B.                  SUPPLEMENTAL AGENDA ITEM (CLOSED SESSION)

1.                   It is the intention of the Board of Supervisors meet in Closed Session to consider the public employee performance evaluation for the position of County Administrative Officer pursuant to Government Code Section 54954.5.

C.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Board of Supervisors

1.                   Request for Ratification of Letter Authorized on September 12, 2006 Regarding Collaborative Efforts and Support for Public-Private Partnerships for the Future of St. Joseph Hospital (Supervisor Woolley)

RECOMMENDATION: Approve request.

2.                   Letter of Appreciation to Donald Fidjeland for His Service on the Loleta Fire Protection District Board (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign letter of appreciation.

3.                   Appointment of Jim Renner as Commissioner to the Loleta Fire Protection District Board (Supervisor Smith)

RECOMMENDATION: Appoint Jim Renner to the Loleta Fire Protection District Board.

4.                   Resolution of Commendation for Betty Briggs on Her Retirement from the Ferndale Chamber of Commerce. (Supervisor Smith)

RECOMMENDATION: Ratify the Resolution.

5.                   Resolution Honoring Lillian Ross Henderson for Her 100th Birthday on September 28, 2006 (Supervisor Neely)

RECOMMENDATION: Adopt the Resolution.

Community Development Services - Economic Development Division

6.                   Workforce Investment Area Local Plan Modification for Program Year 2006-07

RECOMMENDATION: Authorize Chair to sign Plan Modification.

County Counsel

7.                   Resolution Modifying Appendix B of the County's Conflict-of- Interest Code

RECOMMENDATION: Adopt Resolution No. 06-__, which reflects changes in the County positions and Committees which are required to report under the County's Conflict-of-Interest Code.

District Attorney

8.                   Supplemental Budget ($53,144) and Allocation of Victim-Witness Program Specialist; Child Abuse Services Team

RECOMMENDATION: Approve supplemental budget and position allocation.

Health and Human Services - Administration

9.                   Request for Approval of Exercising the Option to Extend the Lease, Executed on December 16, 2003 with the California Newspapers Partnership, Inc. Through November 30, 2007 for Social Services Office Space at 930 Sixth Street in Eureka

RECOMMENDATION: Approve request.

Health and Human Services - Mental Health Branch

10.               Appointments to the Mental Health Board

RECOMMENDATION: Appoint Bill Christensen and Monica Rivera to said Board.

Health and Human Services - Public Health Branch

11.               Contract with the Humboldt Waste Management Authority for the Transfer of Waste Reduction and Used-Oil Programs for Fiscal Years 2006 and 2007

RECOMMENDATION: Authorize Chair to sign said contract.

Probation

12.               Request for Temporary Increase in Compensation for Juvenile Corrections Officer Meara McCovey as Supervising Juvenile Corrections Officer

RECOMMENDATION: Approve request.

13.               Resolution Allowing the Chief Probation Officer to Submit an Application to, and Sign All Subsequent Grant-Related Paperwork Associated With, the Corrections Standards Authority Funding Under the Enhanced Disproportionate Minority Contact Technical Assistance Project

RECOMMENDATION: Adopt Resolution No. 06-__.

Public Works

14.               Annual Transportation Development Claim ($2,415,940)

RECOMMENDATION: Authorize Chair to sign said claim for forwarding to the Humboldt County Association of Governments.

15.               Surplus Property

RECOMMENDATION: Declare the following property surplus:  one 2000 Ford Crown Victoria (No. 07182); one 2001 Ford Crown Victoria (No. 07188); one 1989 Ford E-350 (No. 17407); one 1963 Caterpillar motor grader (No. 71782); one 1987 JCB loader/backhoe (No. 43868); one trailer axle; one Lincoln gas-powered welder (No. A1058032); four Husqvarna 51 chainsaws (motor only); one Husqvarna 55 chainsaw (motor only); two Husqvarna 350 chainsaws (motor only); and miscellaneous chainsaw parts.  Authorize the Purchasing Agent to dispose of the surplus property when the Equipment Superintendent puts the replacements in service.

16.               Janes Creek Flood Control District

RECOMMENDATION: Authorize up to $8,500 for repair of the low-head tide gates at the mouth of Janes Creek.  Direct staff to pursue dissolution of this District with all excess funds transferred to the City of Arcata for Janes Creek drainage improvements.

17.               Construction of Storm Damage Repairs on Alderpoint Road; Project No. ER 3812 (007); Contract No. 203137

RECOMMENDATION: Award the project to Jurin Construction, Inc.

18.               Agreement with Kelly-O'Hern Associates, Professional Land Surveyors, for the Mattole Monument Preservation Fund Survey ($26,500)

RECOMMENDATION: Authorize Chair to executed said agreement.

19.               First Amendment to Lease with the U.S. Department for Agriculture for a Portion of the County-Owned Building Located at 5630 Broadway in Eureka

RECOMMENDATION: Authorize Chair to execute lease amendment, and allocate $7,200 to Facility Management for additional custodial services.

D.                  SPECIAL PRESENTATIONS

1.                   Resolution in Honor of Tim McKay for His Lifetime of Work (Supervisor Woolley)

RECOMMENDATION: Adopt the Resolution.

2.                   Proclaim September 24-30, 2006 as "Childhood Lead Poisoning Prevention Week" (Supervisor Neely)

RECOMMENDATION: Adopt the Proclamation.

E.                  DEPARTMENT REPORTS

Community Development Services - Economic Development Division

1.                   Approval of the Headwaters Fund Board's Recommended Grant Fund Competitive Award Grants

RECOMMENDATION: Authorize Chair to sign grant contracts with the following:  Redwood Region Economic Development Commission ($37,500 for a Passenger Demand Analysis); Economic Development Division ($44,000 for the County's Industry Cluster support work); Community Development Services ($20,000 for support of the public interface software portion of an overall project to streamline the permit process); Center for Environmental Economic Development ($40,000 for support to complete the environmental review and design development phases of a Sustainable Living Lodge and Eco-Hostel); Community Alliance with Family Farmers ($17,317 to increase regional and statewide marketing of local produce); and North Coast Small Business Resource Center ($12,950 to support the development of an Artisan Wine Guild and joint marketing strategies and materials for local vintners);

F.                  MATTERS INITIATED BY BOARD MEMBERS

RECOMMENDATION: Receive reports, and take appropriate action (if required).

2.                   Standing Item--Pursuant to Government Code Section 54957.6, Review the County's Position, and Instruct Designated Representatives with Respect to the Various Forms of Compensation Provided to the County's

3.                   Standing Item--Report on Pending or Threatened Litigation Pursuant to Government Code Section 54956.9   (if required)

4.                   Conference with Legal Counsel - Existing Litigation Pursuant to Government Code Section 54956.9(a).  County of Humboldt v. Robert C. McKee; Humboldt County Superior Court, Case No. DR020825

5.                   Standing Item--Adjourn as County Board of Supervisors, and Reconvene as Humboldt County Public Authority.  Pursuant to Government Code Section 54957.6, Conference with Labor Negotiator.  It is the intention of the Board of the Humboldt County Public Authority to meet in Closed Session to have a conference with its Labor Negotiator to review and instruct designated representatives with respect to the various forms of compensation provided to represented and unrepresented personnel of the Humboldt County Public Authority.

H.                  PUBLIC APPEARANCES--1:30 P.M.

This 15-minute portion of the meeting is reserved for persons desiring to address the Board on any matter not on this agenda that is under the jurisdiction of the Board. It is requested that speakers sign the sheet at the front doors of the Chamber by 1:25 p.m.
