Agricultural Commissioner

1.                   Approval of Standard Agreement No. 12-0075, High-Risk Pest Exclusion Contract in the Amount of $5,470.75

RECOMMENDATION: That the Board of Supervisors:  Approve Standard Agreement No. 12-0075, known as the High-Risk Pest Exclusion Program Contract with the California Department of Food and Agriculture; Authorize the Chair to sign the original agreement, one copy of the cover page and the Contractor Certification Form, and direct the Clerk of the board to return all copies to the Agricultural Department for further processing; and Grant a waiver from the provisions of the Nuclear-Free Ordinance.

 

 

Auditor-Controller

2.                   Resolution Ratifying the Previous Establishment and Use of Cash Difference/Overage Fund - 3018 and Authorizing the Continued use Thereof Pursuant to Government Code Sections 29370 et seq. and Revenue and Taxation Code Section 2611.5.

RECOMMENDATION: That the Board of Supervisors adopt the accompanying resolution ratifying the previous establishment and use of Cash Difference/Overage Fund - 3018 and authorizing the continued use thereof pursuant to Government Code Section 29370 et seq. and Revenue and Taxation Code Section 26111.5; and Direct the Clerk of the Board to transmit certified signed copies of the accompanying resolution to both the Auditor-Controller and Treasure-Tax Collector.

3.                   Board Orders - Meeting of November 6, 2012.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from November 6, 2012 and authorize the Clerk of the Board and the Board Chair to sign the Minute Book in accordance with the California Government Code Section 25103.

County Administrative Office

4.                   Suddenlink Cable System Transfer Agreement.

RECOMMENDATION: That the Board of Supervisors:  Adopt Resolution No. ___(Attachment 1) consenting to the transfer of control of the cable television franchise in connection with the acquisition by Nespresso Acquisition Corporation of the equity interests of Cequel Communications Holding, LLC; and Authorize the County Administrative Officer to sign the attached Transfer Agreement (Attachment 2) on behalf of the County.

5.                   Memorandum of Understanding with Trinity County for Agricultural Commissioner/Sealer Services.

RECOMMENDATION: That the Board of Supervisors approve the attached agreement with the county of Trinity for Agricultural Commissioner/Sealer services and authorize the County Administrative Officer to sign.

Health and Human Services - Mental Health Branch

6.                   Recommendation to the State Department of Alcohol and Drug Programs for Fortuna Community Services Humboldt Alcohol Recovery Treatment (HART) Program to Provide a 30-Month Driving Under the Influence (DUI) Program in Humboldt County.

RECOMMENDATION: That the Board of Supervisors: Approve the request to submit an application for licensure to the Department of Alcohol and Drug Programs by Fortuna Community Services Humboldt Alcohol Recovery Treatment (HART) Program to provide a 30-month driving under the influence (DUI) program in Humboldt County; and Authorize the County Alcohol and Drug Administrator to notify State Department of Alcohol and Drug Programs in writing of the need for expanded DUI services in Humboldt County, and assurance of fiscal and programmatic integrity of the applicant.

7.                   Appointments to the Humboldt County Behavioral Health Board.

RECOMMENDATION: That the Board of Supervisors appoint Tim Doty and Jana Kirk-Levine to the Humboldt County Behavioral Health Board.

 

 

 

 

 

 

 

Health and Human Services - Public Health Branch

8.                   State Agreement #HM-HMP-0324-12-00 with the Governor's Office of Emergency Services for updating the Humboldt County Hazardous Materials Area Plan of 2008 and Supplemental Budget (4/5 vote required).

RECOMMENDATION: That the Board of Supervisors: Approve the State Agreement #HM-HMP-0324-12-00 between the Governor's Office of Emergency Services and the County of Humboldt for funds to update the Humboldt County Hazardous Materials Area Plan for the term beginning October 1, 2012 through September 30, 2013 in the amount of $20,828;  Direct the Auditor Controller to supplement the budget in Fund 1175, Budget Unit 411, Hazardous Materials Program as outlined on Attachment 2 (4/5 vote required);  Authorize the Director of Public Health to sign two (2) originals of the Grant Award Face Sheet and initial two (2) originals of the HMEP Grant Special Conditions Sheet;  Authorize the Director of Public Health to sign any subsequent amendments directly related to the Agreement; and Direct the Clerk of the Board to return the approved Agreement to Public Health Administration for execution.

9.                   Special Circumstance Fee waiver by the Department of Health and Human Services, Division of Environmental Health, Consumer Protection Program for Temporary Food Facility permits and Temporary Food Facility Coordinator permit for non-profit food sales hosted by McKinleyville Ace Home and Garden Center.

RECOMMENDATION: That the Board of Supervisors: Approve a special circumstances waiver of Consumer Protection (CO) Program Temporary Food Facility (TFF) permit fees for non-profit organizations operating at McKinleyville Ace Home and Garden Center; and Waive the Temporary Food Facility Coordinator (TFFC) permit fee for non-profit, fund raising events at McKinleyville Ave Home and Garden Center.

10.               Division of Environmental Health's letter of support of legal public sewer connection for 2212 Jacoby Creek Rd., Bayside, Ca APN: 501-011-066.

RECOMMENDATION: That the Board of Supervisors approve the letter from the Department of Health and Human Services, Public Health branch, Division of Environmental Health (DEH) tot he City of Arcata recommending an emergency sewer hookup for the parcel located at 2212 Jacoby Creek Rd., Bayside, Ca.

Health and Human Services - Social Services Branch

11.               Approval of California Child and Family Services Review, System Improvement Plan for Humboldt Children & Family Services and Humboldt County Probation Department.

RECOMMENDATION: That the Board of Supervisors:  Adopt Resolution No. ___ (Attachment 1) authorizing approval of the System Improvement Plan, recognizing the Child Abuse Prevention Coordination Council (CAPCC), and identifying the CAPCC to administer the County Children's Trust Fund (CCTF); and Approve the five-year California Child and Family Services Review, System Improvement Plan (2012 to 2017) for Humboldt Children & Family Services and Humboldt County Probation Department (Attachment 2); and Authorize the Chair to sign four (4) copies of the System Improvement Plan signature pages (Attachment 3) and one copy of the Notice of Intent (Attachment 4) as requested by the state; and Direct the Clerk of the Board to return one original of the signed Resolution, three (3) signed copies of the System Improvement Plan signatory pages, one signed Notice of Intent and one executed agenda item to the Department of Health and Human Services.

Library Services

12.               Temporary Closure of the Ferndale Branch Library for Facility Improvements.

RECOMMENDATION: That the Board of Supervisors approve the temporary closure of the Ferndale Branch Library on Tuesday, November 20, Wednesday, November 21, and Saturday, November 24 to accommodate re-carpeting of this city owned facility.

Human Resources

13.               Dissolution of the Current Eligibility List for Senior Public Health Nurse.

RECOMMENDATION: That the Board of Supervisors approve the dissolution of the current eligibility list for Senior Public Health Nurse, effective upon the establishment of a new eligibility list.

Public Works

14.               Construction of Bald Hills Road (F4R300) Paving at PM 10.1 to 13.4 Project No.: J5252407 BIA IRR, Contract No.: 321601.

RECOMMENDATION: That the Board of Supervisors:  Accept the completed contract, including all change orders approved by the Public Works Department between Mercer-Fraser Company and Humboldt County for the construction paving on Bald Hills Road; and Approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $13,545.47.  This will bring the total amount paid to 100% of the contract.

15.               Contract for Design Engineering and Project Development for Red Cap Road Bridge (04C00117) Over Big Rock Gulch.

RECOMMENDATION: That the Board of Supervisors execute the contract for design and project development services to develop plans and specifications for construction of a new bridge over Big Rock Gulch on Red Cap Road near the town of Orleans.

D.                  SPECIAL PRESENTATIONS

1.                   Certificate of Recognition for Charles Douglas of Access Humboldt. (Supervisor Virginia Bass)

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the Certificate of Appreciation for Charles Douglas.

1.                   Presentation of the Headwaters Fund 2011-12 Annual Report.

RECOMMENDATION: That the Board of Supervisors receive and accept the Headwaters Fund (HWF) Annual Report.

County Administrative Office - 10:00 a.m.

2.                   Presentation of the Decade of Difference Annual Report.

RECOMMENDATION: That the Board of Supervisors receive a presentation on the Decade of Difference Annual Report.

1.                   Merger of County Indigent Defense Offices.

RECOMMENDATION: That the Board of Supervisors:  Transfer the existing Office of Conflict Counsel and re-establish the Office of Alternate Counsel both under the administrative direction of the Public Defender; and Reallocate the unoccupied department head level position of Conflict Counsel (class 0845, salary $10,901 monthly) in budget unit 246 to a 1.0 full time equivalent (FTE) Supervising Attorney (class 0610, salary range 532) position in budget unit 246; and Reallocate the 0.9 FTE  Investigator (class 0449, salary range 400, position 01) in budget unit 246, currently occupied by Francisco Lassiter, to a 1.0 FTE (class 0449, salary range 400) in budget unit 246; and Allocate a 0.5 FTE Supervising Attorney (class 0610, salary range 532) position in budget unit 253; and Reallocate the 1.0 FTE Deputy Public Defender I/II/III/IV (class 0604, salary range 404/439/470/503, position 08) in budget unit 219, currently occupied by Lawrence Truitt, to 1.0 FTE Deputy Public Defender I/II/III/IV (class 0604, salary range 404/439/470/503) in budget unit 253; and Reallocate the 1.0 FTE Deputy Public Defender I/II/III/IV (class 0604, salary range 404/439/470/503, position 03) in budget 246, currently occupied by Leslie Keig, to 1.0 FTE Deputy Public Defender I/II/III/IV (class 0604, salary range 404/439/470/503) in budget unit 253; and Reallocate the 1.0 FTE Senior Legal Secretary (class 1140, salary range 339, position 01) in budget unit 246, currently occupied by FL Klay, to 1.0 FTE Senior Legal Secretary (class 1140, salary range 339) in budget unit 253; and Reallocate the 1.0 FTE Supervising Attorney (class 0610, salary range 532) in budget unit 246, under filled as a Deputy Public Defender I/II/III/IV by David Lee, to a 1.0 FTE Deputy Public Defender  I/II/III/IV (class 0604, salary range 404/430/470/503) in budget unit 246; and In accordance with Assembly Bill AB 340, Pension Reform Act of 2013, Section 7522.56, approve the Extra-Help appointment of Glenn Brown to the 0.5 Supervising Attorney position in budget unit 253; and Approve the attached budget transfer moving funds from the Public Defender (219) and Conflict Counsel (246) budget units to the new Alternate Counsel budget unit (253) (4/5 vote required);  effective January 1, 2013.

I.                     CLOSED SESSION

1.                   Conference with Labor Negotiator - Pursuant to Government Code section 54957.6 it is the intention of the Humboldt County Public Authority for In-Home Supportive Services to meet in closed session to review the Public Authority's position and instruct its designated labor negotiators with respect to various forms of compensation provided to the Public Authority's represented and unrepresented personnel. Negotiators: Rick Haeg and Dan Fulks. Employee Organization: California United Home Care Workers Union, SEIU/AFSCME (CUHW). Adjourn as the Humboldt County Board of Supervisors; Convene as the Governing Board for the Humboldt County Public Authority for  In-Home Supportive Services

RECOMMENDATION: That the Board of Supervisors review, consider and approve proposed revisions to specific sections of the Klamath Basin Restoration Agreement (KBRA).

M.                 ADMINISTRATIVE ABATEMENT HEARINGS

Code Enforcement Unit

1.                   The Estate of Leonna Stevens and the Estate of Ted Stevens.  111 Old Wagon Road, Trinidad, California.  AP#514-051-011.

RECOMMENDATION: That the Board of Supervisors, pursuant to Humboldt County Code sections 351-21 and 351-22; hold an administrative hearing to determine whether a public nuisance exists on the subject property; and adopt the attached Findings of Nuisance and Order of Abatement consistent with the evidence presented at the hearing.
