B.                  SUPPLEMENTAL AGENDA ITEMS

1.                   Classification Review - Library Circulation Manager.

RECOMMENDATION: Approve the allocation of the Library Circulation Manager position currently occupied by Ronda Wittenberg in budget unit 621, (salary range 374, class 0654) to the class of Library Division Manager (salary range 407, class 0652) and delete the class of Library Circulation Manager from the compensation plan effective the beginning of the first biweekly pay period following approval.

2.                   Conference with legal counsel.Existing litigation pursuant to Code Section 54956.9(a), Brian and Cheryl Nunn v. Phillip Crandall, et. al., Superior Court of California, County of Sacramento, Case #05CS01457.

RECOMMENDATION:

3.                   Relocation Assistance Authorization

RECOMMENDATION: Approve and authorize the Chair to authorize relocation expenses for Stephen Williams, M.D., and Psychiatrist of $3,233.44.

4.                   Proclamation in Support of Memorial Recognition of Dr. John Joseph Montgomery (Supervisor Rodoni)

RECOMMENDATION: Adopt the Proclamation

C.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Auditor-Controller

1.                   Audit contract for fiscal year ended June 30, 2006.

RECOMMENDATION: Approve the proposed contract with Donald R. Reynolds, CPA, to audit the financial statements of the County of Humboldt for the fiscal year ended June 30, 2006, and authorize the Chairman to sign the agreement.

Board of Supervisors

2.                   Fortuna Union Elementary School District Requests the Board Authorize the Placement of a School Bond Issuance Proposition on the November 7, 2006 Ballot. (Supervisor Rodoni)

RECOMMENDATION: Approve the request and forward to the Elections Department for processing.

3.                   The City of Ferndale Requests the Board to Authorize a Consolidated Election with County Elections for Two City Council Seats and the Mayor's Office on November 7, 2006. (Supervisor Smith)

RECOMMENDATION: Authorize the request and forward to the Elections Department for processing.

4.                   Letter of Appreciation to Douglas Bosco, Chairman of the Board of Directors and Sam Schuchat, Executive Director of the California Coastal Conservancy. (Supervisor Woolley)

RECOMMENDATION: Ratify letter of appreciation.

5.                   Letter of Congratulations to Lloyd Throne, Executive Director, Redwood Community Action Agency on his Appointment by Governor Schwarzenegger as the State Director of Community Development Services. (Supervisor Woolley)

RECOMMENDATION: Ratify letter of congratulations.

6.                   Access Restriction for Cattle Trucks through Richardson Grove. (Supervisor Rodoni)

RECOMMENDATION: Direct the Public Works Department to provide a third party analysis for Access through Richardson Grove by Cattle Trucks to include an accident history for the last three years, review of most of California Highway Patrol reports on this issue, review and identification of specific Constricted Locations within the Richardson Grove stretch of Highway 101, review of other California or Federal legal exemptions for trailers and any other information as required by Senator Chesbro's office.

Clerk of the Board

7.                   Request From the Jacoby Creek Charter School District for Consolidation of its Bond Election with the State-Wide General Election on November 7, 2006

RECOMMENDATION: Approve request for consolidation with the condition that the District reimburse the County for costs incurred pursuant to this request.

8.                   Reappointments to the Humboldt County Fish and Game Advisory Commission

RECOMMENDATION: Reappoint, and send letter of appreciation to Johanna Rodoni for her years of service on the Commission.

9.                   Reappointments to the Board of Directors for the Petrolia Cemetery District

RECOMMENDATION: Reappoint Patty Mendes and Joe Zanone with terms to expire on June 30, 2010.

10.               Williamson Act Real Estate Disclosure Statement - Ordinance - Final Adoption.

RECOMMENDATION: Adopt Ordinance No. 2367 repealing Ordinance No. 2356 that added Section 2161-1, Chapter 1, Division 16, to Title II, of the Humboldt County Code requiring a Real Estate Disclosure Statement for transfer of land subject to the Williamson Act and Re-enacting it with an identically numbered section in order to cure a procedural error in the first adoption.Direct the Clerk of the Board to publish the Summary of Publication after the adoption within fifteen (15) days following adoption.

Community Development Services

11.               Approve the 2004 Headwaters Fund grant for $50,000 for an Economic Development Web Portal Project.

RECOMMENDATION: Approve the Headwaters Fund Board's recommended Headwaters Fund Grant of up to $38,000 to the Community Development Services Department and up to $12,000 to the Redwood Region Economic Development Commission for a total of $50,000 for an economic development Web Portal Project.Authorize Chair of the Board to sign two grant-related contracts when completed, one for $12,000 with the Redwood Region Economic Development Commission and one for $38,000 with Community Development Services Department after review and approval by County Counsel and Risk Management Director/Deputy CAO.

County Administrative Office

12.               Assessment Appeals Board - Ordinance - Final Adoption.

RECOMMENDATION: Adopt Ordinance #2366 amending sections 2212-2 through 2212-6, and adding section 2212-9 to the Humboldt County Code relating to the Assessment Appeals Board, and Direct the Clerk of the Board to post the two Assessment Appeals Board positions to coincide with a final selection being made prior to the beginning of the next term, which is September 4, 2006.

13.               Publication of Ordinance Summary for Adoption of 2006-07 Fee Updates.

RECOMMENDATION: Direct the Clerk of the Board to post and publish the required pre-adoption summary of the ordinance and public hearing notice for updating the Humboldt County Schedule of Fees and Charges at least ten (10) days prior to the public hearing.Direct the Clerk of the Board to have the data and documentation supporting the new fees for public review at least ten (10) days prior to the public hearing, and direct the Clerk of the Board to post a certified copy of the full text of the proposed ordinance in the office of the Clerk of the Board of Supervisors at least five (5) days prior to the Board meeting at which the ordinance will be adopted (Government Code Section 25124(b)(1).

Health and Human Services - Mental Health Branch

14.               Extension of Lease Agreement with Johnson's Mobile Solutions for Modular Building Located at 2933 H Street, Eureka.

RECOMMENDATION: Approve exercising the option to extend the lease agreement with Johnson's Mobile Solutions for $2,091.38 per month, tax included, for a modular building located at 2933 H Street for Department of Health Services, Mental Health Branch from November 1, 2006 through October 31, 2007.Authorize Real Property to send a notice to Lessor that County is exercising the option to extend the lease.Direct the Clerk of the Board to return one (1) executed agenda item to Real Property.

Health and Human Services - Public Health Branch

15.               Correction to Allocation Table for Fiscal Year 2006-2007 for the Pharmacist Position in Budget Unit 400, Fund 1175.

RECOMMENDATION: Approve a correction to the Allocation Table for Fiscal Year 2006-2007 for the filled Pharmacist (Salary Range 458, Class 0502), position 01, in budget unit 400, fund 1175 currently occupied by Raquel Selinger, from a .5 to .8 FTE, effective retroactive to July 1, 2006.

16.               Approve resolution designating the Humboldt Waste Management Authority as lead agency for the Used Oil Block Grant from the California Integrated Waste Management Board.

RECOMMENDATION: Approve the resolution designating the Humboldt Waste Management Authority as the County lead agency for the Used Oil Recycling Block Grant from the California Integrated Waste Management Board.Authorize the Chair to sign resolution and Direct the Clerk of the Board to return signed original resolution to Environmental Health for processing.

17.               Approval of budget revision and agreement with California Department of Health Services for Project Leaders Encouraging Activity and Nutrition (Project LEAN), Fund 1175, Fiscal Year 2006-2007.

RECOMMENDATION: Approve Agreement Number 06-55336 with the California Department of Health Services.Authorize Chair to sign the first page of the completed agreement package and seven (7) additional copies, and the first page of the Contractor Certification Clauses.Direct the Clerk of the Board to return the complete agreement package, the seven (7) additional face sheets, and the Contractor Certification Clauses to the Public Health Branch.Approve a budget revision in Fund 1175, budget unit #436, Project LEAN, and direct the Auditor Controller to revise the budget as requested.

Public Works

18.               Final Construction of Briceland Thorne Road Between PM 5.50 and 5.65, County Project Number 203851, FY 2005/2006.

RECOMMENDATION: Authorize the Director of Public Works to sign Contract Change Order Number 3 for the total amount of $18,511.96.Accept the completed contract between John N. Petersen, Inc., Contractor, and Humboldt County for the construction of Briceland Thorne Road.Approve supplemental budget for payment of the final claim and approve the claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $23,612.30.

Sheriff

19.               Acceptance of amended agreement number 2006-21 between the County of Humboldt and the Drug Enforcement Administration of the United States Department of Justice.

RECOMMENDATION: Accept amended letter of agreement, number 2006-21, authorize the Chair to sign, Request for Advance or Reimbursement, authorize the Sheriff to sign agreement number 2006-21 and instruct the Clerk of the Board to return the signed original documents to the Sheriff's Office for further processing.

20.               Acceptance of Funds from NOAA/National Weather Service Office and Supplemental Budget (06/07).

RECOMMENDATION: Accept the Statement of Work, Order for Supplies or Services, from the National Weather Service, Western Region.Approve supplemental budget in Sheriff's budget 1100 274, Office of Emergency Services (OES) in the amount of $12,300, to retrofit three donated outdoor Tsunami Warning sirens with controlling equipment.
