1.                   Certification of the Results of the November 6, 2012, Presidential General Election.

RECOMMENDATION: That the Board of Supervisors accepts the Certified Statement of Results of the Official Canvass for the November 6, 2012, Election.

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Board of Supervisors

1.                   Veterans Appreciation Resolution. (Supervisor Mark Lovelace)

RECOMMENDATION: That the Board of Supervisors ratify authorization for the Chair to sign the Resolution.

2.                   Informational Report on the Reappointment of Keith Taylor to the Human Rights Commission. (Supervisor Mark Lovelace)

RECOMMENDATION: That the Board of Supervisors receive and file the report.

3.                   Informational Report on the Reappointment of John Shelter to the Human Rights Commission. (Supervisor Ryan Sundberg)

RECOMMENDATION: That the Board of Supervisors receive and file the report.

4.                   Informational Report on the Appointment of Pete Ciarabellini to the Citizens Law Enforcement Liaison Committee. (Supervisor Virginia Bass)

RECOMMENDATION: That the Board of Supervisors receive and file the report.

5.                   Letter of Appreciation to Kathy McGrath for her service on the Forestry Review Committee. (Supervisor Ryan Sundberg)

RECOMMENDATION: That the Board authorize the Chair to sign the letter of Appreciation.

6.                   Letter of Appreciation to Cheryl Seidner for her service on the Human Rights Commission. (Supervisor Virginia Bass)

RECOMMENDATION: That the Board authorize the Chair to sign the letter of Appreciation.

Clerk of the Board

7.                   Local Appointments List for 2013.

RECOMMENDATION: Receive said list.  Direct the Clerk of the Board to send a copy of said list to the Humboldt County Library, Eureka Main Branch, as pursuant to Government Code Section 54973, the Board hereby designates the Humboldt County Library, Eureka Main Branch, as the public library required to receive a copy of such list.

8.                   Board Orders - Meeting of November 13, 2012.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from November 13, 2012 and authorize the Clerk of the Board and the Board Chair to sign the Minute Book in accordance with the California Government Code Section 25103.

9.                   Board Orders - Meeting of October 26, 2012.

RECOMMENDATION: That the Board of Supervisors approve the Board Order from October 26, 2012 and authorize the Clerk of the Board and the Board Chair to sign the Minute Book in accordance with the California Government Code Section 25103.

10.               Board Orders - Meeting of November 8, 2012.

RECOMMENDATION: That the Board of Supervisors approve the Board Order from November 8, 2012 and authorize the Clerk of the Board and the Board Chair to sign the Minute Book in accordance with the California Government Code Section 25103.

Planning and Building

11.               Houldsworth Lot Line Adjustment and Joint Timber Management Plan Application.  File no.: APN 316-320-12 et all.  Case No.: LLA-12-23/ JTMP-11-05.

RECOMMENDATION: That the Board of Supervisors (by 4/5 vote: Approve the Lot Line Adjustment as conditioned, to result in two parcels of 59 and 299 cares, and approve the division of assessor parcels zoned Timberland Production Zone (TPZ) for which a Declaration of Covenants, Conditions and Restrictions (Declaration) (Attachment A) has been executed and for which a Joint Timber Management Plan (JTMP) and Guide (Attachment B) have been prepared pursuant to Section 5119.5 of the California Government Code (C.G.C) (Note: a 4/5th vote is required); Direct the Planning Division staff to record the Declaration with the JTMP; and Direct the Clerk of the Board to give notice of the decision to owners, the County Assessor's Office and any other interested party.

 

 

Health and Human Services - Public Health Branch

12.               State Standard Agreement with California Department of Parks and Recreation for water testing by the Public Health Laboratory or the period of January 1, 2013 through March 31.

RECOMMENDATION: That the Board of Supervisors:  Approve State Standard Agreement C1237018 with the California Department of Parks and Recreation for water testing by the Public Health Laboratory for the North Coast Redwoods District for up to $4,750.00 for the period of January 1, 2013 through March 31, 2014;  Authorize the chair to sign three (3) originals of the Agreement and one (1) Contractor Certification Clauses (CCC-307); and Direct the Clerk of the Board to return all signed originals and Contractor Certification Clauses to Public Health.

13.               Interagency Agreement between the County of Humboldt, Department of Health and Human Services - Public Health, and the Humboldt County Office of Education for the California Children's Services Medical Therapy Program.

RECOMMENDATION: That the Board of Supervisors: Approve the Interagency Agreement between the County of Humboldt, Department of Health and Human Services - Public Health and the Humboldt County Office of Education for the California Children's Services Medical Therapy Program;  Authorize the Chair of the Board to sign three (3) originals of the proposed Agreement; and Direct the Clerk of the Board to return two (2) signed originals of the proposed Agreement to Public Health.

Public Works

14.               Construction of 17-T-Hangars at the Arcata/Eureka Airport (ACV).

RECOMMENDATION: That the Board of Supervisors authorize the Director of Public Works to send the attached letter requesting a deposit for proposed hangar construction to prospective tenants.

15.               Request to use County Equipment in the Annual Trucker's Parade.

RECOMMENDATION: That the Board of Supervisors authorize the use of County Road trucks and heavy equipment in the annual Trucker's Parade.

16.               Extension of Extra-Help Hours for Roads Maintenance (325).

RECOMMENDATION: That the Board of Supervisors extend Jeremy Jones, Timothy Hunt, John Stillwell, Andrew Weller, Glen Gradin, and Erin Cearley extra help employees hours 1000 hours to a maximum of 1960 hours for fiscal year 2012-13 pursuant to Section 7 of the Humboldt County Salary Resolution (4/5 vote required).

17.               Redway Pedestrian Safety Improvements Project.  Project No.: RPSTLPLE 5904 (114), Contract No.: 210050.

RECOMMENDATION: That the Board of Supervisors:  Approve the plans and specifications; and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with Bids to be opened on Tuesday, January 8, 2013 at 2:00pm.

Sheriff

18.               Supplemental Budget in Sheriff's Homeland Security Budget 1100 213 for Expenditure of Funding From the Federal Fiscal Year (FFY) 2012 Governor's Office of Homeland Security Grant.

RECOMMENDATION: That the Board of Supervisors approve supplemental budget in the amount of $173,718 to purchase approved expenditures under the US Department of Homeland Security grant through the Governor's Office of Emergency Management, Homeland Security (Attachment 1).

 

 

19.               Approve Purchase of Loader, Establish Fixed Asset Account and Supplemental Budget in Sheriff's Budget 1100 243.

RECOMMENDATION: That the Board of Supervisors:  Approve the purchase of a Skid Steer Loader for use at the Sheriff's Work Alternative Program (SWAP) wood yard and farm; Authorize the Auditor/Controller to establish fixed asset amount 1100-243-8-762, Loader in the amount of $25,000; and Approve the attached supplemental budget in Sheriff's budget 1100 243 in the amount of $25,000.

20.               County Flood Contingency Plan.

RECOMMENDATION: That the Board of Supervisors approve the County of Humboldt Flood Contingency Plan, prepared by the Sheriff's Office of Emergency Services as directed by the Humboldt County Disaster Council.

21.               Request for Waiver of 960 Hour Limit for Extra Help Legal Office Assistant Michaela Rice (Budget Unit 1100221) Pursuant to Section 7 of the Humboldt County Salary Resolution (4/5 Vote Required).

RECOMMENDATION: That the Board of Supervisors approve an increase in extra help hours for Legal Office Assistant Michaela Rice from 960 hours to 1920 hours, pursuant to Section 7 of the Humboldt County Salary Resolution (4/5 vote required).

1.                   Resolution Recognizing Sheriff's Investigator Steve Quenell on his Retirement.

RECOMMENDATION: That the Board of Supervisors adopt the resolution.

County Administrative Office

1.                   Board Meetings - Calendar Year 2013

RECOMMENDATION: That the Board of Supervisors cancel Board Meetings on the following dates in Calendar Year 2013 and direct the Clerk of the Board to notify all County departments of these cancelled meetings: Tuesday, January 1, 2013 (New Year's Day holiday), Tuesday, January 29, 2013 (5th Tuesday), Tuesday, February 12, 2013 (Lincoln's Birthday holiday), Tuesday, April 30, 2013 (5th Tuesday), Tuesday, July 30, 2013 (5th Tuesday/Summer Break), Tuesday, August 6, 2013 (Summer break), Tuesday, October 29, 2013 (5th Tuesday), Tuesday, November 19, 2013 (CSAC Conference), Tuesday, November 26, 2013 (Thanksgiving break), Tuesday, December 24, 2013 (Christmas break) and Tuesday, December 31, 2013 (5th Tuesday/Christmas break).

2.                   Adoption of 2013 State and Federal Legislative Platforms.

RECOMMENDATION: That the Board of Supervisors:  Provide input and direction to staff as desired regarding the proposed State and Federal legislative platforms for 2013; Provide input and direction to staff as desired on six federal policy issues to receive priority federal advocacy services; Adopt the proposed State and federal legislative platforms, incorporating any changes desired by the Board, as the final platform for 2013; Direct the County Administrative Officer to submit the final version of the State legislative platform to Governor Jerry Brown, Assembly Member Wesley Chesbro, State Senator Noreen Evans, California State Association of Counties and Peterson Consulting; Direct the County Administrative Officer to submit the final version of the federal legislative platform to U.S. Representative Jared Huffman, U.S. Senators Dianne Feinstein and Barbara Boxer, National Association of Counties, and Waterman & Associates; and Authorize and direct the County Administrative Officer to submit letters to State and federal representatives as needed to support the County's legislative platform during 2013.

RECOMMENDATION:

County Counsel

1.                   Adopt Interim Ordinance for a Second Extension of the Temporary Moratorium on the Establishment of Any Medical Marijuana Collective, Cooperative or Dispensary, Including the Processing of Existing Applications and the Acceptance of New Applications for Such Facilities, Within the Unincorporated Area of Humboldt.

RECOMMENDATION: That the Board of Supervisors:  Introduce the proposed ordinance by title and waive further reading; Receive and file the Report on Measures Taken to Alleviate the Conditions that led to the Adoption of the Interim Ordinance Prohibiting the Establishment of any Medical Marijuana Collective, Cooperative, or Dispensary within the Unincorporated Area of Humboldt County (Exhibit A); Adopt by at least a 4/5ths vote Interim Ordinance No. ____  (Exhibit B), for a Second Extension of the Temporary Moratorium on the Establishment of Any Medical Marijuana Collective, Cooperative or Dispensary, Including the Processing of Existing Applications and the Acceptance of New Applications for Such Facilities, Within the Unincorporated Area of Humboldt County; and Direct the Clerk of the Board to publish the full text of the ordinance in a newspaper of general circulation within fifteen (15) days after passage, and to enter in the minutes of the proceeding that the ordinance has been duly published.

Treasurer - Tax Collector

2.                   Public Hearing to Consider Adoption of an Ordinance to Amend the 2012-13  Humboldt County Schedule of Fees and Charges to Incorporate Revised Fees for Business Licenses Pursuant to Senate Bill 1186.

RECOMMENDATION: That the Board of Supervisors:  Open the Public Hearing; Introduce by title, Ordinance No. ____ (Attachment 1), updating the Humboldt County Schedule of Fees and Charges for 2012-13, waive the first reading of the ordinance; Receive the staff report and public comments; Approve the new fee, as shown in Attachment II; Adopt the Ordinance; Direct the Clerk of the Board, within 15 days, to publish a post-adoption summary of the ordinance (Attachment I) with the names of the Supervisors voting for and against the ordinance, and to post in the office of the Clerk of the Board a certified copy of the full text of the adopted ordinance and amendments along with the names of those Supervisors voting for and against the ordinance [Government Code Section 25124 (b)(1)]; and Close the Public Hearing.

1.                   County Administrative Officer Report : Conference Attendance and Various Other Topics.

RECOMMENDATION: That the Board of Supervisors receive an oral report from the County Administrative Officer on his recent conference attendance, and various other topics, and take action as may be required.

2.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.
