Board of Supervisors

1.                   Certificate of Achievement for Marshall Rousseau for Achieving the Rank of Eagle Scout. (Supervisor Rex Bohn)

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the Certificate of Achievement.

2.                   Informational Report on the Appointment of Charles Bean to the Human Right's Commission. (Supervisor Virginia Bass)

RECOMMENDATION: That the Board of Supervisors receive and file the report.

Clerk of the Board

3.                   Board Order dated December 11, 2012.

RECOMMENDATION: That the Board of Supervisors approve the Board Order from December 11, 2012 and authorize the Clerk of the Board and the Board Chair to sign the Minute Book in accordance with the California Government Code Section 25103.

4.                   Appointment of Brian Ward to the Humboldt County Area 1 Developmental Disability Board.

RECOMMENDATION: That the Board of Supervisors appoint Brian Ward to the Humboldt County Area 1 Developmental Disability Board to fill the open seat with a term expiring December 18, 2015.

Planning and Building

5.                   Cancellation of Agriculture Preserve Contract No.: 88-15.  File No.: APN No.: 100-091-08; 100-111-01; 100-111-08.   Case No.: AGP-11-12N.

RECOMMENDATION: That the Board of Supervisors:  review the request for Final Cancellation submitted by the state Wildlife Conservation Board in accordance with Section 51293.4(b) of the California Government Code (Attachment C);  determine that the conditions for the cancellation of Agricultural Preserve Contract No. 88-15 have been met and adopt Resolution No. ____ (Attachment A) approving final cancellation;  Direct the Clerk of the Board to record the Certificate of Cancellation (Attachment B); and Direct the Clerk of the Board to give notice of the Board's action to the State Wildlife Conservation board, the Assessor's Office, County Counsel, the Planning Department, the Director of the California Office of land Conservation and any other interested party.

6.                   Metz Lot Line Adjustment and Joint Timber Management Plan Application.  File No.: APN215-191-40 et al.  Case No.: LLA_12-018: JTMP-12-11 Whitethorn Area.

RECOMMENDATION: That the Board of Supervisors 9by 4/5 vote0; Approve the Lot Line Adjustment, as conditioned, to result in two parcels of 42 and 275 acres, and approve the division of assessor parcels zoned Timberland Production Zone (TPZ) for which a Declaration of Covenants, Conditions and Restrictions (Declaration) (Attachment A) has been executed and for which a Joint Timber Management Plan (JTMP) and Guide (Attachment B) have been prepared pursuant to Section 51119.5 of the California Government Code (C.G.C.) (Note 4/5th vote is required); Direct the Planning Division staff to record the Declaration with the JTMP; and Direct the Clerk of the Board to give notice of the decision to owners, the County Assessor's Office and any other interested party.

County Counsel

7.                   Cost Recovery Assessment Hearing.  Ronnie Verilhac and Maxine Pelroy.  171 Orick Hill Road, Orick, California, AP#519-252-019.

RECOMMENDATION: That the Board of Supervisors, pursuant to Humboldt County Code section 351-33 through 351-44:  Confirm the Finding and Orders Confirming Account and Assessment in the sum of nine thousand one hundred eighty-five dollars and sixty-two cents ($9,185.62);  Authorize the Chair of the Board to sign the Findings and Order Confirming the Account and Assessment; Direct the Auditor, upon receipt of the monies assessed, to deposit the money used for the administrative abatement, consisting of six thousand two hundred seventy eight dollars ($6,278), back into the Code Enforcement Trust Fund account number 3440000; Direct the Auditor upon receipt of the monies assessed, to deposit two thousand nine hundred four dollars and sixty-two cents (#2,904.62) into County Counsel Office revenue account number 1100-121-603-040 to recoup Code Enforcement staff time, mileage and office expenses incurred enforcing the Humboldt County code in this matter; and Direct the Auditor, upon receipt of the monies assessed, to deposit three dollars ($3.00) into the Recorder's account number 3661-000-808-000, for copying of property deed,


District Attorney

8.                   Grant Application for Fiscal Year (FY) 2012-13 Automobile Insurance Fraud Program.

RECOMMENDATION: That the Board of Supervisors accept the Grant Award for FY 2012-13 Automobile Insurance Fund Program; adopt the attached Resolution accepting the grant award from the State of California; and direct the Clerk of the Board to process and return the Resolution to the District Attorney's Office, attention Kevin Furtado, for further processing.

9.                   Grant Acceptance for Fiscal Year 2012-13 Worker's Compensation Insurance Fraud Program.

RECOMMENDATION: That the Board of Supervisors accept the Grant Award from the Workers' Compensation Insurance Fund Program FY 2012-13; adopt the attached Resolution accepting the grant award from the State of California; and direct the Clerk of the Board to process and return the Resolution to the District Attorney's Office, attention Kevin Furtado, for further processing.

10.               Extension of Extra-Help Hours Past the 960 Hour Limit for Office Support Staff Personnel in Budget Unit 205.

RECOMMENDATION: That the Board of Supervisors approves the extension of extra help hours for; Kevin Furtado, Administrative Analyst I, to 1920 hours through June 30, 2013; Michael McDonald, Paralegal to 1920 hours through June 30, 2013; and Jessie Kelmal, Office Assistant I to 1920 hours through June 30, 2013.

Health and Human Services - Administration

11.               Extension of Extra Help Hours Past the 960 Hour Limit.

Health and Human Services - Mental Health Branch

12.               Agreement between Humboldt County and Mental Health Management 1, Inc., Canyon Manor for August 15, 2012 through June 30, 2013.

RECOMMENDATION: That the Board of Supervisors:  Approve the Agreement between Humboldt County and Mental Health Management 1, Inc., Canyon Manor; and Authorize the Chair to execute three (3) copies of the Agreement effective August 15, 2012; and Direct the Clerk of the Board to return two (2) executed copies of the Agreement to the Department of Health and Human Services, Mental Health Administration.

13.               Reappointment to the Humboldt County Behavioral Health Board.

RECOMMENDATION: That the Board of Supervisors reappoint Tim Ash and Eric Thompson to the Humboldt County Behavioral Health Board for three year terms.

14.               Department of Health and Human Services, Children and Family Services Division - Substance Abuse and Mental Health Services Administration grant for Children's System of Care Expansion Implementation Grant.

RECOMMENDATION: That the Board of Supervisors:  Accept the award in the amount of $4,000,000 over four (4) years granted by the Substance Abuse and Mental Health Services Administration (SAMHSA) for Children's System of Care Expansion Implementation; and Adopt the supplemental budget as attached in Exhibit B for fiscal year 2012-13 for Department of Health and Human Services (DHHS) - Mental Health budget units 1170-424 and 1170-497, (4/5 vote required); Disallocate the following vacant positions; 1.0 FTE Fiscal Assistant I/II (class 0177A/B, position #05, salary range 279/305); 1.0 FTE Senior Mental Health Clinician (class 0917, position #01, salary range 443); 1.0 FTE Activity Therapist (class 0939, position #04, salary range 343); 2.0 FTE Vocational Counselor I/II (class #0768A/B, position #01 and #02) salary range 327/350) in budget unit 424; and Allocate the following positions; 1.0 FTE Senior Program Manager (class 0933, salary range 289); 1.0 FTE Supervising Mental Health Clinician (class 0916, salary range 458); 1.o. FTE Social Worker IV position (class 0707A/0707B/0707C/0707D) salary range 388/402/404/434) 1.o FTE Administrative Analyst I/I (class 0626A/0626B, salary range 361/394) and 1.o FTE Vocational Trainee/Vocational Assistant (class 07421/0742, salary 259/273) in Budget Unit 424 effective on approval.

Health and Human Services - Public Health Branch

15.               Reallocate three (3) Office Assistant I/II positions to Medical Office Assistant I/II positions and two (2) Senior Office Assistant positions to Senior Medical Office Assistant positions in Fund 1175, Budget unit #400, Public Health Administration.

RECOMMENDATION: That the Board of Supervisors:  Reallocate the office Assistant I/II (class 0179, salary range 250/281, position 02) position in budget unit 400 currently occupied by Lyn Johnson to Medical Office Assistant I/II (class 0574, salary range 281/2990; and Reallocate the office Assistant I/II (class 0179, salary range 250/281, position 03) position in budget unit 400 currently occupied by Valerie Schagerto Medical Office Assistant I/II (class 0574, salary range 281/299); and Reallocate the unoccupied Office Assistant I/II (class 0179, salary range 250/281, position 04) position in budget unit 400 to Medical Office Assistant I/II (class 0574, salary range 281/299); and Reallocate the Senior Office Assistant (class 0135, salary range 316, position 01) position in budget unit 400, currently occupied by Patricia Deanton, to Senior Medical Office Assistant (class 0575, salary range 327); and Reallocate the Senior Office Assistant (class 0135, salary range 316, position 02) position in budget unit 400, currently occupied by Tim Howard, to Senior Medical Office Assistant (class 0575, salary range 327) effective the beginning of the pay period immediately following approval.

16.               Certification of Compliance for the Child Health Disability Prevention and California Children's Service Programs and adjust Fund 1175 , Budget Unit 418 CHDP Administration for Fiscal Year 2012-13.

RECOMMENDATION: That the Board of Supervisors:  Authorize the Chair of the Board to sign the Certification Statement for the Child Health and Disability Prevention and California Children's Service Programs; Direct the Clerk of the Board to return the two signed original Certification Statements to Public Health for submission to the State Department of Health Services; and Approve and direct the Auditor-Controller to adjust Fund 1175, Budget unit 418 Child Health and Disability Prevention Administration in the amount of $71,928 for the 2012-13 fiscal year per attachment 3.

Health and Human Services - Social Services Branch

17.               Approve Agreement with Humboldt Area Foundation Betty Chinn Homeless Fund to assist with CalFresh Outreach and support activities.

RECOMMENDATION: That the Board of Supervisors:  Approve Agreement with Humboldt Area Foundation Betty Chinn Homeless Fund to assist the Department of Health and Human Services to increase utilization of CalFresh  benefits by eligible households; and Authorize the Chair to execute three (3) copies of the Agreement (Attachment 1); and Direct the Clerk of the Board to route two (2) fully executed copies of the Agreement to the Department of Health and Human Services (DHHS)-Social Services Administration.

Public Defender

18.               Lease Agreement with Carter Properties, for Office Space for the Alternate Counsel Office at 931 Third Street and Supplemental Budget for Alternate Counsel (1100-253_ in Fiscal Year (FY) 2012-13.

RECOMMENDATION: That the Board of Supervisors: Approve the lease for 931 Third Street, Eureka from January 1, 2013, at a beginning rental rate amount of $1,868.00 per month; Authorize the chairperson to execute the lease; Direct the Clerk of the Board to return one executed lease to Real Property Services for transmittal to Lessor; and Approve the attached supplemental budget for FY 2012-13 in the amount of $28,770. (4/5 vote require).

Public Works

19.               Briceland-Thorne Rd and Shelter Cover Rd Curve Realignment Project at PM 1.60, 1.80, 1.90, 2.00 & 3.80,5.70; Project No.: HRRRL, 5904(089) EA 01-924820L, Contract No.: 207003

RECOMMENDATION: That the Board of Supervisors:  Approve the plans and specifications; and Direct the Clerk of the Board to advertise the above mentioned project as required by Section 22037 of the California Public contract Code with Bids to be opened on Tuesday, January 29, 2013 at 2:00pm.

20.               Public Health Furnace Replacement Project, County of Humboldt, Project No. 162312.

RECOMMENDATION: That the Board of Supervisors:  Accept the work of Adams Commercial General Contracting as substantially complete for their portion of the Public Health Furnace Replacement Project; and Authorize the Public Works Director to file the Notice of Completion for Adams Commercial General Contracting portion of the project as required; and Authorize the Public Works Director to sign Change Order No. 3.0 for a $29,053 cost increase.

21.               Bid Authorization for Humboldt County Arcata/Eureka Airport Construction of Seventeen (17) Units of T-Hangars, Project No. 381123.

RECOMMENDATION: That the Board of Supervisors:  Receive the plans and specifications and Authorize the Clerk of the Board to advertise the above mentioned project, pursuant to Section 22073 of the California Contract Code, with bids to be opened on Tuesday, February 5, 2013 at 2:00pm.

22.               Donation of Road Fund Equipment to the County Heavy Equipment for Capitalization, Maintenance and Insurance.

RECOMMENDATION: That the Board of Supervisors approve the dination of the attached list of equipment to the County Heavy Equipment Division for capitalization, maintenance and insurance purposes.

Treasurer-Tax Collector

23.               Appointment of Board of Directors-Humboldt County Public Property Leasing Corporation.

RECOMMENDATION: That the Board of Supervisors appoint the following individuals as Directors of the Humboldt County Public Property Leasing Corporation (HCPPLC) for the 2013 calendar year: Bruce Rupp and Greg Bowen.

1.                   Resolution Recognizing Deborah Davis on her Retirement from the Sheriff's Office. (Supervisor Virginia Bass)

RECOMMENDATION: That the Board of Supervisors adopt the Resolution.

RECOMMENDATION: That the Board of Supervisors hear the report and take action if needed.

County Administrative Office

2.                   Adoption of 2013 State and Federal Legislative Platforms.

RECOMMENDATION: That the Board of Supervisors:  Receive staff report on the proposed state and federal legislative platforms for 2013; Provide input and direction to staff as desired on six federal policy issues to receive priority federal advocacy services; Adopt the proposed State and federal legislative platforms, incorporating any changes desired by the Board, as the final platform for 2013; Direct the County Administrative Officer to submit the final version of the State legislative platform to Governor Jerry Brown, Assembly Member Wesley Chesbro, State Senator Noreen Evans, California State Association of Counties and Peterson Consulting; Direct the County Administrative Officer to submit the final version of the federal legislative platform to U.S. Representative Jared Huffman, U.S. Senators Dianne Feinstein and Barbara Boxer, National Association of Counties, and Waterman & Associates; and Authorize and direct the County Administrative Officer to submit letters to State and federal representatives as needed to support the County's legislative platform during 2013.

In-Home Supportive Services Public Authority

3.                   Humboldt County Public Authority for In-Home Supportive Services (IHSS) Adoption of Amendments to IHSS Advisory Board ByLaws, Advisory Board Membership and Presentation of the HISS Advisory Board Survey Results.

RECOMMENDATION: That the Board of Supervisors:  Adjourn as Humboldt County board of Supervisors and  Convene as the Governing Board of the Humboldt County In-Home Supportive Services (IHSS) Public Authority and consider the following agenda:  a. Approve amendments to the By Laws (Attachment 1) of the IHSS Advisory Board to the Public Authority; b. Approve recommendations for removal and appointment of Advisory Board Members; c.  Receive and file the IHSS Advisory Board Survey results (Attachment 2) and hear presentation of Survey Results; d.  Direct the Clerk of the board to send an executed copy of the agenda item to the IHSS Public Authority Executive Director.; and reconvene as Humboldt County Board of Supervisors.

RECOMMENDATION: That the Board of Supervisors:  Open the Public Hearing; Introduce Ordinance No. ____ (Attachment B) by title and waive further reading; Receive staff report and public testimony; Based on the staff report and testimony about the project, approve the modifications to the Q-Qualified Zone that applies to the property to add professional offices to the list of allowed uses by approving the attached Resolution No._____(Attachment A), and adopting Ordinance No._____(Attachment B), which amends Section 311-7 of Division 1 of Title III of the Humboldt County Code (Designation and Adoption of Zoning Maps); Direct the Clerk of the Board to publish a summary of the Ordinance along with a map of the property (Attachment C) within 15-days after adoption of the ordinance by the Board, along with the names of those supervisors voting for and against the ordinance, and to post in the Office at the Clerk of the Board of Supervisors a certified copy of the full text of the adopted ordinance along with the names of those supervisors voting for and against the ordinance;  Direct the Clerk of the Board to give notice of the decision to the Applicant and any other interested party and to five notice of the Zone Reclassification to the Assessor, by sending that office a copy of the executed Ordinance signed by the Chair and the Clerk of the Board, and Direct Planning and Building Department - Planning Division to file Notice of Exemption pursuant to California Environmental Quality Act (CEQA); and Close the public hearing.

1.                   Resolution Affirming County of Humboldt's Commitment to Creating Jobs and Sustainable Economic Growth through Humboldt Bay's Harbor. (Supervisor Bohn & Supervisor Bass)

RECOMMENDATION: That the Board of Supervisors authorizes the Chair to sign the Resolution.

2.                   County Administrative Officer Report: Clarification of Board Subcommittee Regarding Courthouse Property Use Ordinance, City of Arcata Annexation and Various Other Topics.

RECOMMENDATION: That the Board of Supervisors receive an oral report from the County Administrative Officer seeking clarification on a potential meeting between a Board subcommittee and a subcommittee of the Human Rights Commission regarding the Courthouse property use ordinance, an annexation referral from the City of Arcata, and various other topics as may be required.

3.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.
