A.                  SALUTE TO THE FLAG


1.                   Supplemental Item (CLOSED SESSION) - It is the intention of the Board of Supervisors to meet in closed session to consider the appointment for the position of County Librarian pursuant to Government Code Section 54954.5.

2.                   Supplemental Item (Public Works) - Office Space Remodel and Renovation - Building A, Koster Campus for Humboldt County Department of Health and Human Services.

RECOMMENDATION: Authorize the Public Works Director to sign Change Order No. 2.0 for an additional $26,396 to the contract price, and an additional 27 calendar days to the contract time.

1.                   Proclaim October 2006 as Lupus Awareness Month (Supervisor Woolley)

RECOMMENDATION: Adopt the Proclamation

2.                   United Way of Humboldt's Annual Fund-Raising Campaign (Supervisor Neely)

RECOMMENDATION: Approve placement of the United Way Thermometer in front of the Courthouse during October and November 2006.

3.                   Request for Ratification of Letter Authorized on September 12, 2006 Regarding Collaborative Efforts and Support for Public-Private Partnerships for the Future of St. Joseph Hospital (Supervisor Woolley)

RECOMMENDATION: Approve request.

Coroner-Public Administrator



4.                   Transfer of $10,000 from the General Fund Contingency to Provide Funding for a Coroner's Inquest Scheduled to be Held September 12, 2006

RECOMMENDATION: Approve transfer.

County Administrative Office

5.                   U. S. Forest Service Title III Funding

RECOMMENDATION: Elect to reserve 15% of the Forest Service reserve payments for County projects under Title III, and direct staff to notify the U. S. Department of Agriculture, Forest Service, accordingly.

Health and Human Services - Administration



6.                   Authorization to Negotiate Employment Agreements and Relocation Reimbursement for Physicians

RECOMMENDATION: Authorize the Director of Health and Human Services, or his designee, to negotiate and execute individual employment agreements, excluding salary range, for employees in the class of Physician/Psychiatrist, Medical Director, County Physician, and Assistant County Physician.  Authorize the Director of Health and Human Services, or his designee, to approve reimbursement of relocation expenses in an amount not to exceed $3,500 for employees appointed to a position in the class of Physician/Psychiatrist, Medical Director, County Physician, and Assistant County Physician.

7.                   Request for Approval of a Supplemental Budget ($15,625) and Continuation Grant Award from California Governor's Office of Emergency Services for North Coast Regional Child Death Review Project

RECOMMENDATION: Approve request.




8.                   Request for an Overlap of Three Pay Periods in the Hiring for the Administrative Analyst I/II Position Pursuant to the Retirement of John Stopkowicz Effective December 29, 2006

RECOMMENDATION: Approve request.

Public Works

9.                   Ordinance Adding Section 431-34 of the Humboldt County Code Relating to Parking on Fern Street

RECOMMENDATION: Adopt Ordinance No. ____.

10.               Reallocation of County Architect Position to Deputy Public Works Director-Facilities Management

RECOMMENDATION: Delete the class of Architect from the Classification Plan.  Adopt the classification of Deputy Public Works Director-Facilities Management into said Plan.  Approve the reallocation of the Architect position currently occupied by Tyler Holmes in Budget Unit 171, to the class of Deputy Public Works Director-Facilities Management position in Budget Unit 162.



11.               Pay Differential for Craig Wilson, Facility Maintenance Supervisor

RECOMMENDATION: Authorize the continuation of the temporary increase in compensation for Facility Maintenance Supervisor, Craig Wilson, of ten salary ranges from September 23, 2006 and continuing through December 30, 2006, or until the adoption, recruitment, and hiring of the new classification of Facility Maintenance Manager is completed (whichever occurs first).

12.               Allocation of a Full-Time Facility Maintenance Manager Position

RECOMMENDATION: Adopt the new classification of Facility Maintenance Manager into the Classification Plan.  Allocate one full-time Facility Maintenance Manager position in Budget Unit 162.



13.               Pay Differential for David Ryan, Associate Land Surveyor

RECOMMENDATION: Approve the continuation of a temporary increase in compensation of ten salary ranges for Associate Land Surveyor, David Ryan, for service as County Surveyor, from September 24, 2006 through January 27, 2007, or until the County designates a County Surveyor position (whichever occurs first).



14.               Lease with the Federal Aviation Administration for Terminal Office Space at the Arcata-Eureka Airport ($38,940 Annual Payment to Humboldt County)

RECOMMENDATION: Extend existing lease through September 30, 2008.  Approve a ten percent (10%) increase in the rental amount in order to compensate for the cost-of-living increases that have occurred in the past five years since the current lease was executed.

15.               Overflight Easement to the County of Humboldt Executed by Frank R. Bickner and Darcia A. Short for the Benefit of the Arcata-Eureka Airport

RECOMMENDATION: Accept overflight easement.

16.               Grant Allocations from the Humboldt County Fish and Game Advisory Commission

RECOMMENDATION: Approve the following grant allocations:  1)  $1,500 to the Eel River Salmon Restoration Project for the Salmon in the Classroom Program; 2) $3,000 to the City of Arcata's Environmental Services Department for Lower Beith Creek Fish Habitat Restoration; 3)  $1,500 to Bradford Norman for restoration of salmonid habitat in the Klamath River drainage through invasive species removal; and 4)  $1,500 to the Hoopa Valley Tribe & Wildlife Conservation Society for Pacific Fisher conservation.


17.               Approval of 2007 Annual Operating Plans for Cooperative Patrol and Controlled Substance Operations Between the Humboldt County Sheriff's Department and the Six Rivers National Forest

RECOMMENDATION: Authorize the Chair and the Sheriff to sign said plans.

18.               Request to Authorize the Sheriff to Sign Documents Necessary to Submit a Request for Application for the California Multi-Jurisdictional Methamphetamine Enforcement Team (Cal-Mett) Program

RECOMMENDATION: Approve request.


1.                   Resolution of Commendation for Lin Glen on Her Retirement from the Health and Human Services Department, Public Health Branch (Supervisor Woolley)

RECOMMENDATION: Adopt the Resolution.

2.                   Proclaim October 7, 2006 as Humboldt Solar Neighbors Tour Day (Supervisor Smith)

RECOMMENDATION: Adopt the Proclamation.

3.                   Resolution Recognizing the North Coast Stand Down Committee (Supervisor Smith)

RECOMMENDATION: Adopt the Resolution.

4.                   Proclaim September 22, 2006 as "American Indian Day" (Supervisor Neely)

E.                  DEPARTMENT REPORTS

County Administrative Office (CAO)

1.                   Vehicle Use Committee

RECOMMENDATION: Adopt the recommendations of the Vehicle Use Committee for Fiscal Year 2006-07.  Thank the Committee members for their service, and disband the Committee.

Health and Human Services - Mental Health Branch

2.                   Travel Reimbursement for Members of Crisis Intervention Team

RECOMMENDATION: Approve travel reimbursement for Tim Ash, member of the local affiliate of the National Alliance for the Mentally Ill; and Tony Zanetti, Eureka Police Department Officer, to attend the National Crisis Intervention Team conference in Orlando, FL on September 25-27, 2006 as part of an integrated crisis-intervention response team.


3.                   Participation Agreements with the Six Rivers National Forest Service for the Juvenile Assigned Work Service Program, and with Six Rivers National Forest and the Humboldt County Office of Education for the Probation Environmental Preservation Project

RECOMMENDATION: Authorize Chair to execute said agreements.

I.                     ADMINISTRATIVE ABATEMENT HEARING - 1:45 p.m.

Code Enforcement Unit

1.                   Humboldt County vs. Glenda Rasella; Assessor's Parcel No. 510-281-002; 2225 Walker Road, McKinleyville (Continued from August 15, 2006)

RECOMMENDATION: Find the conditions of the property of the subject premises constitute a public nuisance.  Order the property owner to abate all violations on or before October 16, 2006, including a final inspection by the Code Enforcement Unit.  Order that, in the event such abatement is not commenced, prosecuted and completed by the property owner within the terms set by the Board, that the Code Enforcement Unit shall be empowered and authorized to abate such nuisance, and shall return to the Board for its consideration of an appropriation to abate such nuisance, and that the costs of abatement shall become a lien on the subject property.

J.                   PUBLIC HEARINGS

Community Development Services

1.                   BOYD Zone Reclassification/Lot Line Adjustment; File No. 216-261-37; Case Nos. LLA-05-11/DS-05-16/ZR-05-05; Alderpoint Area

RECOMMENDATION: Approve the Zone Reclassification amending Section 311-7 of the Humboldt County Code by realigning the existing zoning boundary between the Forest Recreation zone (1-acre minimum) and the Forest Recreation (5-acre minimum) to follow the newly-adjusted lot line, and adopt Ordinance No. ____.

2.                   Appeal of the Community Development Services Director's Determination that the Relocation of Zoe Barnum High School to the Worthington Elementary School Campus in the Myrtletown Area Does Not Constitute an Intensification of Use Under the Coastal Act; Case No. IR-06-03A; File No. APN 016-151-15

RECOMMENDATION: Uphold the Community Development Services Director's determination, and find the proposed change of use exempt from a Coastal Development Permit by adopting Resolution No. 06-__.

County Counsel

3.                   An Action to Rescind the Approval of a Project to Modify a Conditional Use Permit, Surface Mining Permit and Reclamation Plan to Add a Rock Crusher to an Existing Surface Mining Operation, Owned and Operated by Jack Noble, Case Nos. CUP-19-94MA, SMP-03-94; File No. 204-111-09, Hydesville Area

RECOMMENDATION: Review and consider Jack and Mary Noble's request that the Board rescind its January 3, 2006 approval of the project to modify a conditional use permit, surface mining permit, and reclamation plan to add a rock crusher to their existing surface mining operation.  Rescind the January 3, 2006 approval of the project to modify a conditional use permit, surface mining permit, and reclamation plan by adding a rock crusher to an existing surface mining operation, Case Nos. CUP-19-94MA, SMP-03-94 & RP-03-94, including the action take on that date to adopt the Supplement to the 1997 Final Supplemental Environmental Impact Report prepared for the modification project.
