B.                  MODIFICATIONS TO THE AGENDA

1.                   Cooperative Agreement between the Department of Homeland Security (DHS) Transportation Security Administration (TSA) and the Humboldt County Division of Aviation for Law Enforcement Services at the Arcata-Eureka Airport. (CONSENT)

RECOMMENDATION: That the Board of Supervisors grant a waiver of the provisions of the Humboldt Nuclear Free Ordinance and authorize the Director of Public Works to sign Cooperative Agreement Number HSTS02-12-R-SLR349 RA and all subsequent modifications to the agreement upon approval of County Counsel, Risk Manager and the Sheriff.

1.                   Payroll Clearing Transfer for Fiscal Year 2011-12.

RECOMMENDATION: That the Board of Supervisors approve the attached fiscal year 2011-12 appropriation transfer for $1,075,043 (4/5 vote required); authorize the Auditor-Controller to make minor budget adjustments as needed to provide sufficient appropriations to cover actual expenditures for fiscal year 2011-12.

2.                   Certificate of Recognition for Mike Howe, Unit Chief, Humboldt-Del Norte Unit, CAL FIRE on his Retirement. (Supervisor Clif Clendenen)

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the Certificate of Recognition.

3.                   Informational Report Regarding the Appointment of Glenn Ziemer to the Greater Eureka Area Municipal Advisory Committee (GEAMAC).

RECOMMENDATION: That the Board of Supervisors receive and file the report.

4.                   Informational Report on the Appointment of Jannez (Nezzie) Wade to the Human Rights Commission. (Supervisor Virginia Bass)

RECOMMENDATION: That the Board of Supervisors receive and file the report.

5.                   Letter of Appreciation to Eric Wedge for his service on the Behavioral Health Board. (Supervisor Virginia Bass)

RECOMMENDATION: That the Board authorize the Chair to sign the letter of appreciation.

6.                   Appointment of Carolyn Green to the Humboldt County Status of Women Commission to Fill the District 2 vacancy. (Supervisor Clif Clendenen)

RECOMMENDATION: That the Board of Supervisor receive and file the appointment of Carolyn Green to the Humboldt County Status of Women Commission to fill the District 2 vacancy.

7.                   Approval of Board Orders - Meeting of October 2, 2012.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from October 2, 2012 and authorize the Clerk of the Board and the Board Chair to sign the Minute book in accordance with California Government Code Section 25103.

Human Resources

8.                   County Administrative Officer Employment Agreement.

RECOMMENDATION: That the Board of Supervisors approve the attached Employment Agreement which memorializes the appointment of Phillip Smith-Hanes as County Administrative Officer effective December 22, 2012 and sets out the employment terms between the County and County Administrative Officer Phillip Smith-Hanes; and authorize the Chairman of the Board of Supervisors to execute the Employment Agreement.

 

 

 

 

Public Works

9.                   Janes Creek Flood Control District.

RECOMMENDATION: That the Board of Supervisors authorize expenditures of up to $170,000 to complete the final phase of the McDaniel Slough/Janes Creek flood control and habitat enhancement project.

Sheriff

10.               Authorize the Sheriff to Sign Documents to Submit a Non-Competitive Application for the Anti-Drug Abuse (ADA) Enforcement Team Program.

RECOMMENDATION: That the Board of Supervisors authorize the Sheriff to sign the Applicant Agreement and other grant documents as Authorized Agent.

D.                  SPECIAL PRESENTATIONS

1.                   Humboldt Bay Municipal Water District (HBMWD) Water Resource Planning Presentation. (Supervisor Mark Lovelace)

RECOMMENDATION: That the Board of Supervisors hear the presentation and take appropriate action, if required.

2.                   Binational Health Weeks in Humboldt County. (Supervisor Clif Clendenen)

RECOMMENDATION: That the Board adopt the Proclamation.

3.                   Proclaim October 7th-13th, 2012 as National 4-H Week in Humboldt County (Supervisor Rex Bohn)

RECOMMENDATION: That the Board adopt the Proclamation.

E.                  MATTERS SET FOR TIME CERTAIN

Public Works - 9:30 AM

1.                   Humboldt Bay Sea Level Rise Vulnerability Assessment and Adaptation Strategy.

RECOMMENDATION: That the Board of Supervisors receive a presentation from Aldaron Laird on the results of an initial assessment of the vulnerability of the Humboldt Bay shoreline to sea lever rise; and authorize the Chair of the Board to sign the attached letter of support to the State Coastal Conservancy to provide funding for adaptation planning and technical studies associated with the potential impacts of sea level rise on the Humboldt Bay region.

2.                   Welcome to Minister Dasho Sangay who is a Member of the Bhutanese Parliament from Thimphu, Bhutan. (Supervisor Mark Lovelace)

RECOMMENDATION: That the Board of Supervisors welcomes Dasho Sangay to the Board Meeting and hears his presentation on the purpose and goals for his trip to the United States.

Planning and Building

1.                   Cottrell Ranch Zone Reclassification File No. APNs: 207-063-003 et seq.; Case No.: ZR-11-08 Bridgeville Area.

RECOMMENDATION: That the Board of Supervisors open the public hearing; introduce Ordinance NO. ____ by title and waive further reading; receive the staff report and public testimony; based on the testimony received, adopt the Planning Commission's findings approving the proposed Zone Reclassification and adopt Ordinance No. ____ amending Section 311-7 of the Humboldt County Code by reclassifying property in the Bridgeville area from Agriculture Exclusive (AE) and unclassified  (U) to Timberland Production Zone (TPZ) and U to AE; direct the Clerk of the Board to record a Certification of Rezoning (Notice of Timberland Production Zone Status ) (Attachment C) on the parcels pursuant to Sections 51117 and 51141 of the California Government Code (C.G.C.), after attaching a copy of the fully executed Ordinance and Map (Attachment B, Exhibit A); Direct the Clerk of the Board to give notice of the decision to the applicant/owner, the County Assessor's Office and any other interested party, and to publish the Post-Adoption Summary of the Ordinance within 15 days after adoption by the Board and direct Planning and Building Department - Planning Division to file a Notice of Exemption pursuant to California Environmental Quality Act (CEQA); direct the Clerk of the Board to publish a summary of the Ordinance within 15 days after adoption of the ordinance and to post in the Office of the Clerk of the Board of Supervisors a certified copy of the full text of the adopted ordinance; direct the Clerk of the Board to record in the minutes of the Board meeting that the ordinance has been duly published and posted and to give notice of the decision to the applicant, the County Assessor's Office and any other interested party; and close the public hearing.
