422-9 and 422-10 Relating to Speed Limits on Bald Hills Road and Murray Road, 431-52 and 431-53 Relating to Parking on Harrison Avenue and Hatchery Road and by Adding Section 431-7 Relating to Parking on Arbutus Street to title IV of the Humboldt County Code.

RECOMMENDATION: That the Board of Supervisors:  Introduce the attached Ordinance by title and waive the first reading: and Set the Ordinance for adoption on October 2, 2012 or at least one week away; and Direct the Clerk of the Board to publish the pre-adoption summary of the Ordinance and to post a certified copy of the full text of the proposed Ordinance in the office of the Clerk of the Board, both publication and posting to be dome at least five (5) days prior to the Board meeting at which the Ordinance will be adopted [Government Code Section 25124 (b)(1)]; and Direct the Clerk of the Board, within 15 days after adoption of the Ordinance to publish a post-adoption summary of the Ordinance with the names of the Supervisors voting for and against the Ordinance and to post in the Office of the Clerk of the Board a certified coy of the full text of the adopted Ordinance and amendments along with the names of the Supervisors voting for and against the Ordinance [Government Code Section 25124 (b)(1)]; and Direct Public Works to file attached Notice of Exemption with the county Clerk in accordance with the California Environmental Quality Act.

County Administrative Office

2.                   Continuity of Government.                                                               RECOMMENDATION: That the Board of Supervisors:  Receive the presentation on Continuity of Government planning; Direct department heads to identify two representatives within their department to communicate, coordinate, and work with the Continuity of Government (COG) task force in developing their department's Continuity of Operations plan (COOP); and Direct department heads to identify COOP representatives to the County Administrative Office no later than Tuesday, October 9, 2012.

I.                     CLOSED SESSION

1.                   It is the intention of the Board of Supervisors to meet in closed session to consider the Public Employee Performance Evaluation for the position of Director of Health & Human Services pursuant to Government Code Sections 54954.5 and 54957

2.                   It is the intention of the Board of Supervisors to meet in closed session to consider the Public Employee Performance Evaluation for the position of Director of Child Support Services pursuant to Government Code Sections 54954.5 and 54957.

3.                   Conference with Legal Counsel - Threatened, Potential or Anticipated Litigation pursuant to Government Code section 54956.9, subd.(b)(1), and subd.(b)(3) subpar.(C), (1 case); a written threat of litigation by attorney David Weinsoff in a letter to the Public Works Director, dated September 14, 2012.

4.                   Conference with Labor Negotiator - Pursuant to Government Code section 54957.6 it is the intention of the Humboldt County Public Authority for In-Home Supportive Services to meet in closed session to review the Public Authority's position and instruct its designated labor negotiators with respect to various forms of compensation provided to the Public Authority's represented and unrepresented personnel. Negotiators: Rick Haeg and Dan Fulks. Employee Organization: California United Home Care Workers Union, SEIU/AFSCME (CUHW). Adjourn as the Humboldt County Board of Supervisors; Convene as the Governing Board for the Humboldt County Public Authority for  In-Home Supportive Services

RECOMMENDATION: That the Board of Supervisors adjourn and reconvene as the Board of Directors of those special districts governed by the Board of Supervisors:  Open the public hearing; Receive reports from staff; Receive testimony from public; Close the public hearing; Approve and adopt the Fiscal Year 2012-2013 budgets for special districts governed by the board of Supervisors; and Adopt the attached Resolution No. ____ establishing fiscal year 2012-2013 budgets for special districts governed by the Board of Supervisors.
