CITY OF EUREKA - PARKING
INTRODUCTION

The Humboldt County Grand Jury reviewed the availability of handicap-accessible parking in parking lots owned by the City of Eureka. The Americans with Disability Act, Public Law 101-336, (ADA) took effect January 26, 1992. The ADA standard for Accessible design 4.1.2 (5) determines the minimum number of accessible parking spaces in a parking lot (See Exhibit A, attached.) Parking lots constructed after January 26, 1992, were required to meet the minimum ADA standards. Section 35.150 of the Title II of the ADA requires that a public entity should provide an adequate number of accessible parking spaces in existing parking lots. The last date for achieving accessibility for existing parking lots was January 26, 1995.

PROCEDURE

The grand jury interviewed a traffic technician for the City of Eureka and obtained a chart entitled "City of Eureka Public Parking Lots" dated January 2001. The grand jury contacted officials of the ADA section of the US Department of Justice and received from them various publications regarding The Americans with Disability Act.

The list of Eureka public parking lots contained five lots, numbered 24, 28, 30, 31, and 32, for which no parking space information was listed. Members of the grand jury inspected these lots, counted the parking spaces, and recorded the results on Exhibit B (See attached.)

FINDINGS

F-1 The City of Eureka has thirty-seven parking lots. (The location of the lots, the number of regular parking spaces, the number of van-accessible parking spaces, and the regular handicap parking spaces are shown in Exhibit B.)

F-2 The City of Eureka provides parking for the public in thirty-six of the parking lots. ( The lot at the Municipal Auditorium, lot Number 31, is not available to the public for parking.)

F-3 The City of Eureka does not meet the minimum ADA standards for van-accessible parking spaces in thirty-two of their public parking lots. They are lots numbered 1 through 24, 26, 29, and 32 through 37.

F-4 The City of Eureka does not meet the minimum ADA standards for regular handicap- accessible parking in twenty-two of their public parking lots. They are lots numbered 2, 4, 6, 8, 9, 12 through 15, 17 through 23, 25, 28, 29, 30, 34, and 36.

F-5 The City of Eureka has planned, in the summer of 2001, to resurface and restripe parking lots numbered 4, 6, 7, 8, 9, 12, 13, 14, 20, 22 and 23 as shown in Exhibit B. These lots will then meet the minimum ADA standards for accessible-handicap parking when completed.

CONCLUSION

C-1 The Humboldt County Grand Jury concludes the City of Eureka does not comply with the federal ADA law on all city parking lots with public access.

RECOMMENDATION

THE HUMBOLDT COUNTY GRAND JURY RECOMMENDS THE FOLLOWING:

R-1 The City of Eureka comply with the federal ADA law on all city parking lots with public access.
