3.                   Letter Requesting Secretary Gale Norton, Department of Interior to Expedite Release of Humboldt County's 50,000-Acre-feet of Water Per the 1955 Trinity River Division Act   (Supervisor Geist)

RECOMMENDATION: Authorize Chair to sign letter.

4.                   Certificate of Achievement for Shane Aguilar on Achieving the Rank of Eagle Scout   (Supervisor Geist)

RECOMMENDATION: Disallocate a vacant Revenue Recovery Technician position, and allocate a Revenue Recovery Officer I/II position.

8.                   Proposed Procedure for Submittal of Board Agenda Reports

RECOMMENDATION: Adopt the submitted procedure for submittal of board agenda reports.

9.                   Exemptions to the Hiring Freeze

RECOMMENDATION: Approve exemptions as listed in submitted report.

General Services

10.               Ordinance Regulating the Occupancy and Use of Public Rights of Way by Cable Systems and Open Video Systems, Providing for Establishment of Customer Service Standards; Establishing Franchise and Licensing Requirements for Operators of Such Systems and Prescribing Minimum Charges, Terms, and Conditions for and Upon the Construction, Maintenance, and Repair of Such Systems by Adding Division 5 to Title VIII of the Humboldt County Code

RECOMMENDATION: Introduce ordinance by title, waive first reading, and schedule ordinance for adoption on April 20, 2004.

11.               Request for Extension of Extra-Help Hours for Budget Unit 424

RECOMMENDATION: Extend Joe McManus, Medical Office Assistant I, to a maximum of 2040 hours, and extend Jo Anne Frick, Office Assistant II to a maximum of 2080 hours.

RECOMMENDATION: Receive and file report.

13.               Approval of Contract Amendment No. 02-25677-A1; Public Health Fund 1175; Budget Unit 415, and Approval of a Supplemental Budget for Fiscal Year 2003-04

Health and Human Services - Social Services Branch

14.               Authorize Temporary Increase in Pay for Jeannette Rathjen, Integrated Caseworker II, to the Level of Supervising Integrated Caseworker

RECOMMENDATION: Approve temporary pay increase for a period of six months, or until such time as the regular supervisor returns to her position, whichever occurs first.

15.               Allocate One Full-Time Program Manager II Position in Budget Unit 511

RECOMMENDATION: Approve allocation, and exempt newly-allocated position from the hiring freeze.

Library Services

16.               Extension of Extra-Help Hours for Kathryn Wright

RECOMMENDATION: Approve extension to a maximum of 1300 hours.

Public Works

17.               Financial Assurances for Reclamation of Quarry Sites

RECOMMENDATION: Adopt Resolution No. 04-__, authorizing the annual adjustment of the funds pledged by the Public Works Department to complete reclamation of rock and gravel quarry sites.

18.               Overflight Easement to the County of Humboldt Executed by Michael and Veralei Alves for the Benefit of the Arcata-Eureka Airport

RECOMMENDATION: Accept the Overflight Easement.

RECOMMENDATION: Approve allocation, and exempt newly-allocated position from the hiring freeze.

21.               Request to Authorize the Chair to Sign for the Governing Body Resolution and Certification and Grant Assurances for the Fiscal Year 2004 Homeland Security Grant Program

RECOMMENDATION: Approve request.

22.               Treasurer's Investment Policy

RECOMMENDATION: Approve Investment Policy for the Treasurer of Humboldt County.

Health and Human Services--Public Health Branch

1.                   Request for Approval of the 2003 Humboldt County Hazardous Materials Emergency Area Plan and the 2004 Exercise Program of the Area Plan

RECOMMENDATION: Approve request, and adopt Resolution No. 04-__, in support of the multi-agency Hazardous Materials Exercise Program, including both table-top and full-scale exercises.

2.                   Update on Proposed County Budget for Fiscal Year 2004-05

RECOMMENDATION: Receive update, take appropriate action, and schedule update as a standing agenda item.

3.                   Establishment of an Indian Gaming Local Community Benefit Committee

RECOMMENDATION: Accept Information Report, Indian Gaming Revenues--Special Distribution Funds.  Adopt resolution activating Humboldt County Indian Gaming Local Community Benefit Committee (LCBC).  Select two County representatives to serve on the LCBC.  Direct staff to request recommendations from the Cities of Blue Lake, Trinidad, and Arcata for three elected representatives.  Direct staff to contact Chairpersons of the Blue Lake Rancheria, the Hoopa Tribe, and the Trinidad Rancheria regarding appointment of two tribal representatives to LCBC.

J.                   ADMINISTRATIVE ABATEMENT HEARINGS--1:30 P.M.

Code Enforcement Unit

1.                   Administrative Abatement Hearing; Humboldt County vs. McCanless; Assessor's Parcel No. 106-061-061

RECOMMENDATION: Find the conditions of the property of the subject premises constitute a public nuisance.  Order the property owner to abate said nuisance, prescribing a reasonable time, not less than thirty (30) days, for the completion of such abatement.  Order that, in the event such abatement is not commenced, prosecuted, and completed by the property owner within the terms set by the Board, that the Code Enforcement Unit shall be empowered and authorized to abate such nuisance, and shall return to the Board for its consideration of an appropriation to abate such nuisance, and that the costs of abatement shall become a lien on the subject property.

1.                   Klamath River Aggregates Surface Mining Permit, Conditional Use Permit, and Reclamation Plan; Appeal of the Planning Commission Decision to Deny the Project; File No. APN 524-075-23; Case No. CUP-02-15/SMP-02-01/RP-02-01; Willow Creek Area (THIS AGENDA ITEM IS FOR BOARD DELIBERATION ONLY.  THE PUBLIC HEARING WAS HELD, AND CLOSED, ON MARCH 23, 2004.)

RECOMMENDATION: Uphold the appeal, and approve the project.
